Bahorski, City Manager • FROM: Doug Dancs, P.E., Director, Department of Public Works SUBJECT: MAIN STREET ENCROACHMENT PERMIT POLICY SUMMARY OF REQUEST: The proposed City Council action will adopt a Council Policy regarding issuance of encroachment permits in the Main Street Specific Plan area. BACKGROUND: Seal Beach sidewalks within the Main Street Specific Plan Area are a desirable place to walk, stroll, and enjoy the downtown area. Pedestrian related concerns are a priority in the creation of a successful downtown. Tourism, events, and daily business all create pedestrian traffic. Public sidewalks are to provide safe unobstructed passage whenever possible but also allow streetscape amenities that enliven and support the public domain. There are numerous encroachments within the sidewalk area that have never been officially permitted. Some of these encroachments pose potential liability while others enhance the experience of pedestrians and visitors to the downtown area. This policy is a natural progression for regulating all the encroachments within a heavily traveled pedestrian area. The following is a timeline of events regarding this issue. Agenda Item x Y: \DPW 042 Council Reports and Rezo\2002 -12 -09 Council Meeting \DD CM 12.09.02 Main Street Encroachment Policy doc \LW\07 -18 -02 City Council Staff Report December 9, 2002 Council Policy Issues Temporary Signs: Separate from the encroachment policy, at the November 2002 public meeting, many attendees strongly voiced their dissatisfaction with direction received from Council to enforce the current regulations of the sign code. Article 18, Section 28 -1801, (f) prohibits portable signs (i.e. sandwich board type signs) within the City both on private and public property. Many of these signs are within the public right of way and in conflict with the location standards that are set forth in the proposed policy. This issue is separate from the policy. As it now stands, the City Engineer cannot legally issue permits for temporary signs within the right of way since this would be in violation of the sign ordinance. If Council desires that business owners be allowed to place signs either on public, private, or both, the current ordinance must be changed. It is recommended after public input on this item that Council either assert their intent that Staff enforce the existing ordinance or alternatively direct Staff to change the existing sign ordinance. If allowed by ordinance on public property, these signs would need to be placed in accordance with the location standards promulgated by this policy. The encroachment policy would be changed at the time of adoption of a revised sign ordinance. Main Street Encroachment Policy Staff received significant public comment regarding encroachments on Main Street. The following changes are recommended by staff to the draft policy: 1. Do not charge an annual rental charge but adopt an application and inspection fee. 2. Do not standardize encroachments aesthetics. 3. Allow temporary encroachments (excluding signs) under a special activity permit not to exceed more than six times per any given calendar year. 4. Once a City Council Ordinance has been established, only allow outdoor dining after a public hearing. 5. Only allow encroachments that are in conformance with location standards. 1. Do not charge an annual rental charge but adopt application and inspection fee. Originally, Staff's intention for the rental charge was not to collect additional revenue but rather let the rental charge act as a self - enforcing mechanism to allow for only those encroachments that business owners strongly believed would be beneficial. Additionally, the City Engineer issues Temporary Street Obstruction Permits, "Dumpster Permits," for use of the public right of way for up to 45 days. The fees for this permit amount to about a $1 per day of use and many cities charge on a square foot basis for use of the street. DD CM 12.09.02 Main Street Encroachment Policy 2 City Council Staff Report December 9, 2002 Additionally, by not charging a rental charge, the City is allowing public space to be used for private gain such as when outdoor dining is allowed. The public strongly voiced their opposition regarding this issue. After re- evaluation, it is recommended that a rental charge only be instituted if outdoor dining is allowed as an allowable encroachment. There will need to be a one -time application deposit to cover the cost of evaluating the type of encroachment, whether its location is in conformance with the standards, and processing the application. Once the policy is adopted, a fee will be brought before Council for approval in January 2003. 2. Do not standardize encroachments aesthetics. From various public input received, there is no clear consensus from the public regarding standardization of street furniture. Many people voiced their opinions that standards create the "Disneyland" approach and would ruin the small town atmosphere of the town by reducing creativity. Questions were raised would there be standards for every type of encroachment such as planters, bike racks, and benches. Aesthetic standards work when there is a clear vision for an area. Since this is not the case, it is recommended that the various types of encroachments be allowed as long as they can be placed within the location standards set forth by the City Engineer. This will prevent Staff from becoming a de -facto "design review board." 