HomeMy WebLinkAboutPC Res 06-44 - 2006-10-18 RESOLUTION NUMBER 06-44 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING PLANNED SIGN PROGRAM 06-2 PERMITTING A PLANNED SIGN PROGRAM FOR THE P ACIFIC GATEWAY PLAZA AT SEAL BEACH BOULEVARD AND WESTMINSTER AVE, SEAL BEACH. THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY FIND AND RESOLVE: Section 1. On September 8; 2006, John Mehigan, on behalf of Panattoni Development Co., filed an application with the Department of Development Services for Planned Sign Program 06-2. Section 2. Pursuant to 14 Calif. Code of Regs. 9 15301 and 9 II.B of the City's Local CEQA Guidelines, staff has determined as follows: The application for Planned Sign Program 06-2 is categorically exempt from review pursuant to the California Environmental Quality Act pursuant to 14 Calif. Code of Regs. 9 15305 (Minor Alterations in Land Use Limitations), because the proposal involves a minor alteration in land use limitation and does not involve either a property in excess of20% slope or a change in land use or density. Section 3. A duly noticed public hearing was held before the Planning Commission on October 18, 2006, to consider the application for Planned Sign Program 06-2. Section 4. The record of the hearing of October 18, 2006 indicates the following: (a) On September 8, 2006, John Mehigan, on behalf of Panattoni Development Co., filed an application with the Department of Development Services for Planned Sign Program 06-2. (b) Specifically, the applicant has submitted a "Sign Program" for the Pacific Gateway Plaza located at Seal Beach Blvd. and Westminster Ave. The Program calls for wall signs and three monument signs along Seal Beach Blvd. and Westminster Ave. and menu board signs for a future drive-thru restaurant. (c) Section 28-1803 sets forth the procedure to apply for a planned SIgn program. (d) The subject property is described as Assessor's Parcel Number 095-010-58. (e) Surrounding land uses and zoning are as follows: 100 NORTH SOUTH EAST WEST Planning CommissIOn ResolutIOn 06-44 Planned Sign Program 06-2 - Seal Beach Blvd /Westmlllster Ave October /8, 2006 (Across Westminster Avenue) - Commercial businesses and United States Post Office in the Service Commercial (C-l) Zone and the General Commercial (C-2) Zone, and the residential neighborhood of Leisure World in the Residential High Density/Planned Development (RHD/PD) Zone. (Across Seal Beach Boulevard) - The Seal Beach Naval Weapons Station in the Public Land Use/Recreation (PLU/R) Zone. Commercial businesses and an automobile service station in the General Commercial (C-2) Zone, and across Seal Beach Boulevard, the Seal Beach Naval Weapons Station in the Public Land Use/Recreation (PLU/R) Zone. Boeing parking lot and facilities in the Boeing Space and Communications Group Specific Plan (SP). Section 5. Based upon the facts contained in the record, including those stated in 94 of this resolution and pursuant to 9 28-1803 the City's Code, the Planning Commission makes the following findings: (a) Planned Sign Program 06-2 is consistent with the intent of Article 18 (Sign Provisions) and the General Plan. (b) The proposed SIgns meet the design criteria established through Section 28-1803 of the Municipal Code. (c) Approval of this request does not constitute the granting of special privilege or allow substantial greater visibility than the standard provisions allow. Planned Sign Program: (d) The following items have been considered as part of this 1. Distance of buildings from street 2. Size of buildings 3. Traffic speed on the street 4. Arrangement of buildings on the lot or parcel 5. Number of anchor tenants Section 6. Based upon the foregoing, the Planning Commission hereby approves Planned Sign Program 06-2 subject to the following conditions: 1. Planned Sign Program 06-2 for wall signs, three monument signs, and menu board signs is approved with the following modifications: o The planned sign program shall be modified to limit the maximum gross square footage of menu board signs to 45 square feet and the maximum height to six feet. Menu board signs shall be designed to compliment the architecture ofthe building. 20f3 Plalllllng COlllllllsslOn Resolution 06-44 Planned Sign Program 06-2 - Seal Beach Blvd. /West/lllllster Ave October /8, 2006 2. The monument sign located along the Westminster Avenue frontage may be relocated within 100 feet of the driveway entrance to the site upon review and approval by the Director of Development Services. 3. Any substantial deviation from the program approved herein by the City must be approved through an amendment to this Planned Sign Program. 4. In order to achieve consistency with the proposed buildings, all of the monument signs will be of similar construction and appearance and wall signs and lettering will be of similar size according to this approved Planned Sign Program. 5. This Planned Sign Program is for wall signs, monument signs, and menu board signs. Any additional signs, including window signs, must be within the allowable sign regulations of the Municipal Code and should not be visually incompatible as determined by the Director of Development Services. 6. This Planned Sign Program shall not become effective for any purpose unless/until a City "Acceptance of Conditions" form has been signed by the applicant in the presence of the Director of Development Services, or notarized and returned to the Planning Department; and until the ten (10) calendar-day appeal period has elapsed. 7. This Planned Sign Program shall become null and void unless exercised within one (I) year of the date of final approval, or such extension of time as may be granted by the Planning Commission pursuant to a written request for extension submitted to the Department of Development Services a minimum of ninety (90) days prior to such expiration date.
