FOR SANITARY SEWER PIPELINE DESIGN PROJECT NUMBER SS0901 AND WITH AKM CONSULTING ENGINEERS FOR SANITARY SEWER PUMP STATION IMPROVEMENTS PROJECT NUMBER SS0901 SUMMARY OF REQUEST: The City Council is asked to: • Adopt Resolution No. 6135 approving a professional services agreement with Civiltec Engineering Inc. for $186,986 to prepare design of Sanitary Sewer Pipelines, Project No. SS0901. • Adopt Resolution No. 6136 approving a professional services agreement with AKM Consulting Engineers for $489,506 to prepare the plans, specifications, and cost estimates for the Sanitary Sewer Pump Station Improvements, Project No. SS0901. BACKGROUND AND ANALYSIS: On August 08, 2005 The City Council adopted the Sewer System Master Plan Update. This document identified approximately $14.9 million in needed capital improvements to the City's Sanitary Sewer System. The Sewer Capital Improvement Program includes; the upsizing of pipes to increase the capacity, replacement of cracked deteriorated pipes, installation of an internal liner for pipe rehabilitation, and reconstruction of pump stations. The City adjusted sewer rates and progressed on an annual basis to rehabilitate these deficiencies on the highest priority basis. At the July 14, 2008 City Council Meeting, Council authorized staff to pursue the State Revolving Fund (SRF) Loan administered through the State Water Agenda Item K Page 2 Resource Control Board for the Sewer Capital Improvement Program. This loan is administered at a low interest rate (typically 1 -2.5 %) and will allow the City to expedite the remainder of the projects identified within the Sewer System Master Plan Update (2005). The loan is now approved. Two projects are near ready and will begin shortly. Those two projects are the Ocean Avenue Alley Sewer Rehabilitation and the College Park East Sewer Rehabilitation. On November 8, 2010 the City Council approved a Request for Proposals and authorized solicitation for proposals to prepare construction documents for the remaining Capital Improvements identified within the Sewer System Master Plan adopted in 2005. On December 23, 2010 staff received five (5) proposals from AKM Engineers, Civiltec Engineering Inc, Harris and Associates, Wildan Engineering and Tetratech. The scope of work includes preparing plans and specifications to fully reconstruct the Pier Sewer Pump Station, 8 Street Sewer Pump Station and rehabilitate various sewer pipes in Old Town, Bridgeport, Hill, Marina and the Cove. A panel reviewed the proposals and decided that the most efficient and effective way to design this project, for the best price, is to select one consultant to design the pump stations and one consultant to design the pipeline work. After careful consideration of the proposals, staff selected Civiltec Engineering Inc. as the most qualified firm with the best understanding to design the Sanitary Sewer Pipeline Designs, and AKM Consulting Engineers to design the Sanitary Sewer Pump Station Improvements Project Number SS0901. Both have completed numerous sewer design projects for both the City of Seal Beach and other jurisdictions with great success. They have proven track records of professional work and over the years have provided quality work. The fee from Civiltec Engineering Inc. to perform design services to prepare plans and specifications for the Sanitary Sewer Pipelines is $186,986. The fee from AKM Consulting Engineers to perform design services to prepare plans and specifications for the Sanitary Sewer Pump Station Improvements is $489,506. Both of these fee proposals are appropriate for the services rendered. ENVIRONMENTAL IMPACT: The Sanitary Sewer Pipeline Project No. SS0901 and the Sanitary Sewer Pump Station Improvements Project No. SS0901 will comply with the California Environmental Quality Act (CEQA). Page 3 FINANCIAL IMPACT: Funds have been approved in the 2010 -2011 Fiscal Year Budget in the amount of $2,262,900 for Sewer System Improvements Identified in the 2005 Sewer Master Plan Update. RECOMMENDATION: It is recommended that City Council: • Adopt Resolution No. 6135 approving a professional services agreement with Civiltec Engineering Inc. for $186,986 to prepare design of Sanitary Sewer Pipeline Designs, Project No. SS0901. • Adopt Resolution No. 6136 approving a professional services agreement with AKM Consulting Engineers for $489,506 to prepare the plans, specifications, and cost estimates for the Sanitary Sewer Pump Station Improvements, Project No. SS0901. ( "Consultant "), a Corporation, and the City of Seal Beach ( "City "), a California charter city, (collectively, "the Parties "). 1 of 11 RECITALS A. City desires certain professional services. B. Pursuant to the authority provided by its City Charter and Government Code § 37103, if applicable, City desires to engage Consultant to provide sewer design services in the manner set forth herein and more fully described in Section 1. C. Consultant represents that the principal members of its firm are qualified professional engineers and are fully qualified to perform the services contemplated by this Agreement in a good and professional manner; and it desires to perform such services as provided herein. NOW THEREFORE, in consideration of the Parties' performance of the promises, covenants, and conditions stated herein, the Parties hereto agree as follows. AGREEMENT 1.0 Scope of Services 1.1. Consultant shall provide those services ( "Services ") set forth in the attached Exhibit A. To the extent that there is any conflict between Exhibit A and this Agreement, this Agreement shall control. 1.2. Consultant shall perform all services under this Agreement on a timely, regular basis and in a manner reasonably satisfactory to the City. 1.3. In performing this Agreement, Consultant shall comply with all applicable provisions of federal, State, and local law. 1.4. As a material inducement to City to enter into this Agreement, Consultant hereby represents that it has the experience necessary to undertake the services to be provided. In light of such status and experience, Consultant hereby covenants that it shall follow the customary professional standards in performing all services. 1.5. By executing this Agreement, Consultant represents that, to the extent required by the standard of practice, Consultant (a) has investigated and considered the scope of services to be performed, (b) has carefully considered how the services should be performed, and (c) understands the facilities, difficulties and restrictions attending performance of the services under this Agreement. 2.0 Term The term of this Agreement shall commence as of the Effective Date and shall continue for 60 days unless previously terminated as provided by this Agreement. 2 of 11 3.0 Consultant's Compensation City will pay Consultant in accordance with the fee schedule set forth in Exhibit B for Services but in no event will the City pay more than $186,986. Consultant will not be compensated for any work performed not specified in the Scope of Services unless the City authorizes such work in advance and in writing. The City Manager may authorize payment for such work up to a cumulative maximum of $10,000. Payment for additional work in excess of $10,000 requires prior City Council authorization. Any additional work authorized by the City pursuant to this Section will be compensated in accordance with the schedule set forth in Exhibit C. 4.0 Method of Payment 4.1. Consultant shall submit to City monthly invoices for all services rendered pursuant to this Agreement. Such invoices shall be submitted within 15 days of the end of the month during which the services were rendered and shall describe in detail the services rendered during the period, the days worked, number of hours worked, the hourly rates charged, and the services performed for each day in the period. City will pay Consultant within 30 days of receiving Consultant's invoice. City will not withhold any applicable federal or state payroll and other required taxes, or other authorized deductions from payments made to Consultant. 4.2. Upon receipt of 24 hours' notice from City, Consultant shall allow City or City's agents or representatives to inspect at Consultant's offices during reasonable business hours all records, invoices, time cards, cost control sheets and other records maintained by Consultant in connection with this Agreement. City's rights under this Section 4.2 shall survive for two years following the termination of this Agreement. 5.0 Termination 5.1. This Agreement may be terminated by City, without cause, or by Consultant based on reasonable cause, upon giving the other party written notice thereof not less than thirty 30 days prior to the date of termination. 5.2. This Agreement may be terminated by City upon 10 days' notice to Consultant if Consultant fails to provide satisfactory evidence of renewal or replacement of comprehensive general liability insurance as required by this Agreement at least 20 days before the expiration date of the previous policy. 6.0 Party Representatives 6.1. The City Manager is the City's representative for purposes of this Agreement. 6.2. C. Shem Hawes, P.E. is the Consultant's representative for purposes of this Agreement. It is expressly understood that the experience, knowledge, capability, and reputation of C. Shem Hawes, P.E. were a substantial inducement for City to enter into this Agreement. Therefore, C. Shem Hawes, P.E. shall be responsible during the 3 of 11 term of this Agreement for directing all activities of Consultant and devoting sufficient time to personally supervise the services hereunder. Consultant may not change its representative without the prior written approval of City, which approval shall not be unreasonably withheld. 7.0 Notices 7.1. All notices permitted or required under this Agreement shall be deemed made when personally delivered or when mailed 48 hours after deposit in the United States Mail, first class postage prepaid and addressed to the party at the following addresses: To City: City of Seal Beach 211 - 8th Street Seal Beach, California 90740 Attn: City Manager To Consultant: Civiltec Engineering, Inc. 118 West Lime Avenue Monrovia, CA 91016 Attn: C. Shem Hawes, P.E. 7.2. Actual notice shall be deemed adequate notice on the date actual notice occurred, regardless of the method of service. 8.0 Independent Contractor 8.1. Consultant is an independent contractor and not an employee of the City. All services provided pursuant to this Agreement shall be performed by Consultant or under its supervision, and all personnel shall possess the qualifications, permits, and licenses required by State and local law to perform such Services, including, without limitation, a City of Seal Beach business license as required by the Seal Beach Municipal Code. Consultant will determine the means, methods, and details of performing the services. Consultant shall be solely responsible for the satisfactory work performance of all personnel engaged in performing the services and compliance with the customary professional standards. 8.2. Any additional personnel performing services under this Agreement on behalf of Consultant shall also not be employees of City and shall at all times be under Consultant's exclusive direction and control. Consultant shall pay all wages, salaries, and other amounts due such personnel in connection with their performance of services under this Agreement and as required by law. Consultant shall be responsible for all reports and obligations respecting such additional personnel, including, but not limited to: Social Security taxes, income tax withholding, unemployment insurance, disability insurance, and workers' compensation insurance. 8.3. Consultant shall indemnify and hold harmless City and its elected officials, officers and employees, servants, designated volunteers, and agents serving as 4 of 11 independent contractors in the role of City officials, from any and all liability, damages, claims, costs and expenses of any nature to the extent arising from Consultant's personnel practices. City shall have the right to offset against the amount of any fees due to Consultant under this Agreement any amount due to City from Consultant as a result of Consultant's failure to promptly pay to City any reimbursement or indemnification arising under this Section 8. 9.0 Confidentiality Consultant covenants that all data, documents, discussion, or other information developed or received by Consultant or provided for performance of this Agreement are deemed confidential and shall not be disclosed by Consultant without prior written authorization by City. City shall grant such authorization if applicable law requires disclosure. All City data shall be returned to City upon the termination of this Agreement. Consultant's covenant under this Section shall survive the termination of this Agreement. 10.0 Subcontractors No portion of this Agreement shall be subcontracted without the prior written approval of City. Consultant is fully responsible to City for the performance of any and all subcontractors. 11.0 Assignment Consultant shall not assign or transfer any interest in this Agreement whether by assignment or novation, without the prior written consent of City. Any purported assignment without such consent shall be void and without effect. 12.0 Insurance 12.1. Liability Insurance. Consultant shall procure and maintain in full force and effect for the duration of this Agreement insurance against claims for injuries to persons or damages to property and professional negligence which may arise from or in connection with the performance of the services hereunder by Consultant, and its agents, representatives, employees and subcontractors. 12.2. Minimum Scope of Insurance. Unless otherwise approved by City, coverage shall be at least as broad as: Insurance Services Office Commercial General Liability coverage (occurrence form CG 0001). Insurance Services Office form number CA 0001 (Ed. 1/87) covering Automobile Liability, code 1 (any auto). Workers' Compensation insurance as required by the State of California and Employer's Liability Insurance. 5 of 11 Professional Liability insurance. Consultant shall provide to City the standard form issued by the carrier. 12.3. Minimum Limits of Insurance. Consultant shall maintain limits no less than: General Liability: $2,000,000 per occurrence and in the aggregate for bodily injury, personal injury and property damage. Commercial General Liability Insurance or other form with a general aggregate limit shall apply separately to this Agreement or the general limit shall be twice the required occurrence limit. Automobile Liability: $1,000,000 per accident for bodily injury and property damage. Employer's Liability: $1,000,000 per accident and in the aggregate for bodily injury or disease and Workers' Compensation Insurance in the amount required by law. Professional Liability: $1,000,000 per claim /aggregate. 