HomeMy WebLinkAboutCC Min 1973-10-08 t ~ 10-8-73 49 Seal Beach, California October 8, 1973 The City Council of the City of Seal Beach met in regular session at 8:00 o'clock p.m. with Mayor Blackman calling the meeting to I order. At the request of the Mayor, Mrs. Vermille Sickler, President of the Seal Beach Junior Women's Club led the 'Salute to the Flag. ROLL CALL Present: Mayor Blackman Councilmen Dunn, Holden, McKnew, Sales Absent: None Also present: Mr. Courtemarche, City Manager Mr. Winfield, Assistant City Attorney Mr. VanDerj!.yden, Assistant to the City Manager Mr. Neprud, Planning Director Mr. Spielman, Acting City Engineer Mr. Gaudio, Administrative Assistant PROCLAMATIONS Mayor Blackman proclaimed the month of October as "Junior Involvement Month. " Mayor Blackman proclaimed the week of November I through November 7, I 1973 as "National Art Week." APPOINTMENT - SEAL BEACH BUILDING AUTHORITY Councilman McKnew declared his appointment of Samuel James Clark to the Seal Beach Building Authority to fill the unexpired term of Bernard Jeffr"ys, with unanimous consent of the Council. COUNCIL REQUEST Councilman McKnew requested that the City Attorney prepar~ a resolution defining procedures of public hearings before the City Council. It was the order of the Chair with consent of Council that the City Attorney prepare a resolution as requested for consideration of the Coun~il. Councilman McKnew referred to recent news article of Council actions and stated that he had been misquoted as it related to developers. I ORDINANCE NUMBER 916 - SALES and USE TAX Ordinance Number 916 was presented to Council for first reading by title by the City Attorney "AN ORDINANCE AMENDING THE CODE OF THE CITY OF SEAL BEACH, CALIFORNIA, IMPOSING A SALES AND USE TAX TO BE ADMINISTERED BY THE STATE BOARD OF EQUALIZATION AND PROVIDING PENALTIES 10-8-73 50 FOR VIOLATIONS." The City Manager explained that this Ordinance was a procedure amendment as required by the adoption of Senate Bill 90. Sales ,moved, second by Holden to waive further reading of Ordinance Number 916, deem that it has ha4 ~irst reading and be passed to second reaqing. I AYES: Blackman, Dunn, HOlden, McKnew, Sales NOES: None Motioncarried PROPOSED RESOLUTION - AGREEMENT - SALES and USE TAX The proposed resolution author.izing agreement of local sales and use tax was withdrawn at the request of the City Attorney by unanimous consent of the Council. RESOLUTION NUMBER 2255 - APPEAL 'A-2-73 - SURFSIDE COLONY, LTD. - V-22-73 Resolution Number 2255 was presented to Council by title "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH DENYING PLANNING COMMISSION RESOLUTION NO. 764 AND APPROVING APPEAL A-2-73 FILED BY SURFS IDE COLONY, LTD." Sales moved, second by Holden to waive further reading and adopt Reso14tion Number 2255 as presented. I AYES: Blackman, Dunn, Holden, McKnew, Sales NOES: None Motion carried AGENDA AMENDED Dunn moved, second by McKnew to amend the agenda to include a resolution supporting the expansion of the Edison Company's Huntington Beach Power Generating Plant. AYES: Blackman, Dunn, Holden, McKnew, Sales NOES: Motion carried None RESOLUTION NUMBER 2256 - SOUTHERN CALIFORNIA EDISON COMPANY's HUNTINGTON BEACH POWER GENERATING PLANT Resolution Number 2256 was presented to Council and read in full by the City Manager entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, SUPPORTING THE PROPOSED EXPANSION OF THE SOUTHERN CALIFORNIA EDISON COMPANY's HUNTINGTON BEACH POWER ,I GENERATING PLANT." Dunn moved, second by Holden to adopt Resolution Number 2256 as presented; AYES: Blackman, Dunn, Holden, McKnew, Sales NOES: Motion carried None 10-8-73 ...... 51. I.r, CONSENT CALENDAR The City Clerk requested that Item "A" be removed from the Consent Calendar; Councilman'McKnew requested that ~tems "E" and "F" be removed from the Consent Calendar. Holden moved, second by McKnew I to approve the recommended action for items on the Consent Calendar excepting Items ','A", "E" and "F". B. Approved regular demands numbered 15564 through 15666 in the amount of $64,987.77; payroll demands numbered 10199 through 10403 in the amount of $91,591.97; and transfers in the amount of $211,591.97 as approved,by the Finance Conunittee and that warrants be 'drawn on the Treasury for the same. C. Rec~ived and filed notice