In June of 2001 Resolution Number 4911 was adopted establishing the fines for parking violations, it has been discovered that at that time one violation and fine was inadvertently left out of the Resolution. The proposed Resolution simply readopts the existing fines as established by Resolution Number 4911 and adds the violation for parking in a Passenger Loading Zone as set forth in Municipal Code Section 13 -100 for the period of time established by Section 13 -98, attached hereto, and establishes the fine for violation at $35.00. The proposed Resolution has a sense of urgency in that school will soon be open and it has been determined that one area where this violation is occurring regularly is on Bolsa Avenue in front of McGaugh School where it is designated as a Passenger Loading Zone to accommodate persons dropping off and picking up children from school yet recently the Police Department has encountered an excess number of unoccupied vehicles parked in this designated area. Recommended Action: Adopt the proposed Resolution entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH ESTABLISHING FINES ING TO PARKING VIOLATIONS." No person shall stop, stand or park a vehicle in any passenger loading zone for any purpose other than the loading or unloading of passengers for such time as is specified in Section 13 -98 of this Code. (Ord. No. 575) Section 13 -98. Permission to Load or Unload; Restrictions. (a) Permission herein granted to stop or stand a vehicle for purposes of loading or unloading of materials shall apply only to commercial vehicles and shall not extend beyond the time necessary therefor, and in no event for more than twenty (20) minutes. (b) The loading or unloading of materials shall apply only to commercial deliveries, also the delivery or pickup of express and parcel post packages and United States mail. (c) Permission herein granted to stop or park for purposes of loading or unloading passengers shall include the loading or unloading of personal baggage but shall not extend beyond the time necessary therefor and in no event for more than three minutes. (d) Within the total time limits above specified the provisions of this section shall be enforced so as to accommodate necessary reasonable loading but without permitting abuse of the privileges hereby granted.