12.4. Deductibles and Self- Insured Retentions. Consultant shall inform City of any deductibles or self- insured retentions except with respect to professional liability insurance. 12.5. Other Insurance Provisions. The general liability and automobile liability policies are to contain, or be endorsed to contain, the following provisions: 12.5.1. City, its officers, officials, employees, designated volunteers and agents serving as independent contractors in the role of City officials, are to be covered as additional insureds as respects: liability arising out of activities performed by or on behalf of Consultant; products and completed operations of Consultant; premises owned, occupied or used by Consultant; or automobiles owned, leased, hired or borrowed by Consultant. The coverage shall contain no limitations on the scope of protection afforded to City, its officers, officials, employees, designated volunteers or agents serving as independent contractors in the role of City officials which are not also limitations applicable to the named insured. 12.5.2. For any claims related to this Agreement, Consultant's insurance coverage shall be primary insurance as respects City, its officers, officials, employees, designated volunteers and agents serving as independent contractors in the role of City officials. Any insurance or self- insurance maintained by City, its officers, officials, employees, designated volunteers or agents serving as independent contractors in the role of City officials shall be excess of Consultant's insurance and shall not contribute with it. 6 of 11 12.5.3. Consultant's insurance shall apply separately to each insured against whom claim is made or suit is brought, except with respect to the limits of the insurer's liability. 12.5.4. Each insurance policy required by this clause shall be endorsed to state that coverage shall not be canceled or materially modified except after 30 days' prior written notice by first class mail has been given to City, or 10 days' prior written notice by express overnight mail if cancellation is due to nonpayment of premiums. 12.5.5 Each insurance policy, except for the professional liability policy, required by this clause shall expressly waive the insurer's right of subrogation against City and its elected officials, officers, employees, servants, attorneys, designated volunteers, and agents serving as independent contractors in the role of City officials. 12.6. Acceptability of Insurers. Insurance is to be placed with insurers with a current A.M. Best's rating of no less than A:VIII unless waived in writing by City's Risk Manager. 12.7. Verification of Coverage. All insurance coverages shall be confirmed by execution of endorsements on forms approved by City. The endorsements are to be signed by a person authorized by that insurer to bind coverage on its behalf. All endorsements are to be received and approved by City before services commence. As an alternative to City forms, Consultant's insurer may provide complete, certified copies of all required insurance policies, including endorsements effecting the coverage required by these specifications. 13.0 Indemnification, Hold Harmless, and Duty to Defend 13.1 Indemnity for Design Professional Services. In connection with its design professional services, Consultant shall hold harmless and indemnify City, and its elected officials, officers, employees, servants, designated volunteers, and those City agents serving as independent contractors in the role of City officials (collectively, "Indemnitees "), with respect to any and all claims, demands, damages, liabilities, losses, costs or expenses, including reimbursement of attorneys' fees and costs of defense (collectively, "Claims" hereinafter), including but not limited to Claims relating to death or injury to any person and injury to any property, which arise out of, pertain to, or relate to in whole or in part to the negligence, recklessness, or willful misconduct of Consultant or any of its officers, employees, subcontractors, or agents in the performance of its design professional services under this Agreement. 13.2 Other Indemnities. In connection with any and all claims, demands, damages, liabilities, losses, costs or expenses, including attorneys' fees and costs of defense (collectively, "Damages" hereinafter) not covered by Subsection 13.1, Consultant shall defend, hold harmless and indemnify the Indemnitees with respect to any and all Damages, including but not limited to, Damages relating to death or injury to any person and injury to any property, which arise out of, pertain to, or relate to the acts or omissions of Consultant or any of its officers, employees, subcontractors, or agents 7 of 11 in the performance of this Agreement, except for such Toss or damage arising from the sole negligence or willful misconduct of the City, as determined by final arbitration or court decision or by the agreement of the parties. Consultant shall defend Indemnitees in any action or actions filed in connection with any such Damages with counsel of City's choice, and shall pay all costs and expenses, including all attorneys' fees and experts' costs actually incurred in connection with such defense. Consultant's duty to defend pursuant to this Subsection 13.2 shall apply independent of any prior, concurrent or subsequent misconduct, negligent acts, errors or omissions of Indemnitees. 14.0 Conflict of Interest 14.1. Consultant covenants that it presently has no interest and shall not acquire any interest, direct or indirect, which may be affected by the Services, or which would conflict in any manner with the performance of the Services. Consultant further covenants that, in performance of this Agreement, no person having any such interest shall be employed by it. Furthermore, Consultant shall avoid the appearance of having any interest, which would conflict in any manner with the performance of the Services. Consultant shall not accept any employment or representation during the term of this Agreement which is or may likely make Consultant "financially interested" (as provided in California Government Code §§ 1090 and 87100) in any decision made by City on any matter in connection with which Consultant has been retained. 14.2. Consultant further warrants and maintains that it has not employed or retained any person or entity, other than a bona fide employee working exclusively for Consultant, to solicit or obtain this Agreement. Nor has Consultant paid or agreed to pay any person or entity, other than a bona fide employee working exclusively for Consultant, any fee, commission, gift, percentage, or any other consideration contingent upon the execution of this Agreement. Upon any breach or violation of this warranty, City shall have the right, at its sole and absolute discretion, to terminate this Agreement without further liability, or to deduct from any sums payable to Consultant hereunder the full amount or value of any such fee, commission, percentage or gift. 14.3. Consultant warrants and maintains that it has no knowledge that any officer or employee of City has any interest, whether contractual, noncontractual, financial, proprietary, or otherwise, in this transaction or in the business of Consultant, and that if any such interest comes to the knowledge of Consultant at any time during the term of this Agreement, Consultant shall immediately make a complete, written disclosure of such interest to City, even if such interest would not be deemed a prohibited "conflict of interest" under applicable laws as described in this Subsection. 15.0 Equal Opportunity Consultant affirmatively represents that it is an equal opportunity employer. Consultant shall not discriminate against any subcontractor, employee, or applicant for employment because of race, religion, color, national origin, handicap, ancestry, sex, sexual orientation, or age. Such non - discrimination includes, but is not limited to, all 8 of 11 activities related to initial employment, upgrading, demotion, transfer, recruitment or recruitment advertising, layoff, or termination. 16.0 Labor Certification By its signature hereunder, Consultant certifies that it is aware of the provisions of Section 3700 of the California Labor Code that require every employer to be insured against liability for Workers' Compensation or to undertake self - insurance in accordance with the provisions of that Code, and agrees to comply with such provisions before commencing the performance of the Services. 17.0 Entire Agreement This Agreement contains the entire Agreement of the Parties with respect to the subject matter hereof, and supersedes all prior negotiations, understandings, or agreements. This Agreement may only be modified by a writing signed by both Parties. 18.0 Severability The invalidity in whole or in part of any provisions of this Agreement shall not void or affect the validity of the other provisions of this Agreement. 19.0 Governing Law This Agreement shall be governed by and construed in accordance with the laws of the State of California. 20.0 No Third Party Rights No third party shall be deemed to have any rights hereunder against either Party as a result of this Agreement. 21.0 Waiver No waiver of any default shall constitute a waiver of any other default or breach, whether of the same or other covenant or condition. In no event shall the making by City of any payment to Consultant constitute or be construed as a waiver by City of any breach of covenant, or any default which may then exist on the part of Consultant, and the making of any such payment by City shall in no way impair or prejudice any right or remedy available to City with regard to such breach or default. No waiver, benefit, privilege, or service voluntarily given or performed by a Party shall give the other Party any contractual rights by custom, estoppel, or otherwise. 22.0 Prohibited Interests Consultant maintains and warrants that it has not employed nor retained any company or person, other than a bona fide employee working solely for Consultant, to solicit or secure this Agreement. Further, Consultant warrants that it has not paid nor 9 of 11 has it agreed to pay any company or person, other than a bona fide employee working solely for Consultant, any fee, commission, percentage, brokerage fee, gift or other consideration contingent upon or resulting from the award or making of this Agreement. For breach or violation of this warranty, City has the right to rescind this Agreement without liability. For the term of this Agreement, no member, officer or employee of City, during the term of his or her service with City, shall have any direct interest in this Agreement, or obtain any present or anticipated material benefit arising therefrom. 23.0 Attorneys' Fees If a Party commences any legal, administrative or other action against the other Party arising out of or in connection with this Agreement, the prevailing Party in such action shall be entitled to have and recover from the losing Party all of its attorneys' fees and other costs incurred in connection therewith. 24.0 Exhibits All exhibits referenced in this Agreement are hereby incorporated into the Agreement as if set forth in full herein. In the event of any material discrepancy between the terms of any exhibit so incorporated and the terms of this Agreement, the terms of this Agreement shall control. 25.0 Corporate Authority The persons executing this Agreement on behalf of the Parties warrant that they are duly authorized to execute this Agreement on behalf of said Parties and that by their execution, the Parties are formally bound to the provision of this Agreement. 10 of 11 IN WITNESS WHEREOF, the Parties hereto, through their respective authorized representatives have executed this Agreement as of the date and year first above written. Civiltec has no potential conflicts of interest in performing these services for the City of Seal Beach and appreciate the opportunity to present our qualifications to the City. The City is proposing to construct a new s 8 Street pump station that will replace the existing wet/well dry well pump station currently located in the beach parking lot at the end of 8 street. The 8 street pump station will be configured with a wet well and dry well with dry -pit submersible pumps within the drywell. The pump station collects gravity flow from a strip of residential homes south of Ocean Avenue and forcemain flow from the 1 Street and Pier pump stations. Consideration of these flows along with the capacity of the 1 and Pier pump stations will be considered in the final sizing of the 8 Street pump station. Wet well size will be optimized to anticipate and to a certain extent equalize flow from the gravity and pressure systems to ensure appropriate cycling of pumps and to limit the detention time within the wet well thus mitigating against odor generation. The station should be configured so that mixing of the wet well will be promoted through a cascading effect from the influent pipelines into the wet well, if this cannot reasonably be achieved a mixer of adequate size and strength will be included • in the design to promote mixing. Page 2 will be located within close proximity to the pump station. A new forcemain will be design from the discharge of the new pump station to the intersection of 8th Street and Ocean Avenue. The Pier pump station is in a location that. is difficult to access and does not promote safe maintenance or operating conditions. The City desires to improve accessibility to the pumps which are currently hard flanged to the discharge head and provide a means for grease interception to limit impact from grease on the pump and forcemain operations. A new wet well and pumping system along with controls will be designed to replace the existing system. The Pier pump station is connected to the underside of the City Pier and services Ruby's restaurant. Perform design of lining and spot repair improvements for approximately 20,000 I.f, of sewer pipe. The majority of this design effort will include preparation of plans based on base maps developed from existing City ROW, GIS and or Model data. Base maps will ultimately be converted to a useful design platform or ACAD and this effort will only include develop of plan view plans. Due to the straightforward nature of these improvements Civiltec anticipates that spot repair and or relining design will be represented from this plan perspective. Necessary research of public information, review of existing CCTV and field investigation will be performed to quantify the