from the Army Corpos of Engineers re application by Los Angeles County Flood Control District for permit to construct storm drain outlet. I D. Denied claim of Ri~cardo and Genoveva Villa for personal damages and referr,ed same to the city I S insurance carrier. G. Received and filed notice from Local Agency Formation Commission re proposed annexation to Midway City Sanitary District designated Stahov Avenue No. 1 Annexation. H. Rejected all bids received for Fire Station Number 1 Improvements and authorized the City Manager to receive new bids. AYES: Blackman, Dunn, Holden, McKnew, Sales NOES: None Motion carried Items Removed From The Consent Calendar ITEM "A" - COUNCIL MINUTES I ,The City Clerk stated that a correction should be made on ~age two, paragraph six, line five, that the number should be 60 acres instead of 16 acres in reference to the North American property. R. BLEVINS' Councilman McKnew requested'information as to the status of the report that the report had been submitted in a previous newsletter. McKnew I on claims relating to the Police Department. The City Manager stated moved, second by Sales to deny the claim of T. R. Blevins ,for personal damages and refer same'to the'clty's insurance carrier. AYES: '.. 'Blackman;' Dunn;, HO'lden-,r McKn-ew;- Sales NOES: None' Motion carried ITEM "F" - RESOLUTION - CITY OF, ANAHEIM - PROPOSITION NO. 1 Councilman McKnew asked that Item "F" be held over to be considered at the same time as agenda item IX-A, relating to the Proposition One. It was the order of the Chair with consent of Council to hold this item over as requested. COMMUNICATIONS - PROPOSITION ONE - TAX INITIATIVE Janet Enzmann, Vice-President, League of Women Voters, read her conununication to the Council opposing Proposition One. McKnew moved, I second by Dunn to receive and file the Resolution from the City of Anaheim supporting Proposition One. AYES: Blackman, Dunn, Holden, McKnew, Sales NOES: None Motion carried It was ,the consensus of the Council that further study would be advisable before a motion to support or oppose be made. McKnew moved, second by Dunn that Councilman Sales, as the voting delegate to the League of California Cities Conference, be authorized to vote his convictions after further study on Proposition One, the Tax Initiative.' AYES: Blackman, Dunn, Holden, McKnew, Sales NOES: None Motion carried I CHARTER AMENDMENTS It was the order of the Chair with consent of Council that the City Clerk and the City Attorney prepare proposed amendments to the City Charter on the subjects of the annual audit, elections and compensation 1 10-8-73 ~ of the City Council. CITY ENGINEER's REPORT - JACH H. DAVIDSON CORRESPONDENCE Mr. Spielman, City Engineer, reported on the Huntington Marina permit as requested by Mr. Davidson at the last Council meeting. Members I of the Council discussed the matter and noted that Mr. Davidson had not provided copies of the documents as requested. Dunn moved, second by Sales that the City Engineer communicate with the Corps of Engineers, requesting them to notify the respe~tive cities when issuing such- permi:ts in', the future' and with respect to the case at hand, require the property owner to proceed with work under the permit or restore the prope;t~ to its original condition. AYES: Blackman, Dunn, Holden, McKnew, Sales NOES: None Motion carried ORAL COMMUNICATIONS Mayor Blackman declared that this was the time for oral communications. Councilman Sales stated that street repair was scheduled for College I Park West and asked that further notif~cation be given to allay the potential problem of ingress and egress in the area. Mayor Blackman announced that Assemblyman Burke would be holding a hearing in Seal Beach in December on revenue and taxation and that further publicity would be handled by Mr. Burke's office. Gordon Shanks, 215 Surf Place, announced that the Historical Society would be celebrating the 58th birthday of our ~ity, October 20th and invited the Councilmen and city officials to attend. Mrs. Dorr, 231 - 6th Street, stated that there would be "red car T-shirts" for sale and rides on the Red Car for the public. John Harper, 1305 Sandpiper, spoke in support of Proposition One. There were no further oral communications from the audience; Mayor Blackman declared oral communications closed.
