Bahorski, City Manager FROM: Mac Cummins, Associate Planner /Special Projects Manager SUBJECT: FIRST• READING OF ORDINANCE NO. — SPECIAL EVENTS PERMITS SUMMARY OF REQUEST: Introduce First Reading of Ordinance No., An Ordinance of the City of Seal Beach Amending Section 19E of the Code of the City of Seal Beach regarding the Processing of Special Events Permits. BACKGROUND: On August 12, 2002, the City Council considered the Special Event Permit process and the types of events which are considered special events. The Council's direction that 'evening, was to leave the Policy Statement unchanged, and change the ordinance to do the following: 1. Reduce the processing time from 60 days to 30 days 2. Revise the approval body from the City Manager to the Director of Development Services 3. Change the appeal procedure to the C'ty Manager, rather than an appeal procedure to the City Council Staff has prepared the ordinance to address those three changes. The Council further directed staff to enforce the provisions of the ordinance through the Police Department, particularly in cases where an applicant does not have a permit and has told the staff that they "are just going to `do it' anyway." Staff has discussed this matter internally, and the Police Department will close the events down and if necessary issue citations, if the • responsible party does not have the appropriate permit. • However, in the interim month, staff has received an application to close down Electric Avenue for a special event. Street closures of this type have traditionally come before the City Council for authorization. As staff understands the direction from the City Council, these types of applications would still be handled at the staff level, with notification and Agenda Item /� • Adoption of Ordinance No. — Special Events Permits Sec. 19E City Council Staff Report August 13, 2001 input from/to the Council through the City Manager. If this is the direction of the Council, no further direction is needed. However, if the Council wishes to see applications of this type come directly before the Council, staff would recommend that an additional section of the ordinance be added that applications which involve street closures be submitted and immediately come before the City Council for decision. This section could be added before the 2 reading of the Ordinance. FISCAL IMPACT: None.
