I OATH OF OFFICE The City Clerk administered the Oath of Office to James W. Dunn, Jr., 8-27-73 ?7 District One, to fill the'unexpired term of Thomas Barnes. Mr. Dunn took his seat at the Council table with congratulations fTom members of the Council present. ROLL CALL Present: Mayor ProTem McKnew Councilmen Dunn, HOlden, Sales I Absent: Councilman Blackman Also present: Mr. Courtemarche, City Manager Mr. Winfield, Assistant City Attorney Mr. Spielman, Acting City Engineer Mr. Neprud, Planning DiTector Mr. VanDerhyden, Assistant to the City Manager Mr. Gaudio, AdministTative Assistant ' PUBLIC'HEARING - ZONING -'FRONT and SIDEYARD ENTRANCES Mayor McKnew declared the public hearing open to consider amending Article 18, Section 1819, to require that main entrances and that aTea immediately adjacent to said entrances or dwellings where the entrances abut or are reached via a sideyard shall maintain a minimum distance of five feet from the property line. The City Clerk stated that notices had been posted as required by law and I that no communications had been received for or against the matter. Mr. Neprud, Planning Director, presented the staff report and recommendations of the Planning Commission. There were no communications from the audience either for or against the matter. Mayor McKnew dec~ared the public hearing closed. ORDINANCE NUMBER 913 - ZONING - FRONT and SIDEYARD ENTRANCES Ordinance Number 913 was presented to Council for first reading by title "AN ORDINANCE OF THE CITY OF SEAL BEACH AMENDING SECTION 1819 OF ARTICLE 18 OF THE ZONING APPENDIX OF THE CITY CODE CLARIFYING REQUIREMENTS FOR FRONT OR REAR ENTRANCES ABUTTING SIDEYARDS." AYES: NOES: Dunn, Holden, McKnew, Sales None ABSENT: Blackman Motion carried PUBLIC HEARING - APPEAL A-2-73 (V-22-73) - SURFS IDE COLONY Mayor McKnew declared the public hearing open to consider the ,98 8-27-73 appeal, A-2-73, of Surfs ide Colony, Ltd. to Planning Comm~s5ion: deci~io~ gr~t~ng,Yariance'V-22-73 for construction of garage in excess of ten feet in height'~t Lot,49" Block B., Surfs ide Colony. The City Clerk stated that notices had been posted and mailed as required by law and that no communications had been received either for or against the matter. Mr. Neprud, Planning,Director, presented the staff report and actions of the Planning Commission. , M9,rsha Kober, B-32, Surfs ide was, duly sworn, in by the Clerk and spoke for ,granti.ng the appeal. William Sawtelle, B-50, Surfside, was duly sworn in by the Clerk and stated his objection to the construction of the l3foot, 9 inch garage and spoke for granting the appeal. William Bruton, B-6l, Surfside, member of the Surfside Board of Directors, was duly sworn in by'the Clerk and related the Board's feelings against granting the variance and spoke for granting the appeal. There were no further communications from the audience; Mayor McKnew declared the public hearing closed. Councilman Dunn requested information regardi.ng h~ights of other structures in the area. Betty Jean Dunham, B-41, Surfside, stated that he garage was 9 feet, 5 inches and with the parapet it was 12 feet, 5 inches. Councilman Sales asked if there was a means of preventing a parapet wall from being added at a later date. Mr. Neprud stated that this condition could be imposed with the granting of a variance. McKnew moved. that this matter be referred back to the Planning Commission for further consideration. Councilman Sales seconded the motion. ORDINANCE 'NUMBER 912 - STREET EXCAVATION STANDARDS I Ordinance Number 912 was presented to Council for second reading by title "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH AMENDING CHAPTER 20, STREETS AND SIDEWALKS, OF ,THE CODE OF THE CITY OF SEAL BEACH, CALIFORNIA, PERTAINING TO THE REGULATION OF EXCAVATIONS IN PUBLIC PLACES; REQUIRING ,A PERMIT T-HEREFORE AND ,PAYMENT OF A FEE; IMPOSING REQUIREMENTS IN CONNECTION WITH SUCH, WORK' INCLUDING TRAFFIC PEDESTRIAN SAFEGUARDS AND THE PROTECTION OF UTILITIES AND OTHER PROPERTY; REGULATING THE BACKFI-LLING AND RESURFACING OF EX€AVATIONS; PRESCRIBING SURETY BOND, INSURANCE AND DEPOSIT REQUIREMENTS; AND PRESCRIBING PENALTIES FOR VIOLATIONS OF PROVISIONS CONTAINED'HEREIN." ,Holden moved, second by Sales to waive further,reading and adopt Ordinance Number 912 as presented. AYES: Dunn, Holden, McKnew, Sales NOES: None ABSENT: Blackman Motion carried 'ORDINANCE NUMBER 914 - VACATIONS Ordinance Number 914 was presented to Council for first reading by title' "AN ORDINANCE OF THE CITY OF SEAL BEACH, CALIFORNIA, AMENDING SECTION 7-37, CHAPTER SEVEN, SEAL BEACH CITY CODE, RELATING TO VACATIONS." Sales moved, second by Dunn to waive further reading of Ordinance Number 914, deem that it has had first reading and be passed to second reading. AYES: Dunn, Holden, McKnew, Sales NOES: None ABSENT: Blackman Motion carried ORDINANCE'NUMBER 915 - 1973-74 FISCAL YEAR TAX RATE The City Manager presented Ordinance Number 915 to the Council and explained certain sections