HomeMy WebLinkAboutCC AG PKT 2002-12-09 #T f f 1 M E M O R A N D U M 4 � �� ' O December 9, 2002 i / O ` b TO: Honorable Mayor and City Council FROM: City Clerk RE: Conflict of Interest Code Biennial Review As required by the Political Reform Act of 1974, the City of Seal Beach adopted its Conflict of Interest Code for the various City departments /designated employees by Resolution Number 3008 in September, 1980 pursuant to California Government Code Sections 87300 through 87313. A designated employee is an officer, employee, member or consultant of an agency whose position is designated because the position entails the making or participation in the making of governmental decisions which may foreseeably have a material effect on any financial interest. Participating in the making of a decision means the person negotiates, without significant substantive review, with a governmental entity or private person(s) regarding the decision, or, advises or makes recommendations to the decision maker(s) by conducting research or an investigation, preparing or presenting a report, analysis or opinion which requires the exercise of judgment on the part of the employee and the employee is attempting to influence the decision. State law also requires the local agency to review its Conflict of Interest Code in each even numbered year and if necessary make amendments thereto should there be additional designated positions, renaming or deletion of previously designated positions, changes to disclosure categories, etc. The last amendment of the City's Conflict of Interest Code was in November, 1996 making minor changes by Resolution Number 4511, and in 1998 and 2000 it was determined that no changes were necessary at those times. AGENDA ITEM T 6 The proposed amendments to the Conflict of Interest Code are basically minor in nature, there are some language changes/ clarifications, a couple of positions have been moved into the correct department as they currently exist, certain job titles corrected to reflect the current titles, deputy or assistant positions added where felt appropriate, deletion of Form 700 specific Schedule(s) identification numbers or letters as they change frequently, and adoption of the most recent Standard Conflict of Interest Code prepared by the Fair Political Practices Commission. Recommended Action: Adopt the proposed Resolution amending the City's Conflict of Interest Code, as required by State law, which incorporates by reference the most recent Standard Conflict of Interest Code a op ed by the FPPC.