desired work effort. Geotechnical or survey work will not be performed for these areas. (. Due to deterioration in the gravity mains it is anticipated that 5,000 I.f. of pipeline will need to be completely reconstructed. Due to the proximity of the improvements to the Ocean and the presence of high ground water, geotechnical investigation will be performed at 1,000 foot intervals to determine the quality of the existing subsurface materials and to provide any recommendations necessary for full reconstruction activities. Pipeline inverts and manhole rims will be surveyed along with relevant above grade features from curb face to curb face. Well Qualified To Perform Scope Civiltec engineering, inc. presents herewith our qualifications and proposal to provide professional engineering services for this important Project. We are well qualified to provide services for this type of project because of: Our Engineering Team's experience in design, cost estimating and construction management of wastewater facilities, piping improvements, pump station upgrades and electrical system improvements. Civiltec recently designed the wastewater flow equalization station for Pepperdine University in Malibu, CA. The station equalizes flow between two treatment facilities. One facility is served by gravity from the equalization station and the other is through a 5 mile forcemain. The station has a capacity of 0.5 MGD. Civiltec performed the construction management and inspection of all aspect of this project. (. Our Engineering Team's diverse knowledge of wastewater facility design, system reliability issues, facility maintenance, site development, grading plan design and wastewater facilities construction methods. Civiltec reviewed and provided design recommendations for 5 separate lift stations ranging in capacities from 1 to 2 MGD within the City of New Port Beach b Our Team's knowledge of wastewater engineering activities, wastewater system planning, capital improvement program development, wastewater system evaluations, budget analysis, and project scheduling performed for wastewater agencies. Civiltec designed and construction managed the improvements for adding the Pepperdine University 3.8 MGD open impoundment reservoirs and has recently designed the improvements to the City of LA DC Tillman equalization station, teaming with the Design -Build contractor to build the improvements. This storage reservoir is proposed to have a total capacity of 15.2 MG, included yard piping improvements with dual 48" diameter pipelines to fill the basin to full capacity within 3 hours. Civittec's hands on experience in working with contractors on a real time basis to complete and execute project objectives. In 2006 and 2007 Civiltec teamed with WA Rasic to design -build two forcemain projects of substantial size to meet the internal performance metrics of the Eastern Municipal Water District. The first of the two projects begin with design in April of 2006 and design completion in August of that same i, year for the Caswston Lift station. This pipeline consisted of preparation of plans for 9,700 1.f. of 12 -inch forcemain. The second project completed with WA Rasic included design of 7,700 1.f. of 24 -inch forcemain from the Diaz Lift Station to it Temecula Valley Regional WRF. ♦ Civiltec has been involved in many sewer repair and replacement projects in the recent past. The existing plant facilities consisted of head works screening, grit removal, primary clarification, a roughing tower, series trickling filters, secondary clarification, sand filtration, chlorine disinfection, primary pumping, various flow control structures, anaerobic digestion, waste gas facilities, solids conveyance pumping, belt press thickening, and solids composting. The two steel tanks were recently constructed in 2009. The total design and construction management assistance cost for the reservoirs was $170,000. We have also design several pipeline projects for the City. The new facilities were designed per City standards, were reviewed and approved by the City. The Greencroft pump station has been completed and is operation. The Hooks Canyon Reservoir project is complete and in service. Subconsultant Qualifications Civiltec proposes to utilize the services of the following subconsultants, to complete this project: The electrical engineering will be performed by Mullen and Associates, Inc. of Fullerton, California. Mullen is a specialized electrical engineering firm. The Project Manager for Mullen will be Larry D. Mullen, P.F., Principal and Owner. Mr. Mullen has worked with Civiltec since 2005 in design of power systems, lighting systems and telemetry systems for pump stations, reservoirs and well facilities. Mr. Mullen has over 30 years of extensive experience in design and construction management, electrical and telemetry systems, lift station facilities, ( booster pumping facilities and reservoirs. Mr. Mullen's expertise includes design of motor controls, telemetry, power service and telephone service coordination. We propose to assign Tom Benson, CEG, P.E., of Leighton Consulting of Rancho Cucamonga, California as the project manager for the geotechnical and geologic services for the Project. Mr. Benson will be responsible for engineering geology and geological research and investigations. Mr. Benson currently is responsible for management, technical supervision and performance of engineering geology, geotechnical, environmental impact, and environmental geology projects, and is a Professional Engineer and Certified Engineering Geologist in California. Mr. Benson has worked with Civiltec since 1995 on projects requiring geotechnical investigations most recently including the Pasadena Water and Power Devil's Gate Reservoir and the Hooks Canyon Reservoirs and Greencroft Pump Station for the City of Glendora. Surveying services will be provided by Western States Surveying, Inc. (WSS) of Monrovia, California, which is an affiliate company of Civiltec's. Eugene C. Duncan, L.S. and Jim Kevorkian, L.S., of WSS have worked with Civiltec since 1986 providing the survey services necessary for the planning and construction of projects. They have extensive experience in research, topographic surveys, boundary surveys, construction staking, easement calculations and land title matters; and have performed extensive survey work within southern California. WSS will be responsible for topo survey of the site to generate the base map. Page 12 Scope of Services and Approach The City is seeking a qualified design engineering firm to prepare design plans, drawings and specifications for construction of the proposed 8 Street and Pier Pump stations, repair and relining work of 20,000 I.f. of deficient sewer lines, replacement of a 6" forcemain, and full reconstruction of 5,000 of deficient sewer lines. Civiltec will prepare plans and specifications in complete detail to enumerate and identify the necessary construction effort associated with the improvements. Civiltec anticipates that each project will require the necessary structural, civil and electrical improvements and have identified a scope and team herewith with the specialized expertise in the various disciplines to support finalizing and bidding the project. Our scope of services does not include Construction Management or support during the implementation phase of the improvements. The City plans to line 20,000 1.f. of existing sewer lines that have been video taped and documented numerous areas that require spot repairs by complete lining of pipe from manhole to manhole. Design efforts for preparation of the design for these improvements include the following: Preparation of basemaps detailing the Street right of way and any necessary or conflicting • utilities. Civiltec currently has the majority of these basemaps prepared in the College Park East Area. 6 Identify the limits of the lining and spot repair improvements from manhole to manhole and any lining improvements necessary to manholes. b Field visits to verify location and extent of improvements as necessary to complete the design. The City plans to fully reconstruct 5,000 1.f. of existing sewer lines that cannot successfully be relined. Design efforts for preparation of the design for these improvements include the following: Preparation of basemaps detailing all topographic features between curb face to curb face. 6 Survey of all topographic features along these alignments including dipping all sewer manholes to verify invert elevations of sewer lines. ♦ Preparation of a geotechnical report which will outline trench, backfrlI, shoring and excavation requirements for the proposed improvements. si Design of a fully reconstructed pipe of the same size as existing. The City plans to construct an upgrade to the Pier Puinp Station to provide for easy access and maintenance. Access to the pump station is the primary concern. There is limited access to the pumps and valves connected to the force main. Page 13 0 Demolish the existing pump station and associated electrical switch gear and controls. 6 Install a double hatch door though the top of the pier deck directly over the fiberglass tank to allow for access over the fiberglass holding tank, pumps and valves. 6 Provide a new fiberglass wet well of sufficient size to promote appropriate pump cycling and limit detention time to reasonable levels. b Design of a two (2) submersible or dry pit - submersible pumping system meeting the following conditions: o Two max day wet weather (AMWWF) pump appropriately sized at approximately 2.5 HP and provide soft start. This pump will be configured as a lead lag system and will alternate operation to equalize wear among the pumps. o Accessibility through hatches will be provided. 4 Provide a grease trap in series with and prior to the pump station to allow for easy access by City personnel and to limit interference with restaurant operations. b Flow metering will be included in the design. ♦ Controls design and installation will be performed by the Mullen and Associates. Civiltec will provide the instrumentation input and output signals for control of the pump station in our design. Pump control will utilize an ultrasonic transmitter to monitor level and turn on and off lead and lag pumps and will also be provided with back up float i' switches to alarm City staff and to turn on and off pumps if the ultrasonic transmitter were to fail. 6 Design supports wet well and pumps to connect to Pier structural members and suspend from the underside of the Pier. ♦ Design a roof structure to enclose the existing transformer, new switch gear and control panel. The City plans to construct a new 8 Street Pump station with a firm capacity of 290 gpm and a new forcemain approximately 400 I.f in length. Plans shall be prepared in a manner that will provide a fully functional pump station. Civiltec will prepare plans and specifications for replacement of the existing 8 Street wastewater pumping station. The existing system has a firm capacity of 530 gpm when one of the 10 horsepower pumps is operational. The existing pump station is equipped with one (1) additional 10 horsepower pumps that serves as a backup to wet weather flow loading. The design plans, drawings and specifications will be prepared to identify the following: 6 Demolition of the existing lift station, electrical and mechanical equipment. 6 Perform geotechnical investigative services. Groundwater is anticipated to be in close proximity to ground surface. Design of a new wastewater pump station consisting of a wet well and dry well . 6 Design of a new building to house the electrical and emergency generator equipment. The new building will be designed to be in close proximity to the new pump station within the beach parking lot. Phase I Preliminary Design A. Arrange and conduct a workshop with the City and the Civiltec Project Team to formalize design criteria, discuss schedules and obtain any data, CAD files, plans or documents that the City may have in its possession relative to the Project. Provide meeting minutes and action items. B. Civiltec has and will thoroughly review the Sewer Master Plan including the video logs. We will research the locations of all existing utilities such as sewer, water, gas, storm drains, electric, telephone and cable. We will copy the City all utility company correspondence. We will ask that the City mark USA for the sewer alignments to assist with field identifying existing utilities. C. Civiltec will send survey crews into the field to gather data to supplement the City's existing aerial mapping. We will survey all existing planimetric data such as valves, utility boxes, power poles, utility markings, etc. along each sewer line alignment slated for full reconstruction and perform general survey at the 8th Street Pump station site. We will measure existing sewer manhole top and invert elevations (in and out) to confirm as -built characteristics of all manholes in the project alignments slated for full reconstruction. D. We will compile a project base map including all found utility data, right of way and easement information, existing lot line stub -outs, existing mapping, and supplemental field survey data. E. We will review the proposed improvements in relation to the project base map to determine to best alternatives for the sewer line repairs or upgrades. Methods may include cured in place pipe (CIPP) relining, pipe bursting, bypass lines, repair couplings, or complete replacement of sections of pipe. We will verify all required utility clearances for pipe upgrades and determine if utility relocations or sewer main line alignment changes are needed. We will take into consideration locations and characteristics of existing service connections, and the impact of each alternative on the respective property owner. F. Proposed Geoteclnical Scope Of Work Subsurface exploration will be focused on the proposed 8 street pump station area and at �. every 1,000 foot interval along the 5,000 foot length of full sewer Iine reconstruction work activities. We propose to perform borings specific to each site, geotechnical laboratory testing, geotechnical engineering analyses and report preparation, as described in the following subsections: Background Data We will collect and review available geotechnical reports, maps, plans, aerial photographs and other pertinent data for this project, from the City and/or other readily available sources. We will also interact with Civiltec to understand proposed structural loads, allowable differential settlements and other soil/structure interaction criteria. Field Exploration Before we begin fieldwork, we will mark our proposed exploration locations and notify the Agency and Underground Service Alert (USA), so that known underground