SUBJECT: Amendment to Cooperation Agreement with County of Orange for FY
2003 -2005 participation in CDBG program
SUMMARY OF REQUEST:
Request authorization from the City Council to allow the City Manager to sign
amended agreement for participation in Community Development Block Grant
funding program. The City entered into the Cooperation Agreement with the County
on June 25, 2002.
BACKGROUND:
As a non - entitlement city (population less than 50,000), the City of Seal Beach
receives CDBG funding through a contractual agreement with the County of Orange.
The County's Housing and Community Development Department (H /CD) applies to
HUD for CDBG funding, then divides the funding among its subrecipients: the non -
entitlement cities; unincorporated areas; and, non -profit organizations eligible for
funding.
The formal agreement for this process is through the Cooperation Agreement
described above. HUD sent notice that some of the language which was previously
approved by the agency and subsequently approved by the County and the City must
be changed.
A summary of the changes is as follows:
1. Contract with HUD will be automatically extended unless City or County
provides in writing its desire to withdraw from the program. .
2. City may not apply for grants under small cities or state CDBG programs for
fiscal years in which it participates in County's CDBG program.
3. County and City may not terminate or withdraw from the Cooperation
Agreement while it remains in effect until the CDBG and Home funds during
that three year period are expended.

Staff has no objection with any of the proposed changes.
FISCAL IMPACT:
None. If the City receives grant funding in the future, the only cost to the City would
be Staff time in administering the projects and grant funds.
RECOMMENDATION:
Authorization from the City Council to allow the City Manager to sign amended
agreement for participation in Community Development Block Grant funding
program.