therein. Ordinance Number 915 was read in full entitled "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, FIXING AND DETERMINING THE RATE OF TAXES TO BE LEVIED FOR MUNICIPAL PURPOSES OF THE'CITY OF SEAL BEACH FOR FISCAL YEAR 1973-74, AND DECLARING THE URGENCY THEREOF, AND THAT THIS 1 I 30 8-27-73 ORDINANCE SHALL TAKE EFFECT IMMEDIATELY." Discussion followed. Holden moved, second by Sales to adopt Ordinance Number 915'as presented. AYES: Dunn, HOlden, McKnew, Sales NOES: None ABSENT: Blackman Motion carried RESOLUTION 'NUMBER 2247 - SALARY RATES 1 Resolution Number 2247 was presented to Council by title "A RESOLUTION OF nm CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, A CHARTER CITY, ESTABLISHING SALARY RATES, A SALARY AND WAGE SCHEDULE, AND OTHER PAYMENTS FOR EMPLOYEE 'BENEFITS, AND REPEALING, ON THE EFFECTIVE DATES SPECIFIED, ALL RESOLUTIONS IN CONFLICT THEREWITH.," Sales moved, second ,by Dunn to waive further reading and adopt Resolution Number 2247 as presented. AYES: Dunn, Holden, McKnew, Sales NOES: None ABSENT: Blackman Motion carried CONSENT CALENDAR I Councilman Dunn requested that Item "C" be removed from the Consent Calendar. The City Manager noted that the amount of $2800 in Item "G" was in error and should be changed to $3500. Holden moved, second by Sales to approve the reconunended actions for items on the Consent Calendar except Item "C" as presented. A. Approved the minutes of the regular meeting of August 13, 1973 as presented. B. Approved regular demands numbered 15353 through 15451 in the amount of $113,505.61; payroll demands numbered 9750 through 9978, in the amount of $95,739.04 and transfers in the amount of $316,739'.04 as approved by the Finance Conunittee and that warrants be'drawn on I the Treasury for the same. D. Approved specifications and project locations for slurry seal coating of City streets, College Park East and College Park West and authorized the City 8-27-73 :l1 Manager to obtain bids. I E. Approved time extension of forty-five calendar days to McGuire Construction Company, 'Project 312, Sewer Interceptor Change'Order No. 12. F. Authorized vacation for City Man,ager from regular City Council meeting of September 10, 1973. G. Authorized transfer of $3500 from Contingency Fund to General Fund to perform necessary repairs to City Council Chambers and Administration Building. H. Bids were received and opened by the City Clerk, August 21', 1973 at 2:00 o'clock p;m. for one 4-wheel drive, I-ton Cab and Chassis as follows: Verne Holmes, Inc. Dodge Dealers $ 4835.50 Awarded the bid for one 4-wheel drive, I-ton Cab and Chassis for the Beach Maintenance Division, to Verne Holmes, Inc. in the amount of $4,835.50. I AYES: Dunn, Holden, McKnew, Sales NOES: None ABSENT: Blackman Motion carried 'Items'Rellloved From The Consent Galendar 'ITEM "C" - 'TIME EXTENSION - ANNUAL AUDIT Councilman Dunn noted that since data was not available to comply with the Charter Section naming the August 31 deadline for the annual audit, that a Charter Amendment should be considered moving the deadline up to a later date. It was the order of the Chair that the City Clerk prepare a report outlining the steps required for a Charter Amendment to be included on the primary ballot. Sales moved, second by Dunn to approve the ninety day time extension for the annual audit as recOlJllllended. Bateman made a presentation to the Council explaini:ng ~2 8-27-73 the needs and objectives of the Public Cable Television Authority and requested ,that the Council' authorize" the staff, to negotiate for Seal 'Beach 'participation in their program. Discussion followed with members of the Council directing questions to Mr. Bateman. Mr. McKnew requested that the'staff prepare a report for .the Council regarding Seal Beach participation in the PCTA. REPORT - FIRE 'STATION NO; 1 Ron Adiuns, Fire Chief, presented a report and plans for improvements to Fire Station No. 1 to the CoUncil. Sales moved~ second by Holden to approve the plans and specifications 'for Fire Station No.1 and authorize the City Manager to obtain bids. AYES: Dunn, HOlden, McKnew, Sales NOES: None ABSENT: Blac~an Motion carried REPORT ~ GAS TAX PROJECT PRIORITY LIST Norm Spielman, Acting City Engineer, presented a report regarding gas tax project priority list for this fiscal year. It was the order of the Chair with consent of Council to receive and file the Gas Tax Project Priority List as presented. ORAL 'COMMUNICATIONS Mayor McKnew declared oral communications open. John Smedley, l20~ - 3rd Street, s~ggested that the staff include in their report, the function of UHF Channel 50 as it relates to PCTA. Robert Cook, 441 Central Avenue, suggested that the Council adopt a resolution of commendation for Mr. Barnes' service as Councilman, District One. , McKnew moved, second by Dunn that a resolution be prepared cOllllllending Mr. Barnes for his service as Councilman. Councilman Dunn,stated he would hold a public forum meeting as soon as practicable.