utilities can be identified. However, it is unlikely that USA will be helpful within this secure plant. Therefore, we will rely on as -built utility plans provided by the City, to avoid existing piping, other buried conduits and structures. We are not responsible for damage to unidentified utilities. We assume permits will not be required while drilling. For the purposes of this proposal, we assuune the site is accessible for a truck- mounted hollow - stem/rotary wash drill rig. Page 16 We will obtain relatively undisturbed driven ring -lines and /or Shelby Tube samples, Standard Penetration Tests (SPTs) and bulk soil samples from our borings for visual classification and geotechnical laboratory testing. Obtain an encroachment and monitoring permit from the City of Seal Beach and a well installation permit from the Orange County Health Agency (OCHA). Leighton will perform subsurface exploration consisting of the excavation and logging small- diameter borings. Three borings will be excavated to a depth of up to approximately 20 feet. Within the three deeper borings, a groundwater monitoring well will be installed at appropriate locations along the sewer line alignments. Standard well casing equipment for groundwater monitoring (2 -inch PVC pipe) will be used and a traffic rated well cover will be installed. The remaining borings will be drilled to a depth of approximately 5 feet. The purpose of these two borings will be to observe the pavement section, subsurface conditions and obtain bulk samples for laboratory testing. Identification, handling and treatment of hazardous materials are beyond the scope of our geotechnical engineering services. If such materials are encountered, we will notify the ( ; City immediately, and a proposal for handling of such materials will be submitted, if requested. Geotec /anical Laboratory Testing We will conduct geotechnical testing on the sampled earth materials, in our in -house laboratory, for soil classification and engineering properties. This testing will include 1) moisture contents and dry densities, 2) organic content (loss -on- ignition), 3) sieve and hydrometer analyses, 4) Atterberg Limits, 5) direct shear strength, 6) Expansion Index, 7) consolidation, and other tests as necessary for analysis of settlement, bearing capacity, and liquefaction potential. Atterberg Limits, sieve and hydrometer analyses are expected to be required to refine the liquefaction evaluation, to reduce the potential for obtaining erroneously conservative liquefaction predictions and settlement estimates. Office Studies We will review collected field and laboratory data and perform geotechnical- engineering analyses to develop geotechnical recommendations for the proposed pump station and replacement lift station discussed in the project description of this proposal. We will then prepare a report that includes results of our exploration and testing, and our conclusions and geotechnical recommendations for design of the proposed improvements. Page 17 will include an exploration location plan, geotechnical section, exploration logs, and laboratory test data in addition to the following: 6 Site Conditions: We will review and summarize surface, subsurface, groundwater conditions (past and present), and the engineering properties of the earth materials encountered during subsurface exploration. 6 Geologic Hazards: We will discuss potential site- specific geologic hazards at the basin and lift station sites, including liquefaction, lateral spreading, differential seismic compaction, fault rupture and ground shaking. Recommendations for soil liquefaction mitigation will be addressed. b Seismicity: We will provide a regional fault map showing the proximity of the site to major faults identified by the California Geological Survey within a 100 - kilometer radius of these treatment facilities. We will also provide site - specific seismic coefficients in accordance with ASCE 7 -05 and Chapter 16 of the 2006 International Building Code (IBC), adopted in the 2007 California Building Code (CBC), and in accordance with ACI and /or AWWA criteria. 6 Foundations: Utilizing the data collected during our investigation, we will recommend a suitable foundation type for the proposed improvements. We will also provide foundation design criteria including recommendations for minimum size, embedment depth, allowable vertical and lateral capacities, and expected total and differential settlements. Consideration will be given to "net" values, with and without hydrostatic pressures. 6 Vault/Well Subterranean Walls: We will present retaining wall design criteria, including recommended foundation type, lateral earth pressures, including seismic incremental loading, drainage and backfill recommendations,. 6 Bedding and Backfill: Leighton will present earthwork recommendations and guide specifications, including recommendations for pipe bedding, materials for backfill, and suitability of excavated materials for use as bedding and backfill. 6 Temporary Excavations: Utilizing data collected during our exploration, we will present temporary excavation guidelines (construction site safety is the responsibility of the contractor). 6 Uplift Resistance: In areas of shallow groundwater, Leighton will provide geotechnical recommendations for design of pipeline uplift resistance. b Lateral Earth Pressures: For design of manholes and thrust blocks, Leighton will provide recommended lateral earth pressures (passive "bearing ") and friction resistance (including soil angle of internal friction). • City of Seal Beach Mr. Michael Ho, City Engineer Proposal to Provide Professional Engineering Services 2010 Sewer CIP No. SS0901 g Otarrn December, 23 2010 v o� engineering I Page 18 6 Pavements: Leighton will provide pavement sections for pipe - trench pavement repairs. 6 Temporary Shoring: Leighton will present geotechnical parameters for design of temporary trench shoring, including lateral earth pressures. G. Work with the City to prepare a study of the system hydraulics at the Pier and 8th Street Pump Stations to determine the improvements necessary for the existing systems. We will size pumps and calculate the necessary horsepower and electrical requirement during this phase. The City has preliminarily indicated that the pumps will each have a 290 gpm capacity. H. Prepare a site study of the Pier and 8 Street Pump Station area including alternative layouts of the site /station based on input from the City supplied to determine the most efficient configuration and location of the pump station. The Study will include a discussion on site constraints and construction boundaries. The conceptual site plans will be prepared at a scale of 1 -inch = 10 feet, showing the location and layout of the site, including major appurtenances and site utilities. We will focus our study on the layout and feasibility of the pump station construction materials, configurations, and related r construction costs. I. Prepare preliminary designs, plans, specifications and layouts to include the following and update the preliminary construction cost estimate. 6 Site improvements. We will prepare preliminary design of the site improvements, paving, drainage, site utilities, etc for each site. We will implement the recommendations of the City and the City input on aesthetics. 6 Pipelines. We will prepare preliminary designs and plans drawings for the piping system improvements, including valving. Our plans will detail the discharge piping appurtenances to the required points of connection at both sites. b Electric Service. We will prepare preliminary designs and specifications for the new electrical service equipment at the Pier and 8 Street stations site. We will also design the new motor controls for the new pump Stations. 6 New Pump Station. We will prepare preliminary designs, details and specifications for the new 8 Street and Pier pump stations. 6 Cost Estimates. Prepare preliminary construction cost estimates based on the preliminary investigations and designs. J. Meet with the City and the City Staff and system operators to review the preliminary layouts prior to proceeding into Final Design. The drawings will be 100% AutoCAD for Windows and ink on 24" x 36" mylar for the final design only. The drawings will be complete, detailing but not limited to the following: 1 A title sheet with construction notes and site location and vicinity maps. 2 A site plan indicating the pump station location and site improvements, including plan views of the proposed construction, final grading and elevations. 3 Sewer line lining plans and details as necessary. 4 Sewer line full reconstruction and details as necessary (' 5 Pump details and sections. 6 On site Suction and Discharge piping with piping details and sections. 7 Miscellaneous details. 8 Electrical and telemetry provision plans including site plans, lighting plans, power distribution and outlet plans. Civiltec proposes to provide a number of submittals prior to final approval the drawings and specifications. The following list identifies key submittals, meetings and design information proposed for each submittal: 6 90% Design Review - Submit complete drawings, second draft of complete specifications document, updated construction cost estimate, a narrative of progress addressing outstanding issues and design completion schedule and 50% design review comments -- 3 sets. Meet to discuss approximately one week after submittal. Meeting minutes will be provided. 6 100% Design Review - Submit complete drawings and specification document reflecting 90% design review corrections for final approval from the the City — 3 sets. Design Schedule Civillec is available to begin work on this project immediately and assuming a notice to proceed in February 2011, will complete the scope of services in approximately 4 months. Critical path to the design effort is the ability to meet to review the plans at milestones with the City. Please see Appendix D for a project specific Work Flow Diagram tailored to this project. Pursuant to the authority provided by its City Charter and Government Code § 37103, if applicable, City desires to engage Consultant to provide Sanitary Sewer Design services in the manner set forth herein and more fully described in Section 1. C. Consultant represents that the principal members of its firm are qualified professional Engineers and are fully qualified to perform the services contemplated by this Agreement in a good and professional manner; and it desires to perform such services as provided herein. NOW THEREFORE, in consideration of the Parties' performance of the promises, covenants, and conditions stated herein, the Parties hereto agree as follows. AGREEMENT 1.0 Scope of Services 1.1. Consultant shall provide those services ( "Services ") set forth in the attached Exhibit A. To the extent that there is any conflict between Exhibit A and this Agreement, this Agreement shall control. 1.2. Consultant shall perform all services under this Agreement on a timely, regular basis and in a manner reasonably satisfactory to the City. 1.3. In performing this Agreement, Consultant shall comply with all applicable provisions of federal, State, and local law. 1.4. As a material inducement to City to enter into this Agreement, Consultant hereby represents that it has the experience necessary to undertake the services to be provided. In light of such status and experience, Consultant hereby covenants that it shall follow the customary professional standards in performing all services. 1.5. By executing this Agreement, Consultant represents that, to the extent required by the standard of practice, Consultant (a) has investigated and considered the scope of services to be performed, (b) has carefully considered how the services should be performed, and (c) understands the facilities, difficulties and restrictions attending performance of the services under this Agreement. 2.0 Term The term of this Agreement shall commence as of the Effective Date and shall continue for 60 days unless previously terminated as provided by this Agreement. 2 of 11 Error! Unknown document property name. • 3.0 Consultant's Compensation City will pay Consultant in accordance with the fee schedule set forth in Exhibit A for Services but in no event will the City pay more than $489,506. Consultant will not be compensated for any work performed not specified in the Scope of Services unless the City authorizes such work in advance and in writing. The City Manager may authorize payment for such work up to a cumulative maximum of $10,000. Payment for additional work in excess of $10,000 requires prior City Council authorization. Any additional work authorized by the City pursuant to this Section will be compensated in accordance with the schedule set forth in Exhibit A. 4.0 Method of Payment 4.1. Consultant shall submit to City monthly invoices for all services rendered pursuant to this Agreement. Such invoices shall be submitted within 15 days of the end of the month during which the services were rendered and shall describe in detail the services rendered during the period, the days worked, number of hours worked, the hourly rates charged, and the services performed for each day in the period. City will pay Consultant within 30 days of receiving Consultant's invoice. City will not withhold any applicable federal or state payroll and other required taxes, or other authorized deductions from payments made to Consultant. 4.2. Upon receipt of 24 hours' notice from City, Consultant shall allow City or City's agents or representatives to inspect at Consultant's offices during reasonable business hours all records, invoices, time cards, cost control sheets and other records maintained by Consultant in connection with this Agreement. City's rights under this Section 4.2 shall survive for two years following the termination of this Agreement. 5.0 Termination 5.1. This Agreement may be terminated by City, without cause, or by Consultant based on reasonable cause, upon giving the other party written notice thereof not less than thirty 30 days prior to the date of termination. 5.2. This Agreement may be terminated by City upon 10 days' notice to Consultant if Consultant fails to provide satisfactory evidence of renewal or replacement of comprehensive general liability insurance as required by this Agreement at least 20 days before the expiration date of the previous policy. 6.0 Party Representatives 6.1. The City Manager is the City's representative for purposes of this Agreement. 