3. Allow temporary encroachments (excluding signs) under a special activity permit not to exceed more than six times per any given calendar year. Since it would be difficult and costly to enforce any type of regular temporary encroachment policy, encroachments that are of a temporary nature such as moveable furniture, merchandise, tables, chairs, displays are proposed not to be allowed within the public right of way unless otherwise allowed by ordinance or special event permit subject to the location standards. This allows business owners to still hold sidewalk sales and event sales but leaves the sidewalk less cluttered. Results from the questionnaire were strongly in favor of allowing sidewalk sales under this type of regulation. The questionnaire revealed that people have differing ideas about how many times these events should occur. Fourteen out of the eighteen respondents or 78% would not like to see sidewalk sales held more than quarterly. Attendees at the public meeting voiced their opposition to this matter and that the current practice of daily merchandise should be • maintained. • The current special activity permit policy allows for up to six events per any given calendar year. Since there is no consensus, it is recommended that this policy stay in place for this type of event. DD CM 12.09.02 Main Street Encroachment Policy 3 City Council Staff Report December 9, 2002 4. Once a City Council Ordinance has been established, only allow outdoor dining after a public hearing is held. From the questionnaire and public input there was no clear consensus on whether to allow outdoor dining within the public right of way. Since this use would most likely require a separate ordinance and be approved after a public hearing, it should not be allowed until such time directed by Council and would not be allowed under this policy. S. Only allow encroachments that are in conformance with location standards. Since the sidewalk is only 12 feet wide and includes various existing fixtures such as trees, light poles, bus stops, hydrants, and newspaper racks the Engineering Division has developed location standards to ensure that proper clearances are met for pedestrian travel, conformance with American Disability Act requirements, and reduction of liability. These are identified in the attached Standard SB -140 -1 SIDEWALK ENCROACHMENTS IN MAIN STREET SPECIFIC PLAN AREA. These include access aisle ways so people, including those in wheelchairs, can move along the sidewalk freely, clearances so cars cannot hit or overtop encroachments, people can access the sidewalk without walking in back of other cars, access for fire hydrants and other public works improvements. Aerial encroachments, except for signs, that cantilever over the public right of way such as flags are allowed under this policy as long as there is an 8 -foot clearance for pedestrians. Next Steps: If Council is interested in pursuing this issue further, the following schedule is proposed: Adopt Policy and Implement Enforcement in Phases Adopt Application and Inspection Fee January 2003 Main Street: Pacific Coast Highway to 1 month Electric Avenue Main Street: Electric Ave to Central Ave 1 month Main Street: Central Ave to Ocean Ave 1 month FISCAL IMPACT: Proceeding with this policy and conducting an enforcement action regarding the existing encroachments will result in allocation of staff and City Attorney resources not currently allocated for these work tasks. It is unknown at this time as to the amount of staff resources that may be required to respond to the direction of the City Council. DD CM 12.09.02 Main Street Encroachment Policy 4 City Council Staff Report December 9, 2002 Upon direction being given by the City Council, staff will provide an estimate of the staff allocations necessary to complete the desired action of the City Council. ROLL CALL Present: Mayor Larson Councilmembers Antos, Campbell, Doane, Yost Absent: None Also present: Mr. Bahorski, City Manager Mr. Barrow, City Attorney Mr. Whittenberg, Director of Development Services Mr. Dancs, Director of Public Works /City Engineer Ms. Yeo, City Clerk COUNCIL STUDY SESSION The Director of Public Works explained that what is being presented is a proposed policy for Main Street encroachments, the Engineering Division is currently not issuing permits for encroachments into the public right -of- way but there may have been permits in past years on a non - regular basis, the intent is to create an area where there can be encroachments yet allow for safe access for pedestrians. He noted that staff is looking at about eight different issues, such as, where wil the encroachments be allowed, what type of encroachments will be allowed, how much will be charged for the application, will the City charge an appropriate rental fee for use of the public right -of -way by the business, will temporary encroachments be allowed, will the City use proactive Code enforcement on encroachments such as temporary signs that are currently in the right -of -way under existing City Code, outdoor dining, and catilever projections over the public right -of -way. The Director mentioned that this process started with creating a location standard as a result of going through the ADA access guidelines, talking with the building official as to ingress and egress to buildings, staff looked at everything possible that could be a liability, that in order to create a safe travel walkway for pedestrians, an ADA walk zone is mentioned in the standard which is about five feet wide, that is what ADA calls for in order for two wheelchairs to pass each other, there is a twelve foot wide sidewalk therefore that leaves approximately seven feet for encroachments on either side, a three foot area remains open around a light pole, fire hydrant, any type of public works structure, that is for the purpose of maintenance, etc., a one and a half foot area is proposed for the frontage of cars as there are no bumper stops and it is important that the overhang of cars not encroach over the curb area where it could possibly knock over a bench or other structure, it is also desired that pedestrians have the ability to exit their car in a two foot area where the parking spaces intersect, this Page Two - City Council Minutes - August 12, 2002 allows car passengers to leave the vehicle without walking around the rear of the car. He pointed out the ten foot zone on each side of a crosswalk, the reason for that is that an 8.43 percent minimum slope is needed and minimum 2 percent crossfall yet still maintain the five foot pedestrian isleway and landing area, with that information in mind, it is felt that most of the Main Street encroachments could be accommodated yet they would be spread out more. The Public Works Director mentioned that staff was sent to Main Street to identify where the encroachments exist, of which they took