AYES: Blackman, Holden, Kenyon, McKnew NOES: Sales Motion carried I ORDINANCE NUMBER 942 - WATER RATES Ordinance Number 942 was presented to Council for first reading by title "AN ORDINANCE OF THE CITY OF SEAL BEACH AMENDING CHAPTER 26, WATER AND DRAINAGE, OF THE CITY CODE RELATING TO RATES FOR WATER SERVICE." Mr. Halldin, City Engineer, reported that the increase in water service rates would fund the addition of water facilities and improvements to existing facilities. Councilman Holden objected to the same water service charge for all areas of the city. It was further noted that the actual charge for water service would be set by resolution. Discussion followed. Mr. Little, Assistant to the City Manager, presented the staff report and stated that there were corrections in the text of the ordinance and so noted. Councilman Kenyon, questioned putting the street address on the trash containers and what action the city could take to enforce the ordinance. Mr. Little responded that students available tmder the Work-Study Program from Long Beach State University would be investigating violations of the ordinance, and that the Orange COtmty Health Department would be assisting the city in this matter. Councilman Kenyon requested that the staff inf~rm the citizens of the garbage and rubbish laws and the penalties for violation of same. Mayor McKnew stated that they were public notices from the Army Corps of Engineers for permits for construction. Blackman moved, second by Holden, to receive and file Public Notices Nos. 74-191, 194, 198, 199, 200 and 201, regarding applications for permits for I construction AYES: NOES: Blackman, Holden, Kenyon, McKnew, Sales None Motion carried ITEM "F" - SLURRY SEAL COATING OF STREETS Mr. Halldin, City Engineer, stated that due to the low bid price of 1.3~ for slurry seal coating of streets in the College Park East area, it would be possible to seal coat all of the remaining streets in the area and also to include the cuI de sacs. Mr. Halldin recommended that the City Council authorize a change order for Project Number 418 and increase the size of the project from $13,584.73 to $22,191.06, utilizing budgeted gas tax funds, to not been seal coated. Holden moved, second by,McKnew to approve I include all the streets in the College Park East area that have the 'change order as recommended by the City Engineer. Holden moved, second by Blackman, to receive and file Senate Concurrent Resolution No. 91 regardi~g native American Indians. AYES: Blackman,' HOlden, Kenyon, McKnew, Sales NOES: None Motion carried REQUEST - ORANGE COUNTY FAIR HOUSING COUNCIL Mildred Miller, Executive Director and Beverly Higley, coordinator, for the Orange County Fair Housing Council, addressed the Council explaining the services provided by the OCFHC and requested financial support for their organization. Discussion followed. Councilman Sales stated that he was in favor of the organization, however, felt that the financial support should be provided by private organizations and not city funds. Mayor McKnew requested that the Orange County Fair Housing Council provide a report designating disposition of services provided to landlords and/or tenants so the Council could evaluate future funding from this City. Kenyon moved, second by Holden, to approve the requested $787.78 for funding of the Orange County Fair Housing Council. (SOSNOWSKI, V-13-74) Mr. Neprud, Planning Director, presented the staff report and recommendations of the Planning Commission. Blackman moved, second by Sales to uphold the Planning Commission recommendations to deny I I 9-23-74 2~6 the appeal and conditionally approve the variance request. AYES: Bla'ckman, HOlden, Kenyon, McKnew, Sales NOES: None Motion carried FENCE IMPROVEMENT - COLLEGE PARK WEST Mr. Halldin, City Engineer, reported on ,the condition of the fence at the entil'ance ,to..College Park West- .and, .reported that he had I received numerous requests from residents of the area, for repair of the fence. Mr. Halldin stated that the approximate cost of the fence repair was $2,500 and requested that the balance of funds budgeted for the purchase of a lawn vacuum be reallocated for the replacement of the fence at College Park Drive. Sales moved, second by Blackman, to approve the replacement of the fence at College Park Drive and reallocate budgeted funds for same as recommended by the City Engineer. AYES: Blackman, Holden, Kenyon, McKnew, Sales NOES: None Motion carried COUNCIL REPORTS and REQUESTS Councilman Blackman reported on excessive speeding on Balboa I Drive and requested that the City Manager issue some'type of public communication encouraging slower traffic. Mayor McKnew stated that he would be attending the Bicentennial Committee meeting, September 26 at 7:30 p.m. for Councilman Blackman who is serving as Chairman of that Committee and noted that suggestions for community projects for the Bicentennial year would be welcomed. Mayor McKnew also noted that. there would be a court hearing on the Airport Land Use Commission/Bixby Ranch Company case, October 4. ORAL COMMUNICATIONS Mayor McKnew declared 'oral 'communications open from the audience. Ira Cohen, 1125 Fathom, spoke regarding the garbage and trash I problem in the City. Sherry Baum, 815 Catalina Avenue, quoted from a newspaper article regarding Councilman Blackman's position opposing the EPA regulations through the League of Cities and asked if that was a personal opinion or a policy of the Council. 9-23-74 2,r::;.(' I Mayor McKnew stated that previous Council action had been taken on this matter opposing the parking regulations of the EPA. Patricia Campbell, College Park East, requested clarification of the Council actions regarding the Bixby property as it related to the'Airport Land Use Commission action. Mayor McKnew stated that a legal opinion would,.be' forthcOming ,after, a determination of the court in the matter being heard October 4 relating to that property. Mrs. Fran Leyey, College Park East, stated that the Los Alamitos airfield had stated that the flight patterns would change as a result of the Bixby project to flights over Rossmoor and Leisure World areas and quoted her authority for her statement as ~r. Perrin of the Naval Air Station. Mayor McKnew directed the staff to send a letter to the Naval Air station to clarify their position as to flight patterns. Erick VanAbkoude, 3550 Heather Circle, requested Council consideration of having Council agendas available one day earlier. Mr. VanAbkoude opposed the Bixby Ranch Company condominium project and the increased traffic noise from the freeway in the College Park East area. Mayor McKnew responded that there was a possibility that the freeway would once more be widened and if this occurred a sound barrier could be built by the State Division of Highways. Jay Covington, 4557 Candleberry Avenue, asked if the Council had copies of the Airport Land Use Commission minutes, and asked if the Building Department had been advised to cease action regarding the Bixby property. 'Mayor McKnew advised that the Council did have the Airport Land Use Commission minutes and that plans had been submitted to the Building Department for processing but that no building permits would be issued until the determination of the Court had been heard. There were no other oral communications; Mayor McKnew declared oral communications closed.