3 of 11 Error! Unknown document property name. 6.2. Zeki Kayiran is the Consultant's representative for purposes of this Agreement. It is expressly understood that the experience, knowledge, capability, and reputation of AKM Consulting Engineering were a substantial inducement for City to enter into this Agreement. Therefore, Zeki Kayiran shall be responsible during the term of this Agreement for directing all activities of Consultant and devoting sufficient time to personally supervise the services hereunder. Consultant may not change its representative without the prior written approval of City, which approval shall not be unreasonably withheld. 7.0 Notices 7.1. Actual notice shall be deemed adequate notice on the date actual notice occurred, regardless of the method of service. 8.0 Independent Contractor 8.1. Consultant is an independent contractor and not an employee of the City. All services provided pursuant to this Agreement shall be performed by Consultant or under its supervision, and all personnel shall possess the qualifications, permits, and licenses required by State and local law to perform such Services, including, without limitation, a City of Seal Beach business license as required by the Seal Beach Municipal Code. Consultant will determine the means, methods, and details of performing the services. Consultant shall be solely responsible for the satisfactory work performance of all personnel engaged in performing the services and compliance with the customary professional standards. 8.2. Any additional personnel performing services under this Agreement on behalf of Consultant shall also not be employees of City and shall at all times be under Consultant's exclusive direction and control. Consultant shall pay all wages, salaries, 4 of 11 Error! Unknown document property name. and other amounts due such personnel in connection with their performance of services under this Agreement and as required by law. Consultant shall be responsible for all reports and obligations respecting such additional personnel, including, but not limited to: Social Security taxes, income tax withholding, unemployment insurance, disability insurance, and workers' compensation insurance. 8.3. Consultant shall indemnify and hold harmless City and its elected officials, officers and employees, servants, designated volunteers, and agents serving as independent contractors in the role of City officials, from any and all liability, damages, claims, costs and expenses of any nature to the extent arising from Consultant's personnel practices. City shall have the right to offset against the amount of any fees due to Consultant under this Agreement any amount due to City from Consultant as a result of Consultant's failure to promptly pay to City any reimbursement or indemnification arising under this Section 8. 9.0 Confidentiality Consultant covenants that all data, documents, discussion, or other information developed or received by Consultant or provided for performance of this Agreement are deemed confidential and shall not be disclosed by Consultant without prior written authorization by City. City shall grant such authorization if applicable law requires disclosure. All City data shall be returned to City upon the termination of this Agreement. Consultant's covenant under this Section shall survive the termination of this Agreement. 10.0 Subcontractors No portion of this Agreement shall be subcontracted without the prior written approval of City. Consultant is fully responsible to City for the performance of any and all subcontractors. 11.0 Assignment Consultant shall not assign or transfer any interest in this Agreement whether by assignment or novation, without the prior written consent of City. Any purported assignment without such consent shall be void and without effect. 12.0 Insurance 12.1. Liability Insurance. Consultant shall procure and maintain in full force and effect for the duration of this Agreement insurance against claims for injuries to persons or damages to property and professional negligence which may arise from or in connection with the performance of the services hereunder by Consultant, and its agents, representatives, employees and subcontractors. 5 of 11 Error! Unknown document property name. 12.2. Minimum Scope of Insurance. Unless otherwise approved by City, coverage shall be at least as broad as: Insurance Services Office Commercial General Liability coverage (occurrence form CG 0001). Insurance Services Office form number CA 0001 (Ed. 1/87) covering Automobile Liability, code 1 (any auto). Workers' Compensation insurance as required by the State of California and Employer's Liability Insurance. Professional Liability insurance. Consultant shall provide to City the standard form issued by the carrier. 12.3. Minimum Limits of Insurance. Consultant shall maintain limits no less than: General Liability: $2,000,000 per occurrence and in the aggregate for bodily injury, personal injury and property damage. Commercial General Liability Insurance or other form with a general aggregate limit shall apply separately to this Agreement or the general limit shall be twice the required occurrence limit. Automobile Liability: $1,000,000 per accident for bodily injury and property damage. Employer's Liability: $1,000,000 per accident and in the aggregate for bodily injury or disease and Workers' Compensation Insurance in the amount required by law. Professional Liability: $1,000,000 per claim /aggregate. 12.4. Deductibles and Self- Insured Retentions. Consultant shall inform City of any deductibles or self- insured retentions except with respect to professional liability insurance. 12.5. Other Insurance Provisions. The general liability and automobile liability policies are to contain, or be endorsed to contain, the following provisions: 12.5.1. City, its officers, officials, employees, designated volunteers and agents serving as independent contractors in the role of City officials, are to be covered as additional insureds as respects: liability arising out of activities performed by or on behalf of Consultant; products and completed operations of Consultant; premises owned, occupied or used by Consultant; or automobiles owned, leased, hired or borrowed by Consultant. The coverage shall contain no limitations on the scope of protection afforded to City, its officers, officials, employees, designated volunteers or 6 of 11 Error! Unknown document property name. agents serving as independent contractors in the role of City officials which are not also limitations applicable to the named insured. 12.5.2. For any claims related to this Agreement, Consultant's insurance coverage shall be primary insurance as respects City, its officers, officials, employees, designated volunteers and agents serving as independent contractors in the role of City officials. Any insurance or self- insurance maintained by City, its officers, officials, employees, designated volunteers or agents serving as independent contractors in the role of City officials shall be excess of Consultant's insurance and shall not contribute with it. 12.5.3. Consultant's insurance shall apply separately to each insured against whom claim is made or suit is brought, except with respect to the limits of the insurer's liability. 12.5.4. Each insurance policy required by this clause shall be endorsed to state that coverage shall not be canceled or materially modified except after 30 days' prior written notice by first class mail has been given to City, or 10 days' prior written notice by express overnight mail if cancellation is due to nonpayment of premiums. 12.5.5 Each insurance policy, except for the professional liability policy, required by this clause shall expressly waive the insurer's right of subrogation against City and its elected officials, officers, employees, servants, attorneys, designated volunteers, and agents serving as independent contractors in the role of City officials. 12.6. Acceptability of Insurers. Insurance is to be placed with insurers with a current A.M. Best's rating of no less than A:VIII unless waived in writing by City's Risk Manager. 12.7. Verification of Coverage. All insurance coverages shall be confirmed by execution of endorsements on forms approved by City. The endorsements are to be signed by a person authorized by that insurer to bind coverage on its behalf. All endorsements are to be received and approved by City before services commence. As an alternative to City forms, Consultant's insurer may provide complete, certified copies of all required insurance policies, including endorsements affecting the coverage required by these specifications. 13.0 Indemnification, Hold Harmless, and Duty to Defend 13.1 Indemnity for Design Professional Services. In connection with its design professional services, Consultant shall hold harmless and indemnify City, and its elected officials, officers, employees, servants, designated volunteers, and those City agents serving as independent contractors in the role of City officials (collectively, "Indemnitees "), with respect to any and all claims, demands, damages, liabilities, losses, costs or expenses, including reimbursement of attorneys' fees and costs of 7 of 11 Error! Unknown document property name. defense (collectively, "Claims" hereinafter), including but not limited to Claims relating to death or injury to any person and injury to any property, which arise out of, pertain to, or relate to in whole or in part to the negligence, recklessness, or willful misconduct of Consultant or any of its officers, employees, subcontractors, or agents in the performance of its design professional services under this Agreement. 13.2 Other Indemnitees. In connection with any and all claims, demands, damages, liabilities, losses, costs or expenses, including attorneys' fees and costs of defense (collectively, "Damages" hereinafter) not covered by Subsection 13.1, Consultant shall defend, hold harmless and indemnify the Indemnitees with respect to any and all Damages, including but not limited to, Damages relating to death or injury to any person and injury to any property, which arise out of, pertain to, or relate to the acts or omissions of Consultant or any of its officers, employees, subcontractors, or agents in the performance of this Agreement, except for such loss or damage arising from the sole negligence or willful misconduct of the City, as determined by final arbitration or court decision or by the agreement of the parties. Consultant shall defend Indemnitees in any action or actions filed in connection with any such Damages with counsel of City's choice, and shall pay all costs and expenses, including all attorneys' fees and experts' costs actually incurred in connection with such defense. Consultant's duty to defend pursuant to this Subsection 13.2 shall apply independent of any prior, concurrent or subsequent misconduct, negligent acts, errors or omissions of Indemnitees. 14.0 Conflict of Interest 14.1. Consultant covenants that it presently has no interest and shall not acquire any interest, direct or indirect, which may be affected by the Services, or which would conflict in any manner with the performance of the Services. Consultant further covenants that, in performance of this Agreement, no person having any such interest shall be employed by it. Furthermore, Consultant shall avoid the appearance of having any interest, which would conflict in any manner with the performance of the Services. Consultant shall not accept any employment or representation during the term of this Agreement which is or may likely make Consultant "financially interested" (as provided in California Government Code §§ 1090 and 87100) in any decision made by City on any matter in connection with which Consultant has been retained. 14.2. Consultant further warrants and maintains that it has not employed or retained any person or entity, other than a bona fide employee working exclusively for Consultant, to solicit or obtain this Agreement. Nor has Consultant paid or agreed to pay any person or entity, other than a bona fide employee working exclusively for Consultant, any fee, commission, gift, percentage, or any other consideration contingent upon the execution of this Agreement. Upon any breach or violation of this warranty, City shall have the right, at its sole and absolute discretion, to terminate this Agreement without further liability, or to deduct from any sums payable to Consultant hereunder the full amount or value of any such fee, commission, percentage or gift. 8 of 11 Error! Consultant warrants and maintains that it has no knowledge that any officer or employee of City has any interest, whether contractual, noncontractual, financial, proprietary, or otherwise, in this transaction or in the business of Consultant, and that if any such interest comes to the knowledge of Consultant at any time during the term of this Agreement, Consultant shall immediately make a complete, written disclosure of such interest to City, even if such interest would not be deemed a prohibited "conflict of interest" under applicable laws as described in this Subsection. 15.0 Equal Opportunity Consultant affirmatively represents that it is an equal opportunity employer. Consultant shall not discriminate against any subcontractor, employee, or applicant for employment because of race, religion, color, national origin, handicap, ancestry, sex, sexual orientation, or age. Such non - discrimination includes, but is not limited to, all activities related to initial employment, upgrading, demotion, transfer, recruitment or recruitment advertising, layoff, or termination. 16.0 Labor Certification By its signature hereunder, Consultant certifies that it is aware of the provisions of Section 3700 of the California Labor Code that require every employer to be insured against liability for Workers' Compensation or to undertake self- insurance in accordance with the provisions of that Code, and agrees to comply with such provisions before commencing the performance of the Services. 17.0 Entire Agreement This Agreement contains the entire Agreement of the Parties with respect to the subject matter hereof, and supersedes all prior negotiations, understandings, or agreements. This Agreement may only be modified by a writing signed by both Parties. 18.0 Severability The invalidity in whole or in part of any provisions of this Agreement shall not void or affect the validity of the other provisions of this Agreement. 19.0 Governing Law This Agreement shall be governed by and construed in accordance with the laws of the State of California. 20.0 No Third Party Rights No third party shall be deemed to have any rights hereunder against either Party as a result of this Agreement. 