WAIVER OF FULL READING Holden moved, second by Laszlo, to waive the reading in full of all ordinances and resolutions, and that consent to the waiver after reading of the title unless specific request is made at that I of reading shall be deemed to be given by all Council members time for the reading of such ordinance or resolution. Motion carried PUBLIC HEARING - FISCAL YEAR 1976-77 BUDGET Mayor Blackman declared the public hearing open to consider adoption of a budget for the City of Seal Beach for fiscal year 1976-77. The C~ty Clerk certified that notices had been published as required by law and that no communications had been received either for or against the matter. The City Manager stated that there was a 11% increase in revenues from property taxes and expenditures were up 10% in the General Fund due to inflation and new personnel, that I the proposed budget included continuation of the salaries for the animal control officers and firemen now being paid under the CETA Program. The City ~ager also stated that the proposed budget include d those changes directed at the budget study sessions as 6-28- 74 -' . '. - stated in his memorandum of June 17, 1976. for a total budget of $8,530,899, and that the budget was balanced and provided for continuation of service levels at their present cap~city.. There were no oral communications for or against the. proposed budget. I Mayor Blackman declared the public hearing closed. Councilman Gray elaborated, on his study of the budget and stated that he had recommendations for variances to this budget and moved that the 1976-77 budget burden for the City of Seal Beach be adopted with the inclusion of: 1) no additional employees shall be added to any department at this time and that no title changes shall be made simply to increase wages; 2) wage increases for Fire and Police Department personnel be limited to those provided by present and ongoing negotiations; 3) that total tax burden increases including salaries, wages, fringe benefits and pensions for all other employees in all departments be established at 3% above actual cost for 1975-76 without regard for what was budgeted for 1975-76; I 4) no change in Treasurer's budget over 1975-76 actual burden; 5) total personnel burden for the City Clerk's office be established at $21,000, anticipated at $11,000 for the City Clerk and $10,000 for a 40 hour certified Deputy Clerk; 6) subject to the referendum on the November ballot, I recoDDllend funding of a paramedic unit for $200,000; and 7) I recommend a reduction of the Police Department budget from the 1975-76 ac~ual e~ense by $200;000. Discussion followed with other members of the Coimcil speaking to some of the points and suggesting that each point be dealt with separately. Councilman Gray stated that his motion was to adopt the budget with the changes he had recommended. There was no second to Mr. Gray's motion. I Holden moved, second by Blackman, to adopt the budget presented with the contingency that the City Manager and department heads review each of Mr. Gray's proposals for consideration 'at a"later time. Councilman"Holden withdrew his motion as a result of the above motion., It was noted that there was no second to 'Mr. Gray's motion; Mi. Gray confimed that. lie wished' his motion to read as originally stated.' It.was clarified that there was still no second to Mr. Gray's motion, therefore the amending motion was not valid. Further discussion followed I regarding the..1976-77 budget for the City of 'Seal 'Beach.. Mayor Blackman moved to adopt the 1976-77 budget by Resolution Number 2567 entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, ADOPTING A 'BUDGET FOR THE CITY OF SEAL BEACH FOR FISCAL' YEAR 1976-77" to reflect the following changes: 1) that the tram drivers . positions not be made pemanent employees with the additional fringe benefit cost; 2) that the three new employees proposed)in the budget not be hired until a study is brought before the Council; and 3) that a study be made on the effects of a decrease in the' Police Department budget Of $200,000. Councilman-Laszlo seconded the motion. AYES: . Blackman; Holden, Laszlo , , I NOES: 'Gray; Kredelr Motion carried PUBLIC HEARING - APPEAL A-1-76 - MARVIN ALLISON Mayor Blackman declared the public hearing open to consider Appeal A-1-76 of Marvin Allison, A-113, Surfs ide , to construct a four story single family.residence in Surfside.' The City Clerk certified that notices had'been published and mailed as required by law