RELATING TO WHEELED DEVICES ON PUBLIC
AND PRIVATE PROPERTY
SUMMARY OF REQUEST:

Re- introduce first reading of Ordinance No. 1608 amending Municipal Code
Section 8.05.040 Wheeled Devices on Sidewalks.
BACKGROUND AND ANALYSIS:
At the April 11th meeting, the City Council continued this matter and asked staff
to consider the safety issues in some areas in College Park East and to study the
possibility of allowing motorized four wheeled carts (Golf Carts or Low Speed
Vehicles) outside of Leisure World to go to the beach.
Low Speed Vehicles (Gem Cars) per California Vehicle Code section 21260 are
prohibited from driving on road ways with a speed limit in excess of 35 MPH. Golf
Carts per California Vehicle Code section 21716 shall not operate on a highway
except in a speed zone of 25 miles per hour or less. California Vehicle Code
section 21209 prohibits motor vehicles, which include low speed vehicles and
golf carts from driving in a bicycle lane. Accessing the beach from Leisure World
requires traversing Seal Beach Blvd., which has a posted speed of 50 miles per
hour. Due to posted speed limits, it is illegal for low speed vehicles and golf carts
to drive on Seal Beach Blvd.
The current provisions of the Municipal Code concerning "wheeled devices"
required clarification. The proposed amendment will clarify that the riding or
operating wheeled devices are prohibited in the following locations: City
sidewalks; Public property other than sidewalks where signs prohibiting such
activity are posted; and Pedestrian walkways in privately owned shopping
centers where signs prohibiting such activity are posted.

The Code defines a "wheeled device" to include bicycles, roller skates, scooters,
segways, and skateboards. It specifically excludes baby strollers; shopping
carts, wheelchairs; and motorized cycles utilized by disabled persons. No
changes are proposed to this definition.
The issue raised concerning bicycle riding on certain sidewalks is already
addressed in the municipal code and the City traffic engineer will determine
where signs will be posted.
§ 8.10.040 Bicycle Riding on Sidewalk.
The traffic engineer may post signs permitting bicycle riding on
sidewalks at locations where riding in the street would be hazardous.
Any person may ride a bicycle on a sidewalk where such a sign has
been posted.
FISCAL IMPACT:
The potential negative or positive fiscal impacts of the proposed Municipal Code
amendment, if any, would be minor.
RECOMMENDATION:
Re- introduce first reading of Ordinance No. 1608, An Ordinance of the City of
Seal Beach Amending Section 8.05.040 of the Seal Beach Municipal Code
Relating to Wheeled Devices on Public and Private Property.

AN ORDINANCE OF THE CITY OF SEAL BEACH AMENDING
SECTION 8.05.040 OF THE SEAL BEACH MUNICIPAL CODE
RELATING TO WHEELED DEVICES ON PUBLIC AND PRIVATE
PROPERTY
THE SEAL BEACH CITY COUNCIL DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Section 8.05.040 of the Seal Beach Municipal Code is
amended to read as follows:
§ 8.05.040 Wheeled Devices Prohibition
A. Wheeled Device: For the purpose of this section, a "wheeled
device is any wheeled device propelled by human or mechanical
power. "Wheeled device" includes without limitation: bicycles, roller
skates, scooters, segways, and skateboards. "Wheeled devices"
does not include: cars, trucks and equivalent vehicles; baby
strollers; shopping carts utilized for transportation of goods;
wheelchairs; and motorized tricycles and motorized quadricycles
utilized by persons otherwise unable to move about as pedestrians
by reason of physical disability.
B. Prohibition: No person shall ride or operate a wheeled
device in any of the following locations:
1. City sidewalks
2. Public property other than sidewalks where signs
prohibiting such activity are conspicuously posted.
3. Privately owned sidewalks used for pedestrian traffic
where signs prohibiting such activity are conspicuously posted.
C. Infraction: Any person who rides or operates a wheeled
device in violation of this section shall be guilty of an infraction.
PASSED, APPROVED AND ADOPTED by the City Council of the City of Seal
Beach at a regular meeting held on the day of , 2011.