9 of 11 Error! Unknown document property name. 21.0 Waiver No waiver of any default shall constitute a waiver of any other default or breach, whether of the same or other covenant or condition. In no event shall the making by City of any payment to Consultant constitute or be construed as a waiver by City of any breach of covenant, or any default which may then exist on the part of Consultant, and the making of any such payment by City shall in no way impair or prejudice any right or remedy available to City with regard to such breach or default. No waiver, benefit, privilege, or service voluntarily given or performed by a Party shall give the other Party any contractual rights by custom, estoppel, or otherwise. 22.0 Prohibited Interests Consultant maintains and warrants that it has not employed nor retained any company or person, other than a bona fide employee working solely for Consultant, to solicit or secure this Agreement. Further, Consultant warrants that it has not paid nor has it agreed to pay any company or person, other than a bona fide employee working solely for Consultant, any fee, commission, percentage, brokerage fee, gift or other consideration contingent upon or resulting from the award or making of this Agreement. For breach or violation of this warranty, City has the right to rescind this Agreement without liability. For the term of this Agreement, no member, officer or employee of City, during the term of his or her service with City, shall have any direct interest in this Agreement, or obtain any present or anticipated material benefit arising therefrom. 23.0 Attorneys' Fees If a Party commences any legal, administrative or other action against the other Party arising out of or in connection with this Agreement, the prevailing Party in such action shall be entitled to have and recover from the losing Party all of its attorneys' fees and other costs incurred in connection therewith. 24.0 Exhibits All exhibits referenced in this Agreement are hereby incorporated into the Agreement as if set forth in full herein. In the event of any material discrepancy between the terms of any exhibit so incorporated and the terms of this Agreement, the terms of this Agreement shall control. 25.0 Corporate Authority The persons executing this Agreement on behalf of the Parties warrant that they are duly authorized to execute this Agreement on behalf of said Parties and that by their execution, the Parties are formally bound to the provision of this Agreement. 10 of 11 Error! The scope of work included in this proposal is based upon our understanding of this information, discussions with the City of Seal Beach staff, and our experience with wastewater collection and pumping systems. • The proposed project team will be under the direction of Zeki Kayiran, P.E., a Principal with AKM, who has over 39 years of water and wastewater resources planning, design and construction experience. He serves as the District Engineer for the Garden Grove Sanitary District, and provides expert services to the City of Los Angeles Bureau of Sanitation in wastewater planning. Mr. John Loague, P.E., an AKM Principal with over 27 years of experience in the design and construction of wastewater collection, pumping and treatment facilities, will serve as the Sewer Pump Station Design Engineer. Mr. Morgan Ying, P.E., a Senior Associate with AKM with over 27 years of responsible experience in the planning, design and construction of major wastewater conveyance facilities, will act as Sewer Pipeline Rehabilitation Design Engineer. QA/QC will be provided by Mr. Glen Deiter. Mr. Defter has over 30 years of experience in various aspects of construction, construction management, project scheduling, estimating, cost control, change order preparation, contract negotiation and inspection services on { public projects. Most recently, AKM has completed similar assignments for the Cities of Palos Verdes Estates, Garden Grove and El Segundo. The City ultimately decided on a pump station with a large wet well to provide 11 hours of peak flow storage under emergency conditions. Siting of the facility was primarily dictated by the close proximity of existing homes and the potential for damage by the proposed construction. A location which provided increased construction area but required significant rerouting of the existing gravity sewer system was ultimately chosen as the most suitable site for the project. The project design included two 15 hp 850 gpm submersible peak flow pumps and one 5 horsepower 320 gpm submersible average flow pump. The ( three pump system allowed the City to minimize power costs without the use of variable frequency drives. The design required an extensive documentation and monitoring program to be developed to document the conditions of existing homes and to alert the City to any ground subsidence which may be occurring during construction. Over 100 homes were targeted for video taping and written documentation of their condition. The monitoring program included inclinometers, ground water wells, seismograph monitoring during sheet pile installation, and survey settlement points on homes and sidewalks. Extensive coordination with the Homeowner's Association was continued through the design, with special provisions included in the specification to restrict construction hours, noise, and stockpiling of equipment as well as prohibiting work during special days of celebration such as the Christmas Boat Parade. A 300 amp electrical service meter is located in a weatherproof enclosure, above -grade directly adjacent to the pump station entry hatch. The pump station services a mixture of commercial, industrial, and residential land uses. The Citys Master Plan estimated the ultimate peak wet weather flow to the station at 1210 gpm, including 350 gpm from Pump Station No. 9, which discharges directly to the facility. Pump Station No. 9, along with a laundry located in close proximity, contribute to the high peak flows which are experienced at the station. The pump station had the following problems which prompted the City to undertake its rehabilitation: • The equipment was old, not dependable and spare parts were difficult to find for repair and maintenance. • During shutdowns, the wet well filled and sewage overflowed into the dry well. • The wet well was of inadequate volume to allow sufficient response time, prior to overflowing, in the event of a failure. While the mechanical equipment had been reliable, the area is prone to frequent disruptions in commercial power service. To provide response time during such an outage, the City desired to enlarge the wet well, or locating a standby diesel generator at the site. AKM prepared a preliminary design report, follow up final design, and construction support services for the . project. The final design consisted of constructing a parallel supplemental 40,000 gallon wet well to provide one -hour peak flow storage, a standby emergency generator, and upgrading of the pumps, motors, piping, valving, wet well, and the drywell. The City Is also interested in repairing the remaining reaches of sewer in the Old Town, Marina Hill, Bridgeport, and Marina Hill areas of the City, which were found by the 2005 Sewer Master Plan to be condition ( deficient. These projects are identified in the Master Plan as Priority No.'s 6 through 52, and have a total estimated project cost of $8.4 million. The City Is obtaining a low interest loan from the State Revolving Fund to construct the recommended upgrades. As currently proposed, two sets of construction documents will be prepared; one for the 8 Street and Pier Pump Station Improvements; and the second for the Sewer Rehabilitation work. It is also understood that due to the expected size of the sewer rehabilitation program, it may be desirable to break up the construction package into several smaller projects (such as a sewer lining project, spot repair project, and sewer replacement project) to obtain better pricing from specialized contractors. It was originally constructed in the 1920's and is a wet welVdry well facility which incorporates two 7.5 HP ESSCO recessed impeller pumps rated at 500 gpm each. The pump station's service area covers the land uses south of Ocean Boulevard, including flows generated on the Seal Beach Pier. Both the 1 Street Pump Station and Pier Pump Station discharge into its collection system. The City's 2005 Sewer Master Plan estimated the peak flow to the station to be 360 gpm at ultimate build -out. A study conducted by AKM in October of 2009 estimated the peak dry weather flow into the pump station to be 82 gpm. It further determined the capacities of the existing pumps were 290 gpm and 180 gpm, far less than their rated capacity. The study went on to recommend that the capacity of the new 8 Street Pump Station be designed for 290 gpm and the size of a new forcemain be 6 inches. The pump station is approximately 80 years old and is at the end of its useful life. The City would like to replace this facility with a new pumping plant and forcemain, which meets current design standards and City criteria, and is easier to operate and maintain. Design Criteria The new pump station will be designed to comply with current codes and regulations. Further, the pump station design will also meet or exceed the criteria established in the City's 2005 Sewer Master Plan. A summary of the anticipated criteria that will be utilized for the design of the pump station is listed below. Pumps • Provide a minimum of two pumps each sized for the peak wet weather flow conditions • Minimum solids handling capacity equal to 4 inches • Supply a spare pump and motor of the same type and size installed at the pump station Wet Wells • Sized to provide sufficient operational storage to limit pump cycling to less than 6 times per hour • Provide sufficient storage under peak wet weather flow conditions to allow City crews time to respond to a station failure • Depth must be sufficient to accommodate relocation of the Gold Coast Sewer to the beach front. - 24 - AKM Proposal No. 10-1102 CITY OF SEAL BEACH PROPOSAL FOR SANITARY SEWER PIPELINE AND DECEMBER 23, 2010 PUMP STATION IMPROVEMENT PROJECT #SS0901 Discharge Piping • Minimum size equal of 4 inches — To prevent plugging with solids • Flow velocity range shall be 3 -6 ft/sec — To maintain a self - cleansing condition in the pipe • Provide a flowmeter and pressure gauge — For monitoring of the facility • Pipe shall be ductile iron, lined with a ceramic /epoxy coating system (U.S. Pipe Protecto 401 or equal) Ventilation • Provide 30 air changes per hour in dry wells and vaults — To prevent dangerous accumulation of sewer gases, prevent condensation, and provide a source of fresh air for workers. Emergency Power • Provide a permanent emergency natural gas generator, sized to start both pumps, and supply the miscellaneous electrical loads with a voltage drop of no greater than 20 %. Controls • Provide City standard control panel manufactured by Murcal, with LCD display screen • Level control system shall be an ultrasonic level transducer. A duty and backup controller will be provided. A float system will also be installed to initiate a timed pump down of the wet well in the event of an ultrasonic level control system or PLC failure. SCADA • A Bristol Babcock RTU shall be provided with a Spread Spectrum Radio for communications of status and alarm signals with the SCADA base station at the Adolfo LoperYard. Flood Protection The existing and proposed 8 Street Pump Station are located in FEMA Flood Hazard Zone A -E. The base flood elevation is listed as 13 feet above mean sea level on the Flood Insurance Rate Map. The existing ground surface elevation in the area is 12 feet above mean seal level (AMSL). Although the existing pump station has never been inundated by flood waters or storm surge, it is recommended that the design of the new facility incorporate a pad elevation above this base flood elevation. Pump Station Replacement Alternatives The proposed location for the new pump station is directly to the north of the existing facility across the access c ' road to the beach parking lot. Alternatives considered will therefore be limited to the type of pump station to be constructed: wet ('• well / dry well or submersible. For each alternative, a new forcemain will be constructed to the alley north of Ocean Avenue, where it will discharge into the existing sewer located in the alley, Alternative 1 -- Construct a New Submersible Pump Station. Figures 1, 2 and 3 show a potential submersible pump station alternative. It consists of an 8 -foot diameter wet well approximately 20 feet deep and a 12' x 8' valve vault. Electrical equipment and an emergency generator would be located above -grade In a small block building. As an alternative, this equipment could be located in outdoor enclosures, with chain Zink fencing or a block wall securing the area. The existing pump station would be demolished after the new facility is placed on -line. Alternative 2 — Construct a New Wet Well / Dry Well Pump Station. Figures 3, 4 and 5 show a potential wet well / dry well pump station. It consists of an 8' x 16' wet well, connected to a 20' x 16' dry well. The dry well would include lighting, a ventilation system, and stairway access. Hatches would be placed in the top floor of the dry well to facilitate removal of the pumps by a crane. A natural gas generator and electrical equipment would be located in an above -grade building with an architectural theme matching the surrounding buildings. Again, as an alternative, this equipment could be left outdoors and secured by a chain fink fence or block wall. The existing pump station would be demolished after the new facility is placed on -line. it7 3 — Construct a New Submersible or Wet Well Dry Well Pump Station and Convert the Existing Pump Station Structure to Emergency Storage. With this alternative, either a submersible or wet well / dry well pump station would be constructed as described above, and the existing pump station would be converted to an emergency storage wet well. The design would be such that the structure would not begin to fill unless a high level condition occurred in the new pump station wet well. Feasibility of the alternative is predicated upon a structural evaluation of the existing facility to determine if it can be safely used for this purpose. While other alternatives may exist for reutilizing the existing pump station structure, we do not recommend anything that would require it to be anything more than a standby facility due to its extreme age. The advantages, disadvantages, costs, and construction impacts of each alternative will be fully developed in a • Preliminary Design Report for review and consideration by the City. Non -clog pumps have efficiencies of approximately 50% to 70 %, but have reduced solids handling capability. This type of pump is not recommended as they can be prone to clogging. • Vortex pumps utilize impellers which are located