photographs, examples were a bench not affixed to the public right -of- way and in an area where a car could tip the bench over, benches need to be secured and an inability for a car to tap any encroachment, there were free - standing tables and signs, there are encroachments in and out of the five foot walkway area, that is what needs to be regulated, there are benches facing each other in the same area, that could be resolved with some minimum relocation to keep the walkway area open, this could accommodate the number of benches yet comply with the encroachment standards, there should be a three foot clear area around the trash receptacles also for maintenance purposes. With regard to temporary encroachments, this has drawn a great deal of consideration as to how they could be allowed, especially through the Public Works Department, these would be things that would not normally be allowed unless it is through an ordinance or special event permit, a sidewalk sale would be an example, otherwise it is difficult to enforce what is and is not in the travel isleway, temporary chairs and tables another example, another issue is use of the public right - of -way for marketing purposes by the fronting business. A photo was shown of a small fence with flowers on the street side fronting a business, up to that point is public right - of -way, again there is the issue of ingress and egress standards for ADA purposes for getting in and out of a building, bike racks could be relocated somewhat to center a parking space to allow the travel walkway for pedestrians going in and out of their car also the five foot walkway, bike racks chained to trees or too close to trees are not wanted, they need to be appropriately placed in the right - of -way. Another photo depicted newsracks, sandwich board signs, a display of products all in one area, under current Code sandwich board signs are not allowed however are enforced on a reactive basis, business products would not be allowed to be displayed in the right -of -way without a special event or activity permit, the newsracks will be addressed in a separate ordinance, with regard to signs in the right -of -way the question is whether the Council wants staff to enforce the Code proactively. Again with regard to crosswalks, benches that crowd that passageway, a wheelchair pedestrian needs to have a clear landing area, benches could be moved somewhat to allow that, much of this could be accommodated if the location standards are followed so that a safe travel walkway can be provided yet still allow some of the streetscape improvements to remain, in the instance of a bench being chained to a light pole staff would suggest that the bench merely be relocated somewhat and affixed to the sidewalk, in some instances things can be resolved by merely informing the property owner of the standards. With regard to outdoor dining, a Page Three - City Council Minutes - August 12, 2002 photo was shown of a small encroachment into the right -of- way, to this a direction from Council is sought if they want to allow outdoor dining, if so staff would need to investigate that further for a policy. With regard to the types of encroachments, staff is asking Council, within the policy, for discretion to approve benches, bike racks, kiosks, tables, cans, yet for anything else staff would want to bring it back to Council for review prior to approval. As to an application cost, that would cover application review to make certain the request meets the standards, staff also requests donsideration of establishing a rental license for use of the public right - of -way, the range of costs in other cities have been found to be between $1 and $3 per square foot for outdoor dining, public meetings could be held with the business owners to seek their input. With regard to temporary encroachments, staff is proposing to not allow those unless allowed by a special sidewalk permit. Proactive Code enforcement would include the existing sandwich board signs, question is should a code enforcement officer be directed to clear those signs from the public right -of -way. With regard to outdoor dining, in the event a business were to come to the City under the scenario that there is a twelve foot sidewalk and they request to encroach by seven feet, leaving a five foot area for pedestrian traffic, would that use be allowed, as to cantilever projections and overhangs, staff is recommending that anything that currently exists be grandfathered and any new requests would only be required to pay the application fee but not the rental charges associated with the use of walkable pedestrian space. Staff has also received requests to investigate permitting encroachments in this area. Councilman Antos stated that the Main Street Specific Plan calls for standardization of street furniture, upon looking at the photos shown one can see there is a variety of types of bike racks, a variety of benches, including concrete ones, it would seem that since the Main Street Specific Plan has already been looked at in terms of newsracks, then there should be an attempt to establish a standard for benches, bicycle racks, etc. as well. In regards to newsracks it has already been pointed out that there are places where they can and can not be located, the City will likely be purchasing them, that needs to be taken into consideration before an application is made for a bench in a specific location that may be in conflict. As to the temporary displays, tables, chairs, signs, Councilman Antos stated he is not in favor of them, it is known that there are periodic sidewalk sales throughout the year and tied to other activities that the City is involved in sponsoring, businesses do put out displays in those instances for a day or two then removed, he would not like to see temporary, permanent displays. A suggestion was made to him also that in other cities that have trees on a main street such as Seal Beach they have installed semi - circular benches around the trees, that would seem to be something that could preclude the need for benches on either side of the sidewalk walkway area. Page Four - City Council Minutes - August 12, 2002 Councilman