and that no communications had been' received either for or-against the matter. Mr. Neprud, Planning Director, presented the staff report and recommendations of .the Planning Commission. Mr. Neprud reviewed the background of the Appeal and stated that the City's zoning code requires that buildings in Surfs ide be limited to three stories and thirty-five feet maximum height. I Mayor Blackman invited members of the audience,wishing to speak to this item to come to the microphone and state his name and address for the record. Mr. Moody, 16325 South Pacific Avenue, Sunset Beach, and representing Mr. AHison, was duly sworn by the,Clerk and spoke 6-28-76 " -' ' ~ -' in favor of the Appeal, further stating that the proposed master bathroom utilized the proposed existi~g floor and roof and would not be visible to anyone else in the area, and that the appellant was not utilizing the maximum living space allowable with this I plan. Discussion followed ~egarding density in the area and fire safety. There were no communications in opposition to the Appeal; Mayor Blackman declared the public hearing closed. Councilman Gray moved that the Appeal of Marvin Allison (A-1-76) be referred back to the Planning Commission for further study, stating that although no hardship ~as involved, the.Appellant should have the right to improve his pr~perty as long as this improvement did not interfere with the rights of residents in the area as to view, air and light. Councilman Holden seconded the motion, AYES: Blackman, Gray, Holden, Kredell, Laszlo NOES: None Motion carried Mayor Blackman requested that the Planning Commission review the zoning code as it relates to residential plans such as those I submitted above for Surfside. ORDINANCE NUMBER 993 - CHANGE OF ZONE - 7.113 ACRE PARCEL ON SEAL BEACH BOULEVARD Ordinance Number 993 was presented to Council for second reading by title "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH AMENDING THE ZONING MAP OF THE CITY OF SEAL BEACH BY CHANGING THE ZONE OF A 7,113 ACRE PARCEL OF LAND FROM M-l, LIGHT MANUFACTURING TO P.L.U., PUBLIC LAND USE." By unanimous consent, full reading of Ordinance Number 993 was waived, Holden moved, second by Gray, to adopt Ordinance Number 993 as presented. Councilman Kredell again stated for the record that he would support the Public Land Use Zone but not necessarily the designation for a Police Station in that zone. CONSENT CALENDAR Mayor Blackl1lan requested that Items "D" and "E" be removed from the Consent Calendar; members of the audience requested that Items "I" and "L" be removed from the Consent Calendar. Holden moved, second I by Laszlo, to approve the recommended action for items on the Consent Calendar except Items "D",-"E", "I", and "L" as presented. A. Approved the minutes of the regular adjourned meeting of June 12, 1976, the regular meeting of June 14, 1976, and the regular adjourned meeting of June 19, 1976 as presented. B. Approved regular demands numbered 19809 through 19920 in the amount of $205,617.70 and payroll demands numbered 14677 through 14948 in the amount of $115,805.27 as approved by~he Finance Committee and that warrants be drawn on the Treasury for the same. C. Ratified recommendation of the City Attorney I regarding claim of Patrick McMahon for personal expenses and authorized payment with appropriate release by the claimant. F. Approved request from Kare-Free Aluminum Products Company for refund in the amount of $48.50 for building permit fees. , G. Approved request from Seal Beach Art Association to use Dwight Eisenhower Park for the Annual Art Show to be held in conjunction with the Rough Water Swim on Sunday, July 25, 1976 from 10:00 a,m. until 4:00 p.m. H. Denied claim of Paul A. Sullivan for auto damage and referred same to the city's insurance carrier. I J. Denied claim of Luis Putic for property damage and referred same to the city's insurance carrier. K. Approved extension of Agreement between City of Seal Beach and State of California for use of State O.E.S. Pumper 158 and authorized the Mayor to 6-28-76 . AYES: execute the agreement on behalf of the City. Blackman, Gray, Holden, Kredell, Laszlo NOES: None Motion carried ITEM "D" - SEAL BEACH ROUGH WATER SWIM Mayor Blackman referred to the request to conduct the Eighth Annual Seal Beach Rough Water Swim and noted that this years event would take place on Sunday, July 25th and that further I information could be obtained from the City Clerk. Blackman moved, second by Gray, to approve the request