BACKGROUND: City staff is exploring a potential acquisition of a 100 -acre property within the City known as the Hellman Lowlands. This property has been deed - restricted by the California Coastal Commission for a future wetland restoration project as a condition of approval for a residential development occurring immediately adjacent to the deed - restricted site. In considering this matter, an independent, third -party review of several environmental site investigation reports prepared by Geomatrix Consultants for Hellman Properties LLC regarding site contamination and remediation issues on the subject and adjoining properties. Staff has requested letter proposals for conducting the requested independent, third -party review of the subject documents, including a not to exceed amount for conducting the review and a timeline for completion of the review and preparation of an opinion letter to the City regarding the accurateness of the information and assumptions presented. Copies of these documents are available at the Department of Development Services for review. They have not been provided with the Staff Report due to their length. In preparing the proposal, the following items were to be included: ❑ scope of work ❑ time schedule ❑ fees (lump -sum, not to exceed amount) ❑ capabilities to perform requested services ❑ proposed sub - consultants and capabilities. Proposals were received from the following firms: ❑ Converse Consultants (See Attachment 1) ❑ Levine -Fricke (See Attachment 2) ❑ Tait Environmental Management, Inc. (See Attachment 3) In reviewing the letter proposals, all three firms appear to be well qualified to undertake the requested independent, third party review. The costs of conducting the analysis and the timeframes for completion of the requested analysis are reasonable. Based on a review of the letter proposals, staff would recommend approval of Tait Environmental Management, Inc. to conduct the requested independent third party review. This is primarily due to the familiarity of Tait with the surrounding area, having conducted similar site environmental reviews for the Boeing Seal Beach campus facilities. FISCAL IMPACT: Minor, approval of the letter request will require approval of a budget amendment to re- allocate $5,000 in funds from undesignated General Fund Balance. Currently he estimated fiscal year end undesignated fund balance is $4, 824,793. Approval of this budget amendment will decrease the estimated ending undesignated fund balance by $5,000, to $4, 819,793. That action will be accomplished by the approval of Resolution No. , A Resolution of the City Council of the City of Seal Beach Authorizing Budget Amendment No. 03 -03, Allocating Funds for the Third Party Review of Environmental Site Investigation Reports, Hellman Ranch (Please See Attachment 5 for the proposed resolution). Our services will be billed on a lump sum basis. If additional services are needed beyond the scope of work it will be billed on a time and material basis in accordance with our Schedule of Fees (EP2002), but not without prior written approval. Our services will be completed for the sole benefit and exclusive use of the City of Seal Beach in accordance with the General Conditions under which these services were provided. Based upon the scope of work described above, our lump sum fee will be $3840.00. This estimate will be valid for a period of 60 days from the above date. Written authorization to proceed will be required to initiate work. He has managed numerous contracts for state, local government, and private client involving multiple concurrent programs. His program management experience represents oversight of more than 50 individual projects with as many as 25 being executed simultaneously. He has been responsible for overall quality assurance, staff and resource management, project negotiations, and client satisfaction. His expertise is focused on programs designed to identify and evaluate contaminated property for real estate transactions, characterize and delineate on site contamination and initiate remedial actions in preparation for property development. Mr. White has been responsible for the successful completion of over 150 Phase I Assessments and over 30 Phase II Assessments and remediation projects leading to regulatory closure. Mr. White is a hands -on results oriented manager with extensive field experience which includes the use of: Geoprobe and hollow -stem auger drilling equipment; soil gas sampling, CPT equipment; geophysical surveys; groundwater monitoring well installation and sampling; drum and pond sampling; underground storage tank removals; soil and groundwater remediation system layout, installation and operation; and risk -based corrective actions. REPRESENTATIVE PROJECTS PHASE I & II SITE ASSESSMENTS Responsible for conducting and managing the completion of over 30 Phase I Site Assessments and asbestos and lead based paint surveys for Borders Books during their initial effort to develop the Southern California market. These activities included managing asbestos and lead based paint abatement of a former bank (a 63,000 square foot three story building), two former supermarkets and a former bowling alley. Developed site selection criteria for the Orange County Fire Authority (OCFA) to use for evaluating potentially contaminated sites under consideration for acquisition and development as future fire stations. Conducted Phase I and Phase II assessments of the prospective properties and implemented the criteria in the decision making process based Stanley G White , R.G Page 2 on the assessment results and the needs of the OCFA. Conducted a Phase I Site Assessment and provided oversight representing Eagle Hardware (currently Lowes) and a major southern California developer who was purchasing a property formerly occupied by a zinc smelting plant. Closure activities at the facility included the excavation and disposal of approximately 63,000 tons of hazardous waste ash, removal of 27 UST's abandonment of 11 groundwater monitoring wells and 3 dry wells, and locating a former oil production well on the property. Mr. White was responsible for reviewing and evaluating all environmental activities at the site, recommending additional corrective action, implementing field activities as needed, and participating in negotiations between the buyer, seller, their respective attorneys, real estate brokers and the local city building department and redevelopment agency. He identified the potential for the developer to become a hazardous waste generator during construction and an old oil well beneath the proposed footing area. Due to these findings, the transaction was restructured, an environmental insurance policy was obtained, and the property owner set aside $500,000 for the resolution of future environmental issues. Managed the preparation of Phase I Assessment reports for four (4) proposed school sites for the Los Angeles Unified School District. Preliminary Endangerment Assessments (PEA) was completed for two (2) of these sites with regulatory oversight provided