Subject: FOLLOW -UP FROM DECEMBER 1, 2010 PLANNING COMMISSION
HEARING ON CONDITIONAL USE PERMIT 08 -12 FOR 901 -1101
PACIFIC COAST HIGHWAY (SEAL BEACH REGENCY CENTER) —
OUTSTANDING ISSUES.
BACKGROUND:
Since the original approval of the CUP for a reduction in parking requirements in
January 2009, staff has regularly monitored the parking situation within the center and
has approved new businesses to locate within the center, as well as seen other
businesses leave the center for various reasons. During this time, staff has not become
aware of any problems or adverse impacts resulting from a lack of available parking
within the center, nor does staff anticipate this to change significantly in the near future.
Staff will continue to monitor the parking situation within the center and report back to
the Planning Commission on an as- needed basis.
In response to some of the previous parking issues occurring with the area near the
Laundromat, Regency Centers has installed four (4) reserved parking stalls for the
exclusive use by Laundromat patrons. This has helped alleviate some of the issues
with people not having to walk far distances when carrying large, bulky laundry baskets.
Staff is having an ongoing dialogue with CVS management and Regency Center
management regarding the CVS loading dock being used for storage /staging. Part of
the problem seems to lie with CVS's corporate offices, and Staff will continue to work
with CVS and Regency Centers to find a resolution to this issue that is amenable to
everyone and will help alleviate conflicts between vehicles parking in the lot and large
delivery trucks that use the rear lot drive aisle as a loading /unloading area. Staff has
looked at possibility of providing an additional, smaller loading zone for trucks in a
different area of the rear parking lot, but there does not appear to be adequate space
available to create such a loading zone without removing additional parking.

Staff is also continuing to work with Regency Centers regarding the issue with sign
lighting and light spillover along the Bolsa Avenue elevation and is confident that the
matter can be resolved in the very near future.

6 Mr. Olivera delivered the Staff Report noting that the approval of Conditional Use Permit
7 (CUP) 08 -12 required that Staff monitor parking within the center and return this matter
8 to the Planning Commission (PC) when all of the tenant spaces had been leased, or at
9 the end of 18 months. He indicated that vacant spaces remain, but it has been more
10 than 18 months since the original approval. He indicated that after presenting the item
11 for review in August 2009, the PC requested that the discussion be postponed until
12 representatives of Regency Centers could be present. Mr. Olivera then reported that
13 after monitoring the Seal Beach Center Staff has observed no problems with parking.

15 Kimberly Masayko of Regency Centers stated that they have experienced no issues
16 with parking within the center, although they currently have 7 vacancies. The leasing
17 agent, Aaron Keswick, stated that he has had no complaints about parking from existing
18 tenants. Chairperson Deaton inquired about parking in the rear lot area for CVS and
19 the Laundromat, citing the issue of delivery trucks impeding the area when making
20 deliveries via the CVS loading dock. Ms. Masayko stated that they will be in touch with
21 CVS corporate to attempt to resolve the situation and Regency has established
22 designated parking spaces for the Laundromat.

Commissioner Cummings inquired about turning off the lights in the rear parking lot at a
LJ specific time each night to prevent disturbing neighboring residents. Ms. Masayko
26 stated that she would look into this.

28 Commissioner Massa -Lavitt emphasized that it is important to resolve the problems
29 created by delivery trucks accessing the CVS loading dock.

31 MOTION by Massa - Lavitt; SECOND by Cummings to direct Staff to return in 90 days
32 with an update on the Seal Beach Regency Center.
