Bahorski, City Manager FROM: Mac Cummins, Associate Planner /Special Projects Manager SUBJECT: ADOPTION OF RESOLUTION -- APPEAL OF PLANNING COMMLSSION DENIAL OF CONDITIONAL USE PERMIT NO. 01 -9, A REQUEST TO SERVE BEER AND WINE FOR ON -SALE CONSUMPTION AT RIVER'S END RESTAURANT (15 1 ST.) SUMMARY OF REQUEST: -- Adopt resolution of approval for Conditional Use Permit 01 -9 (River's End Restaurant). BACKGROUND: On October 14, 2002, the City Council voted 4 -1 (Antos voting no) to approve a beer and wine license at 15 1 St. (River's End). No resolution was provided for the Council that evening. The formal language of the resolution has been prepared and is before the Council this evening. The resolution is attached for Council review. FISCAL IMPACT: Limited fiscal benefit. As per the terms of the lease with Mr. Balchin, the City does share in revenue generated as a function of overall sales of beer and wine on the property. The City retains 7% of the sales generated by beer and wine, IF the conditional use permit were to be approved. NOTED AND APPROVED: q r /244..
