SUBJECT: COUNCIL POLICY: PERMIT REQUESTS FOR WORK
IN GUM GROVE PARK
SUMMARY OF REQUEST:

The proposed City Council action will adopt a Council Policy regarding the request for
work by property owners in Gum Grove Park.
BACKGROUND:
At the October 28, 2002 City Council meeting, Council directed staff to require any
issues involving Gum Grove Park be directed to the Parks and Recreation Commission
and Environmental Quality Control Board (EQCB). The purpose of this motion was to
prevent any damage or misuse to the Park in future cases.
This policy will provide a mechanism and procedure for all inquiries in Gum Grove Park
use. The policy defines that any resident or contractor requesting the use of the park is
required to submit a formal application to the City Engineer. The submittal should
include a plot plan, project description and a cash deposit per the approved fee resolution.
The City Engineer shall have the right to deny the permit or refer it to the Parks and
Recreation Commission and the EQCB for recommendations. The final permit would
then go to City Council for final approval.
In addition, staff has implemented changes to the building permit form which notifies the
permit holder that any work in the public right of way (such as adjacent parks, curbs,
streets, trash dumpsters) requires a permit from the Public Works Department. For
further park protection, all locks at all park entrances have been changed.
• FISCAL IMPACT:
None. Property owner would pay all costs associated with this policy.

RECOMMENDATION:
Upon motion of the consent calendar, it is recommended that the City Council adopt a
Council Policy regarding the request for work by property owners in Gum Grove Park.

1. SCOPE

2. PURPOSE AND INTENT
It is the intent of this policy to clarify procedures when residents or contractors
request to work in Gum Grove Park. Its purpose is to ensure that no damage
occurs in the park, cultural resources are protected, and that the City is reimbursed
for all costs associated for the requested work.
3. POLICY:
During the course of residential building projects, residents may request the use of
a public facility to construct their improvement. Residents are required to make a
formal application to the City for such use.
3.1 Requests.
Any property owner who requires, requests or uses Gum Grove Park as a
construction access or improvement is required to submit a formal Public Works
Permit Application to the City Engineer. Such application shall include a plot
plan, description of work and a cash deposit per the approved Fee Resolution.
The City Engineer shall have the right to deny the permit or refer it to the Parks
and Recreation Commission and the EQCB for recommendations. The final
permit would then go to City Council for final approval.
3.2 Costs:
The property owner shall complete a Public Works Application Permit and if
permitted, shall execute an agreement with the 'City regarding the work to be
performed and the amount to be paid on a form prescribed by the Director of
Public Works /City Engineer.
All costs, including application, installation, and inspection, shall be borne by the
property owner.

City Council Policy Statement
The Director of Public Works /City Engineer shall determine the overall costs for
the work. Inspection and administration will be actual cost incurred by the City.