from the Seal Beach Rough Water Swim Committee for ~e of the beach area west of the municipal pier and adjacent waters for the Eighth Annual Rough Water Swim. Meet on Sunday, July 25th, 1976. AYES: Blackman, Gray, Holden, Kredell, Laszlo NOES: None Motion carried ITEM "E" - ACQUISITION OF REGIONAL PARK - SECOND SUPERVISORIAL DISTRICT Mayor Blackman requested that no action be taken on this item as a result of a call from the City of Garden Grove. Mr. Tiernan, I Assistant to Supervisor Schmit, spoke in support of passing a resolution to support the acquisition of acreage for a regional park on the Nike base in the Second Supervisorial District. Discussion followed. Councilman Gray expressed concern regarding interfering with another city's fiscal responsibility. Further discussion followed. Councilman Holden moved to adopt Resolution Number 2568 entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH SUPPORTING THE ACQUISITION BY THE COUNTY OF ORANGE OF A REGIONAL PARK ON THE NIKE BASE IN THE SECOND SUPERVISORIAL DISTRICT." By unanimous cosent, full reading of Resolution Number. 2568 was waived. Councilman Kredell seconded the motion. AYES: Blackman, Gray, Holden, Kredell, Laszlo I NOES: None Motion carried ITEM "I" - AGREEMENT - COUNTY OF ORANGE - SOIL TESTS At the request of Mr. Covington, 4557 Candleberry Avenue, the City Manager explained what the agreement entailed as to soil 6-28-7.6 t~ - ... investigations. Laszlo moved, second by Holden, to approve the agreement between the City of Seal'Beach and the'County of Orange for Ii1a.terials control tests and preliminary soils investigations and authorize the Mayor to execute the agreement on behalf of the I City. AYES: Blackman, Gray, 'Holden, Kredell, Laszlo NOES: None ' ' Motion carried ITEM "L" - AGREEMENT - COUNTY OF ORANGE - ANIMAL'SHELTER SERVICES Adah Winters, l5D7 Electric Avenue, 'requested taht impounded animals from Seal Beach not be used for medical research. The City Manager stated that he would communicate with the County as to the procedures to exempt Seal Beach'animals from medical research. Holden moved, second by Gray, to approve the agreement between the Ci ty of Seal Beach and the County of Orange for animal shel ter services at the Orange County Animal Shelter and authorize the Mayor to execute the agreement on behalf of the City. I AYES: Blackman, Gray, Holden, Kredell, Laszlo NOES: None Motion carried REPORT - BIDS - CONSTRUCTION OF POLICE FACILITY and CORPORATION YARD The City Manager stated that it had been our legal counsel's advice that the Council take similar action as the Redevelopment Agency regarding the bids received for the Police Facility and the City's Corporation Yard, as the property belonged to the City. Holden moved, second by Gray, to reject all bids received for the construction of the Police Facility and the City Corporation Yard. AYES: Blackman, Gray, Holden, Kredell, Laszlo NOES: None Motion carried AMERICAN SAVINGS AND LOAN ASSOCIATION APPEAL I Mr. Neprud, Planning Director, presented the staff report and Planning Commission recommendations regarding signing for American Savings and Loan Association building to be built at the northwest corner of Pacific Coast Highway and Bolsa Avenue. Discussion followed by members of the Council. Councilman Holden moved to , 6-28-76 -!" :..' allow the three fascia signs and eliminate the monument sign. Mr. Catapano, 9465 Wilshire Blvd., Beverly Hills, representing American Savings and Loan Association, addressed the Council regarding the proposed signing for' the building. Discussion followed. Councilman Gray seconded the motion. I AYES: Blackman, Gray, HOlden, Laszlo NOES: Kredell Motion carried REQUEST - WEST ORANGE COUNTY HOT LINE Mildred Jones, 12100'Montecit6 Road, Rossmoor, and Executive Director of the West Orange County Hot Line, addressed the Council and urged financial, suppor,t for the Hot' Line. Discussion followed. Councilman Laszlo moved ,to ,contribute $50 ,per month to the West Orange County Hot Line. There was no second to the motion. The Council thanked Ms. Jones for attending and stated that no action would be taken on this matter' at this time. COUNCIL REPORTS and REQUESTS There were no Council Reports and Requests. ORAL COMMUNICATIONS I' Mayor Blackman declared oral communications open from the audience. Joan Endres, 829 Ocean Avenue, spoke in support of the West Orange County Hot Line. There were no other oral communications; Mayor Blackman declared oral communications closed.
