Director of Public Works /City Engineer SUBJECT: COUNCIL POLICY: REQUESTS FOR WORK DURING PUBLIC WORKS CONSTRUCTION PROJECTS SUMMARY OF REQUEST: The proposed City Council action will adopt a Council Policy regarding the request for additional work paid by property owners during City construction projects. BACKGROUND: During the course of City public works construction projects, residents often request to pay for additional work to be performed. Requests in the past have ranged from new driveway approaches and sidewalk to future water service connections. In many instances, this can be both a benefit to the City and the resident if done properly. In other instances, it is not feasible due to location, type of work, or scheduling. This policy will provide a mechanism and procedure to allow such requests when appropriate. In order to grant a request, the proposed work must already have a unit price within the existing approved contract, not increase the potential for construction claims by the contractor, not delay the work in progress and be located within the public right of way and in the geographic scope of the project. Work on private property would not be allowed except in unique circumstances due to the nature of the project. FISCAL IMPACT: None. Property owner would pay all costs associated with this policy. RECOMMENDATION: Upon motion of the consent calendar, it is recommended that the City Council approve the Requests for Work During Public Works Construction Projects Policy. PURPOSE AND INTENT It is the intent of this policy to clarify procedures when residents request to pay for additional work for mutual benefit not covered within the original scope of the project. Its purpose is to ensure that the City is reimbursed for all costs associated with the additional work, protected against possible construction claims and the work is performed to the standards of the Public Works Department. 3. POLICY: During the course of City public works construction projects, residents often request that additional work be performed. Requests in the past have ranged from new driveway approaches and sidewalk to future water service connections. In many instances, this can be both a benefit to the City and the resident if done properly. In other instances, it is not feasible due to location, type of work, or scheduling. 3.1 Requests. Any property owner who wants to pay for additional work must make a written request to the Director of Public Works /City Engineer describing in detail the proposed location and extent of work. The Director of Public Works /City Engineer may grant a request if the proposed work has a unit price in the contract, will not have the potential for increasing construction claims, and will not delay the work in progress, and is located solely within the public right of way and within the geographic scope of the project. Work on private property during a public works contract will not be allowed unless it is integral or required by the characteristics of the project. 3.2 Costs: The property owner shall execute an agreement with the City regarding the work to be performed and the amount to be paid on a form prescribed by the Director of Public Works /City Engineer. \\Datafile\PWD Common\DPW 042 Policies \Construction for Public Works Projects\POLICY DPW Public Works Construction Changes.doc City Council Policy Statement All costs, including application, installation, and inspection, shall be borne by the property owner. The Director of Public Works /City Engineer shall determine the overall costs for the work. Construction costs will be determined by the awarded contract unit prices. Inspection and administration will be actual cost incurred by the City. No direct payment or agreement will be allowed between the private property owner and the City's contractor. All payments shall be made to the City at least 10 days in advance of the work. Funds shall be deposited in the project fund to cover all costs. 5. ISSUANCE Approved by City Council 2