completely out of the flow path. They therefore have very good solids handling capability, but very low efficiencies (265% to 40 %). • Screw pumps incorporate a screw type impeller located directly in the flow path. These pumps enjoy high efficiencies of approximately 70% to 80% and have good solids handling capability. They are however more expensive, and replacement impellers often require long lead times. All pump alternatives will be thoroughly reviewed with the City prior to selecting the most appropriate design for the application. ( Pumps selected for a submersible application will be equipped with a slide rail system to allow maintenance personnel to remove and reinstall the pumps without entering the wet well. Pumps used in a dry well application will incorporate submersible motors so the pump will continue to operate if the dry well is flooded. DISCHARGE VALVING AND PIPING • Isolation valves shall be eccentric plug type with level actuators, or resilient wedge gate type with hand - wheel actuators. • Check valves shall be swing type with outside lever and spring. • A magnet flow meter and pressure sensor will be provided on the discharge piping. These devices shall be configured accordingly to communicate with the City's SCADA system. • Discharge piping will incorporate a flanged connection to allow bypassing of the facility using a portable pump. EMERGENCY GENERATOR The emergency generator will be sized to start and run 2 pumps in steps with no greater than a 20% voltage drop. The unit will run on natural gas. AEll l AKM Proposal No. 10-1102 - 32 - ER El 19 ® ®® PROPOSAL FOR SANITARY SEWER PIPELINE AND CITY OF SEAL BEACH PUMP STATION IMPROVEMENT PROJECT #SS0901 DECEMBER 23, 2010 "Low Battery', "Generator Run" and "Generator Fail" signals will be routed to the SCADA system RTU for i . remote monitoring by the City. WET WELL New wet wells will be designed as reinforced concrete structures with T -lock lining. They will include a small operational storage area to reduce odor problems and control solids accumulation. A larger emergency storage area will also be included to provide the City response time to an emergency at the facility. The depth of the wet well will be limited to 25 feet or less to allow cleaning by vactor trucks and to improve constructability. Existing structures which are converted to wet wells will be Tined with 120 mils of an epoxy /polyurethane coating system. The bottom will also be sloped to prevent the accumulation of solids. • CONTROL SYSTEM A duplex pump control system will be provided for the pump station. In general, the control strategy will be to start and stop each pump based upon a pre - programmed level, as measured by an ultrasonic level transducer. If the lead pump fails or is unable to keep up with the influent flow, the lag pump will be called to start. A float switch will be provided as a backup system in case of a failure of the level controller. Once . ( ; ' initiated by the float switch, both pumps will run for a pre - selected time period before they are shutdown. The pump station will be capable of running in this mode indefinitely. Control panels shall be designed to communicate fail conditions to an emergency telephone dialer that Is to be provided as part of the project. "Pump Fail", "High Wet Well Level ", "Power Fail ", "Generator Fail" and "Intrusion" signals will be furnished. The control panel will also be configured to communicate with the City's SCADA system via Spread Spectrum Radio. Status and alarm signals which will be provided will include: • Pump Run, Fail • High Wet Well Level • Discharge Pressure • Generator Fad ■ Pump Seal Fail • Wet Well Level • Power Fail • Generator Low Fuel • Pump High Motor Temp • Flow Rate • Intrusion • Generator Low Battery • Generator Run C. Sewer System Rehabilitation The 2005 Sewer Master Plan Update evaluated all of the sewers in the City's collection system for capacity and condition deficiencies. Capacity deficiencies were Identified using a sewer modeling program while - 33 - AKM Proposal No. 10-1102 CITY OF SEAL BEACH PROPOSAL FOR SANITARY SEWER PIPELINE AND DECEMBER 23, 2010 PUMP STATION IMPROVEMENT PROJECT #SS0901 (" condition deficiencies were determined through review and assessment of CCTV inspections of the existing sewer pipes. These CCTV inspections were performed between 2002 and 2004. The condition assessment found 52 sewer segments to be deficient and recommended in most instances complete replacement of the facility. The City, In 2007, designed improvements to the first 5 projects in the condition deficient capital improvement program. It was determined during this process that many of the facilities which were recommended by the Master Plan for replacement could be satisfactorily repaired through the installation of a PVC liner. The City Is now looking to complete the remainder of its condition deficiency Capital Improvement Program (Projects 6 -52), which totals approximately 24,000 LF of sewer and 115 manholes. Based upon the experience with the first year Capital Improvement Program, it Is believed that many of the projects identified for total replacement can be satisfactorily repaired by installing a PVC liner, or performing a small spot repair. The City has requested that each of the sewers identified in the Sewer Master Plan as "condition deficient" be re- inspected utilizing CCTV so that the current condition of the facility can be assessed and more cost - effective solutions implemented. In general, pipes with cracks, minor offsets, deposits, root intrusion, and infiltration can be refurbished with a PVC lining system. Broken pipe, or pipe with large offsets or obstructions may require a spot repair. Pipe which is totally deteriorated, or has long sags can only be corrected by total replacement. Because it Is currently unknown, we have assumed in our proposal that approximately 5000 LF of sewer will require total replacement, necessitating detailed plan and profile construction drawings be prepared. Our proposal is predicated on developing standard type details for any spot repairs needed, and an atlas type map to identify locations for sewer lining projects. D. Pier Pump Station General, The Pier Pump Station is located at the end of the Seal Beach Pier, under a loading ramp and door landing for the Ruby's Restaurant. The pump station consists of a small fiberglass tank which is strapped to the bottom of the pier deck. The pump station includes two 120 gpm, 3 HP submersible pumps which discharge directly to the 8 Street Pump Station through a 4 -inch forcemain. The facility only serves Ruby's and two public restrooms at the end of the MUM Altvelft. ® ® ._ ®--® ®d AKM Proposal No. 10-1102 - 34 - Eil ® El PROPOSAL FOR SANITARY SEWER PIPELINE AND CITY OF SEAL BEACH PUMP STATION IMPROVEMENT PROJECT #SS0901 DECEMBER 23, 2010 pier. The Master Plan estimated average flows to the pump station at 0.86 gpm. Peak flows were estimated ( • at 12 gpm. The existing pump station is extremely difficult to access, which makes it difficult to maintain. Entry to the wet well is through a small removable wood cover in the loading ramp landing above. The opening is too small to provide direct access to the equipment. An operator must lay down on the landing deck and lean into the area enclosed by the ramp and landing to access the pumps. Pumps can only be removed by unbolting a flange located in the wet well, which is extremely difficult. The wet well also accumulates a considerable amount of grease because Ruby's does not maintain a grease removal device at its restaurant. The City would like to improve the existing pump station by providing the following upgrades: • Redesign access to the pump station wet well and equipment • Replace the 20 year old fiberglass wet well with a new wet well designed with secondary containment • Replace the existing pumps and vaiving ▪ Install a new pump control panel • Install a new RTU at the site to communicate with the City's SCADA system • Install a grease trap at the station Access Access to the pump station is best improved by relocating it out from underneath the door landing. An access hatch could then be installed in the pier deck providing direct access to the wet well, valves, and pump equipment. if it is not possible to relocate the pump station, then a large stainless steel access hatch (4 x 4' or larger) should be placed in the door landing above the pump station. This would allow an operator better access to the wet well. During our inspection of the pier pump station, It appears much of the wood used to construct the loading ramp and landing has rotted. It is therefore anticipated that this structure will need to be entirely replaced when improvements to the Pier Pump Station are constructed. Wet Well Replacement Removal of the existing wet well will be difficult and will require that the restaurant and bathrooms be shutdown while the work is occurring. It is anticipated that construction crews will need access under the pier ( - 35 - AKM Proposal No. 10 -1102 CITY OF SEAL BEACH PROPOSAL FOR SANITARY SEWER PIPELINE AND DECEMBER 23, 2010 PUMP STATION IMPROVEMENT PROJECT #SSO901 ( to remove the tank. A barge moored under the pier with a boom may be required for this access. It may also be possible to utilize a bridge inspection boom, if the pier is capable of supporting the vehicle load. The wet well replacement would consist of a stainless steel trough suspended from the top of the pier deck with a fiberglass wet well located within. The trough would not only support the fiberglass wet well, but would provide a means of secondary containment. Figure 6 shows the proposed concept. Control Panel and RTU Replacement A new Murcal pump control panel will be provided for the station. An RTU will also be installed at the site to communicate alarms 'and signals to the City's SCADA station. We have included in our proposal a Radio Survey to verify that communications are possible, and to determine the location and height of the antenna which will be installed. Grease Trap Depending on the restaurant plumbing, a grease trap will be designed for the project. it is currently anticipated that the grease trap could bp located in the enclosed area securing the electrical equipment next to the pump station. However the final location will need to be approved by Ruby's and the City. SECTION 6 - SCOPE OF WORK The scope of work is divided into three phases addressing the necessary elements for both the pump station upgrades and the sewer system spot repairs. It Is anticipated that two separate sets of construction documents will be developed for the two programs. The first phase of work, Phase A "Completion of Preliminary Engineering ", will form the basis for the subsequent design work, addressing and documenting all issues relevant to the project. Phase B "Final Design Services, Construction Plans and Specifications ", is the actual preparation of construction documents for each project. The final phase, Phase C "Construction Support ", outlines office engineering and field support services that will be furnished during pump station and sewer construction. Not shown in each phase of work, but included in the project scope are project management, meetings, and coordination of work. It will become the basis for the work to be completed under TASK 13, Final Construction Documents. The tasks identified for the Preliminary Design Phase are as follows. 1. RESEARCH AND INVESTIGATION A. Kick -Off Meeting The project will commence with a kick -off meeting with the City. The purpose of the project and the desired objectives will be discussed. The project schedule will be reviewed and lines of communication will be established. City staff will be interviewed to develop insight into the existing 8 Street Pump Station operation and discuss preferences, if any, on layout valving, piping, pumps, controls, electrical, tetemetry and other components. If any standardization is desired, its application to the project will be evaluated. Also discussed will be the proposed CCTV sewer inspections, and proposed improvements to the pier pump station. AKM will prepare minutes summarizing the meeting discussions, and distribute the minutes to all meeting participants. 8. Review Existing Documents Existing facility plans, specifications, operational data, measurements, topographic maps, geotechnical studies, easements and legal documents will be obtained. The information will be completely reviewed and documented as appropriate. C. Utility Coordination As -built plans and /or atlas sheets for all the utilities in the vicinity of the 8 Street Pump Station and Sewer Rehabilitation Projects will be obtained. This information will be plotted on base maps of the work area, and confirmed through field Investigations. Site Surveys Detailed ground surveys will be prepared in the area of the 8 Street Pump Station, and in 8 Street to the alley north of Ocean Avenue to supplement the City's aerial topographic map. A second survey will also be conducted on the pier for the purpose of creating a base map of the facilities constructed in and around the pier pump station. The survey work will include: o Surface features in the area of work o Spot elevations at regular intervals o Pick -up of USA markings o Establishment of centerlines and right -of -way o Dipping of existing sewer manholes Field surveys will be conducted by C &V Consulting, under the direction of Mr. Charlie Priolo, as a subconsultant to AKM. E. Geotechnicallnvestlaation A geotechnical study will be conducted at the 8 Street Pump Station site to determine soil conditions and provide design recommendations for the wet well and building, as well as construction recommendations for shoring and dewatering. It is anticipated that one boring will be drilled to a minimum depth of 50 feet (deeper if necessary to locate an impervious layer below the site). This boring will be cased and left in place to be used as a monitoring well during construction. The report will address the following: • Allowable vertical and lateral capacity of foundations • The modulus of subgrade reaction at the mat slab level • Total and differential settlements • Geotechnical and seismic hazards including fault ground rupture, liquefaction, and seismic - induced settlement • Lateral (active, passive, and at rest) earth pressures for retaining structures • Site- response coefficient and seismic design criteria per the California Building Code • Pavement design recommendations - 39 - AKM Proposal No. 10-1102 CITY OF SEAL BEACH PROPOSAL FOR SANITARY SEWER PIPELINE AND DECEMBER 23, 2010 PUMP STATION IMPROVEMENT PROJECT #SS0901 • Existing and historic high groundwater levels • Shoring design recommendations, including driving of sheet piles