Larson inquired as to direction, will the staff be meeting with business people, will there be an ordinance change or whatever. The Public Works Director stated staff would like to do a public outreach with the businesses, meet and discuss their concerns, bring back a policy with any Council suggestions, then formally adopt a policy, it would include where allowed, type allowed, charges, feeling on outdoor dining, cantilever projections, also at this time staff would request direction as to proactive Code enforcement of the sandwich board signs now rather than on a reactive basis. To that there was an indicated preference for proactive Code enforcement at this time by Concilmembers Doane, Antos, and Yost. Councilman Yost offered that he has received comments from residents who are not necessarily pleased with the temporary permanent displays taking place on the sidewalks, that involves the usage of the public right -of -way to expand the square footage of a business, there is also the permanent occupancy of the public space issue, an example are the eves on the Watson building that extend into the public right -of -way, using public real estate permanently, or the case of the railing that is on public property as well, a use of taxpayers space for which they should be reimbursed permanently, they are two different issues, he would not want to do damage to any business yet there should be a uniform environment with the same rules for everyone. Councilman Doane spoke in support of the idea of circular benches, possibly staff could be directed to look into the cost of that, to that caution was raised as to the birds that frequent the trees over which such benches would be placed. With regard to some standardization of benches, the Director stated that if that is a direction of Council he would bring back further information, and seek input from the public and businesses during the public outreach meetings in that there are a number of benches that presently exist. Councilman Yost made reference to certain existing benches that are nice and charming, yet not everyone could afford that type, possibly there could be a minimum standard, not necessarily a cookie cutter design up and down the street. CLOSED SESSION The City Attorney announced that pursuant to Government Code Section 54956.9(b) and 54956.8, the Council would meet in Closed Session to discuss one case anticipated litigation, and to confer with the City's real property negotiator relating to the one hundred acre deed restricted Hellman Ranch Wetlands parcel. The Council adjourned to Closed Session at 6:50 p.m. and reconvened at 7:16 p.m. The City Attorney reported the Council discussed the real property issues pursuant to Government Code Section 54956.8 and that no reportable action was taken. Encroachment permit applications shall be submitted to the City Engineer and shall consist of 5.2.1 A City - provided application form. 5.2.2 A City - provided indemnification agreement. The agreement shall require the applicant to indemnify, defend (with counsel acceptable to City) and hold harmless the City, its officers, employees and agents against any and all claims, demands, losses, costs, expenses, obligations, liabilities, damages, recoveries and deficiencies that the City shall incur or suffer as a result of the applicant's encroachment. Such obligation shall include payment of interest, penalties and attorneys' fees. 5.2.3 Written proof of liability insurance. The insurance shall: (i) be issued by an insurer with a current A.M. Best's rating of A:VII or better; (ii) name the City and its officers, employees and agents as additional insureds; (iii) be primary and provide that any insurance maintained by the City shall be excess insurance; (iv) indemnify for all liability for personal and bodily injury, death and damage to property arising from the applicant's encroachment; and (v) provide a combined single limit liability insurance of at least one million dollars per occurrence. 5.2.4 A non - refundable application fee in an amount set by City Council resolution. 5.3 Field Inspection. Each encroachment permit applicant shall participate in a field inspection with the City Engineer. The applicant shall mark, in chalk or an equivalent method satisfactory to the City Engineer, the precise location proposed for the encroachment. The applicant shall remove the marking at the completion of the field inspection. 5.4 Public Notice. The City Engineer shall send written notice of an encroachment permit application to property owners and tenants having a legal interest in property located within a 100 feet radius of the location proposed for the encroachment. The notice shall indicate that written comments in support or protest of the application may be filed with the City Engineer within 7 days of the date of the notice for consideration by the City Engineer. 5.5 Approval or Denial By City Engineer. If there are no grounds for denial, the City Engineer may approve an encroachment permit application for the following types of permanent encroachments: benches, bike racks, kiosks, tables, banners, decorative refuse receptacles. The City Council may approve encroachment permit applications for other types of encroachments if there are no grounds for denial. The following constitute grounds for denial of an encroachment permit: 702520.2 5.9 Grandfather Rights. Existing awning or marquee or overhang structure encroachments shall be deemed to have received an encroachment permit as long 702520.2 City Council Policy Statement as said encroachment is in conformance with the location standards set forth in SB -140 -1 Sidewalk Encroachments In Main Street Specific Plan Area. 6. ENCROACHMENT LICENSE 6.1 Requirement. An encroachment license shall be obtained concurrently with an encroachment permit for each encroachment other than awnings. 6.2 Term. Each encroachment license shall expire concurrently with the encroachment permit with which it is associated. 7. Yes, there is a business sign on the side of the building but there is no way without individual display signs to let the passersby know of our special promotional events or fitness packages.