by the California State Department of Toxic Substance Control (DTSC). SITE CHARACTERIZATION AND REMEDIATION Conducting activities for assessing, characterizing, remediating, and closing a former town gas site in southern California. The primary contaminant, polynuclear aromatic hydrocarbons, was contained in a 3 to 5 foot thick layer of ash distributed across the site. Areas of soil affected by bunker oil and a sump containing sludge contaminated with cyanide and arsenic were also identified during site assessment and characterization activities. The bunker oil- affected soil and the sump contents were excavated and transported to an offsite facility for disposal. A risk assessment was completed to demonstrate that under the existing site conditions, and the proposed future use of this site, the ash layer did not represent a substantial health risk. Managed site assessment and characterization of hydrocarbon- affected soil and groundwater at numerous service stations throughout southern California and the Midwestern United States. Conducted soil and groundwater sampling, installed groundwater monitoring and vapor extraction wells, installing and operating soil and groundwater remediation systems, reviewed the results and interfaced with major oil company representatives and regulatory agency personnel. Mr. White was also responsible for supervising numerous tank pulls and station dispenser island rebuilding projects and closing over a dozen of these service station sites. Stanley G. White , R.G. Page 3 SUPER FUND Mr. White represented an electric motor production company identified as a potential responsible party (PRP) in the San Gabriel Valley Super Fund Area. Solvents leaking from a parts degreaser contaminated the soil and groundwater implicating company as a PRP. Soil and groundwater assessment and monitoring activities were conducted and vapor extraction was selected for the soil remediation. The results of these activities were presented to the RWQWCB in compliance with their requirements and to a Super Fund Advisory Committee in an effort to reduce the companies over all financial participation in the regional Super Fund cleanup. The final results of these activities are currently pending. SPECIAL PROJECTS Onsite Project Manager for the RCA closure of five wastewater - settling ponds at the former San Diego Gas and Electric Company's electrical generating plant in Carlsbad, California. Mr. White was responsible for preparing and implementing all of the onsite operations. These activities included: preparing budgets, writing work plans, sample analysis and health and safety plans, negotiating cleanup levels, permitting, contracting and managing subcontractors, conducting client and regulatory agency update meetings, daily safety meetings for all onsite personnel. The onsite activities also included collecting over 400 samples to be analyzed for 15 different analytes each, removing the pond liners and leachate collection system, excavating, segregating and disposing of the affected soil, and grading the site for construction of a new parking lot and building. He also interpreted the analytical results and wrote the final closure report for submittal to the RWQCB. Upon reviewing the report a "no further action letter" was issued by the RWQCB. Provided project oversight and represented an industrial property owner whose tenant was closing a chrome /copper /nickel plating and powder coating facility after 35 years of operation on the site. As environmental project manager and part of a litigation team, Mr. White identified critical environmental issues affecting the properties value and the owner's long and short-term liabilities. He participated in strategic planning and negotiation sessions with the client, tenant, the attorneys, and regulatory agencies. Mr. White was responsible for providing environmental over sight for the facility closure, demolition and renovation. These activities included reviewing and evaluating the existing site conditions and all proposed work, negotiating needed changes to the proposed scopes of work, observing and monitoring all work conducted at the site, evaluating analytical data, reviewing assessment and remedial reports, and recommending additional actions as needed. As a result of these efforts, long -term litigation was avoided by the successful settlement on behalf of the client (property owner). Environmental Project Manager for team bidding of construction projects with major construction and development firms. These projects included: a highway bridge retrofitting project (with an estimated total budget of 23 million dollars); designing, constructing and operating an excavation dewatering system for a highway expansion project; the excavation and disposal of approximately 100,000 tons of DDT and hydrocarbon contaminated soil during the construction and renovation of a waste water treatment facility; and designing and installing a methane gas recovery system beneath a building to be constructed in a former oil production field. In this report a recommendation was made for further investigation of four areas. • The second report, dated August 31, 2001, detailed the results of drilling, trenching and analytical testing of the four areas that were recommend for investigation previously. This report concludes with remedial recommendations for the four areas. • The third report, dated September 5, 2001, reports on a review of aerial photos and other historical documents for the site, as well as a reconnaissance level visit to the site. This report focuses on the land to be retained for oil production. Objective TEM understands that the City wishes to have the three reports reviewed by a third party for the contained information's accuracy, and to review the assumptions used in the reports. The City is primarily interested in the adequacy of the analytical tests performed covering the hazardous and petroleum contaminants of concern. Scope of Work The following scope of work is proposed, pending further discussions and /or clarification by the City. Task I Meet with City Council on September 23, 2002 for award. It is anticipated that, prior to actual start of the review, discussions will be held with the City's project manger to further focus on the City's requirements. Task II Commence review of the three Geomatrix reports. Assess their adequacy to characterize the area to be transferred to the City. Special attention will be paid to the adequacy of the geographic coverage of the sampling, the types of sampling conducted, the sample collection methods used, and the types of chemical analyses conducted on the samples. The chemical analysis methods used will be evaluated against the known and /or probable contaminants that may be present. The remediation recommendations made by Geomatrix will be evaluated considering the future use of the site as wetlands. Task 111 Prepare an opinion letter regarding the reviewed documents. Task IV Management and administration. This task includes liaison with the City and the need for overall project management.
