SUBJECT: RESCIND CONTRACT AWARD FOR THE CONSTRUCTION
OF SEAL BEACH BOULEVARD BIKE LANE AND STORM
DRAIN PROJECT, SOUTH OF WESTMINSTER AVENUE.
CIP No. 50025, AUTHORIZE RE -BID
SUMMARY OF REQUEST:
The proposed action will rescind the award of the contract for the construction of the Seal Beach
Boulevard Bike Lane and Storm Drain Project, south of Westminster Avenue from Southland
Construction and authorize Staff to re -bid the project.
BACKGROUND:
On July 22, 2002, City Council awarded the Seal Beach Boulevard Bike Lane and Storm Drain
Project, south of Westminster Avenue, Project No. 50025 to Southland Construction in the
amount of $178,800.00. The contractor has not provided the City with the insurance, schedules,
. and material submittals required by the bidding specifications, and it is in default of the contract.
Numerous written correspondences, phone calls, and scheduled meetings have not produced the
required contract documents.
The next lowest bidder's proposal has expired and Staff is requesting that the existing contract be
rescinded and that the project be re -bid.
FISCAL IMPACT:
Measure M, GMA No.6 funds are available and have been programmed in the approved Capital
Improvement Program. The project cost including design, construction and inspection is
estimated at $250,000.
RECOMMENDATION:
1. Rescind the award of the contract for the construction of the Seal Beach Boulevard Bike
Lane and Storm Drain Project, south of Westminster Avenue to Southland Construction,
in the amount of $ 174,800 and authorize Staff to re -bid the project.

2. Declare the bid bond of Southland Construction forfeited to the City of Seal Beach as
provided by Public Contract Code Section 20172.