near existing structures • Dewatering recommendations, including water quality analysis • Settiement, vibration, and groundwater monitoring program recommendations Geotechnical services will be performed by Ninyo and Moore, under the direction of Mr. Jalal Vakili, Ph.D., P.E., as a subconsultant to AKM. F. SCADA System Analysis A radio survey and path study will be prepared to determine if radio communications are possible from the 8 Street and Pier Pump Stations. The study will also provide recommendations on radio equipment and antenna height. The SCADA system analysis will be prepared by Conceptual Designs, under the Direction of Mr. Vince Cox, as a subconsultant to AKM. G. CCTV Inspection of Condition Deficient Sewers ( ; CCTV inspections of each condition deficient sewer identified in the Sewer Master Plan (Priority Projects 6 -52) will be conducted. The purpose of the CCTV inspections will be to confirm the existing master plan recommendations, and to determine if additional degradation of the facility has occurred. A total of 24,000 LF of sewer will be videoed. Gravity Sewers The inspections will provide a permanent record of the existing condition of the Citys gravity sewer system, and will be used to develop the City's Sewer System Rehabilitation and Replacement Plan, which is part of the Operation and Maintenance Program. As a subconsultant to AKM, Empire Pipe Cleaning and Equipment, Inc. will furnish all equipment, materials, traffic control, and labor required to thoroughly clean and inspect 24,000 of gravity sewers (6 -inch to 21 -inch diameter sewers) through closed circuit television (CCTV). We propose to conduct all inspections in accordance with the National Association of Sewer System Companies (NASSCO) Pipeline Assessment and Condition Program (PACP) standards. in recent years, the PACP standards have become nationally recognized as the industry standard for evaluating ( ! the condition of sewer collection systems and manholes. Conditions and defects will be located by footage and clock reference and will be described using the PACP defect classification. At the conclusion of the CCTV Inspection, all original written Togs and all original recording media, one duplicate set copy, and one hard drive containing the entire inspection will become the property of the City of Seal Beach. The written reports and recording media will meet all reporting requirements. All inspections will include the upstream and downstream manhole identification numbers and pipe numbers per the City's updated sewer GIS. This will ensure compatibility with the City's Sewer GIS as well as the Wastewater Master Plan Report. Sewer Manholes A detailed manhole inspection will be conducted by an independent crew. Pole cameras and software will capture high quality images of each of the manholes. Features such as frame, lid, chimney, and wall will be documented and measured. Manhole inspection data will be recorded separately for each manhole. H. Flow Monitoring (Optional) Flow estimates for the 8 111 Street Pump Station were contained in the Master Plan and in a subsequent • study prepared by AKM in October of 2009. As an optional service, AKM will install flow monitoring equipment in the 2 manholes upstream of the pump station to verify the estimates. Flow monitoring will be conducted for a 2 -week period and will provide average, peak, and diurnal flow information. Flow monitoring will be performed by ADS as a subconsultant to AKM. 2. PRELIMINARY DESIGN REPORT A Preliminary Design Report will be prepared to identify the recommended upgrades for the 8 Street and Pier Pump Stations, as well as the condition deficient sewer facilities. At a minimum, the following elements will be evaluated and/or include in the report. fr Street Pump Station A. Determine Influent Flow Influent flow will be determined from information in the Master Plan and the AKM 2009 Study. If the optional flow monitoring task is implemented by the City, the influent flow determined from those measurements will be used. Peak wet weather flows will be calculated using factors included in the - 41 - AKM Proposal No. 10 -1102 CITY OF SEAL BEACH PROPOSAL FOR SANITARY SEWER PIPELINE AND DECEMBER 23, 2010 PUMP STATION IMPROVEMENT PROJECT #SS0901 City's Sewer Master Plan. The firm pumping capability will be selected to deliver the entire peak wet weather flow. B. Identify Upgrade Alternatives Multiple alternatives will be identified for upgrading the pump station. Some of the potential alternatives that may be considered were discussed in the Project Understanding section of this proposal. Each alternative will be evaluated based upon level of service, cost, constructability, maintenance, and impacts to the surrounding area. Concept drawings depicting each alternative will also be prepared. C. Equipment Sizing and Selection Equipment alternatives will be identified and evaluated. Recommendations will be made based upon economics, maintenance, reliability, and the City's familiarity or standardization with the specific item of equipment. Pump sizing will be based upon the flow studies conducted in Task 2A above, and headloss ( calculations through the pump station and forcemain. Generator sizing will be based upon starting and running each pump in steps while limiting voltage drop to no more than 20 %. The wet well will be sized to limit pump cycling to no more than 6 starts per hour and to provide, at a minimum, 30 minutes of storage under peak flow conditions. The depth of the wet well will be minimized as much as possible to reduce shoring and dewatering requirements for construction. The wet well will however be designed with sufficient depth so that the City may, in the future, reconstruct the Gold Coast Sewer along the beach, removing it from its current alignment which is an easement that is difficult to access. D. Electrical Equipment and Generator Enclosure Alternatives for housing the electrical equipment within a building, or within outdoor rated enclosures will be evaluated. Criteria for this evaluation will be OSHA, NFPA 820, the National Electrical Code, Department of Health Services and our experience with similar projects. Some of the items included in this assessment will be as follows: • Ventilation equipment sized in conformance with NFPA 820 and City requirements • Lighting • Access hatches to facilitate pump removal • Limit switches on exterior hatches and building doors for intrusion detection F. Evaluate Structural Condition of Existing Pump Station Dry Well and Wet Well The structural adequacy of the existing pump station structure must be evaluated to determine if the structure can be safely converted into an emergency storage wet well. AKM will conduct field inspections of the facility to evaluate the structure's existing condition. Structural calculations will be prepared based upon the as -built drawings to determine the adequacy of the structure, and /or structural upgrades that would be required. G. Develop Preliminary Design Drawings We will develop preliminary design drawings for each alternative considered. The following will be prepared: 1. Detailed site plan 2. Elevations or rendering 3. Structural modifications (if rehabilitation alternative is recommended) 4. Mechanical plan 5. Mechanical section Plans will be developed on 11" x 17" paper. H. Construction Phasing AKM will develop construction phasing for implementing the proposed improvements while maintaining operation of the existing pump station. This work will describe how the existing sewers will be rerouted to allow construction of the recommended facilities, any bypass pumping that is required, and testing and acceptance protocol prior to switching services. - 43 - AKM Proposal No. 10 -1102 CITY OF SEAL BEACH PROPOSAL FOR SANITARY SEWER PIPELINE AND DECEMBER 23, 2010 PUMP STATION IMPROVEMENT PROJECT #550401 1. Sketches will be created to help illustrate the proposed recommendations. B. Existing Equipment Evaluation The condition and adequacy of the existing mechanical equipment will be evaluated. Recommendations for replacing the existing fiberglass wet well will also be generated. C. Control Panel Replacement AKM will investigate the feasibility, and provide costs, for replacing the existing pump station control panel with the City preferred panel manufactured by Murcal. D. SCADA System Analysis The results of the SCADA study, conducted under Task 1.F., will be included as part of the overall Pier Pump Station investigation communications, antenna height, and radio recommendations will be addressed. E. Grease Trap Installation The existing plumbing from Ruby's Restaurant will be investigated to determine the feasibility of installing a grease trap in the enclosed electrical equipment area outside the restaurant. Grease trap sizing and required plumbing modifications will be identified, with sketches provided as appropriate. Sewer System Rehabilitation AKM will review the videos and reports addressing the Master Plan identified condition deficient sewers, completed under Scope Task 1.g. Initial review will be completed by our in -house NASSCO certified staff. In most instances, lining the deficient sewer provides a suitable long term repair. The analysis of the reviewer and Project Engineer will be included in the Preliminary Design Report. An exhibit will be generated which shows the locations of all sewers to be lined; where a spot repair is to occur; and where total replacement is needed. Report Preparation The results of the analysis and studies, above, will be documented in a Preliminary Design Report. It will include background information, a discussion of the deficiencies, a detailed evaluation and discussion of the potential improvements, alternative evacuations, costs, design parameters, construction phasing, proposed bidding and construction schedule, and calculations. This report will guide the preparation of the subsequent construction documents. Our proposal is predicated upon designing an entirely new pumping facility and forcemain for the 8 Street Station. The work at the Pier Pump Station includes a new wet well with secondary containment; new access hatch installation; new grease trap; new pump station control panel; and new telemetry system. The amount of sewer replacement is currently unknown. Our proposal is predicated upon preparing plan and profile drawings for 5000 LF of sewer reconstruction. Lining projects will be delineated by an atlas map, and descriptions in the project specifications'. Standard details for the various spot repairs identified will also be provided in the plan set. 1. Construction Plans The plans will be developed to 50, 90 and 100 percent stages, each followed by City review. The plans will be prepared in accordance with the requirements of the City and the "Standard Specifications for Public Works Construction (SSPWC), Latest Edition" as well as applicable national and local codes. The base cost of our proposal is also predicated on a submersible design. Should the City select a wet well / dry well pump station for replacement of the 8 Street facility, an additional 6 structural sheets and 1 mechanical sheet of drawings will be required (7 total additional sheets). Atlas Map Showing Project Locations 4 -15 Sewer Replacement Plan and Profile Drawing 16 -18 Sewer Sport Repair Details 19 -20 Miscellaneous Sewer Details Plan and profile drawings will be developed at 1 " =20' horizontal and 1 " =4' vertical scales. The pump station site plan will be at a scale of 1" = 8'. Details will be drawn to a minimum scale of Y2 "= 1' -0 ". 2. Specifications Separate specifications packages delineating project issues and technical requirements will be prepared ( ) for the pump station Improvement project and sewer rehabilitation project. The Special Provisions will describe design and coordination features of the project, as well as provide requirements for materials, equipment, installation, and workmanship. A bid schedule will also be prepared which will be broken out into sufficiently detailed tasks to assist in evaluating the bids. City furnished Contract Insurance and Standard Specification Documents will be included to complete the package. 3. Cost Estimates Detailed construction cost estimates will be developed for each plan submittal to the City (for both design packages). The estimates will incorporate price quotes from equipment vendors, and will reflect the most recent trends in construction pricing. TASK C — BIDDING SERVICES AKM will provide engineering services during the bid process for each project, as follows: 1. Respond to Questions during Bidding This task will involve responding to contractor questions during the bidding period. It is understood that the City will receive all the questions and issue the responses in order to properly control the flow of information. A ra efilhiSta. Attend Pre -Bid Conference The Project Manager and the lead engineers will attend this meeting to respond to contractor questions. 3. Prepare Addenda If needed, the plans and specifications will be revised to address the bidding period issues and addenda will be prepared. TASK D — CONSTRUCTION PHASE SERVICES • AKM will provide engineering services during construction, for each project, as follows: 1. Response to Requests for information and Request for Change Order. AKM will provide responses to requests for information and change orders forwarded by the City. . 2. Shop Drawing Review The shop drawings will be received by the City and transmitted to AKM for review. Two reviews of each shop drawing have been included in the scope of work (total 30 reviews). AKM will maintain a complete log of the shop drawing submittal and review process. Shop drawing reviews will be completed within one week of receipt. 3. Site Visits / Construction Meeting Attendance AKM will provide periodic site visits to monitor construction progress and to attend construction meetings. A total of 10 site visits have been included for the pump station improvement project, and 4 site visits for the sewer rehabilitation work. 4. Start-Up Assistance (Pump Station Project Only) It is proposed that AKM prepare a start -up testing protocol and submit it to the City and the Contractor for review and comments. Following the acceptance of the testing protocol, start-up testing should be scheduled and conducted to ensure that all systems function as designed. A start-up testing report will be prepared and submitted to the City. The report will also provide directions to the contractor for corrective action. 5. As -Built Drawings AKM will prepare as -built drawings for each project based upon the Contractor's and Inspector's red -lined construction notes. The corrections will be made electronically and the drawings replotted on mylar.
