The City Council of the City of Seal Beach met in regular
session at 8:00 p.m. with Mayor Holden presiding. The
meeting was called to order with the Salute to the Flag.

APPROVAL OF MINUTES
Sales moved, second by Smith to approve the minutes of
June 21, 1971 regular meeting as presented.

COUNCIL REORGANIZATION
I
Mayor Holden stated that pursuant to Resolution, this was
the time for reorganization of the Council. Sales moved
second by Smith, to continue the present organization of
the Council as it now stands.

ORDINANCE NUMBER 846 - ROSSMOOR WALL
Ordinance Number 846 was presented for second reading by
title "AN ORDINANCE OF THE CITY OF SEAL BEACH, CALIFORNIA,
AMENDING SEAL BEACH ORDINANCE NUMBER 707 TO PERMIT A SIX
YEAR EXTENSION OF TIME." Sales moved, second by Smith, to
waive the second reading of Ordinance Number 846.

ORDINANCE NUMBER 847 - ZONING - ALLEY & STREET INTERSECTIONS
Ordinance Number 847 was presented for second reading by
title "AN ORDINANCE OF THE CITY OF SEAL BEACH, CALIFORNIA,
REGULATING THE LOCATION OF FENCES, WALLS, AND SHRUBS AT THE
INTERSECTION OF ALLEYS WITH STREETS AND ALLEYS WITH ALLEYS
IN CITY OF SEAL BEACH, AND AMENDING THE CODE OF THE CITY
OF SEAL BEACH, CALIFORNIA." Sales moved, second by Holden
to waive the second reading of Ordinance Number 847.

ORDINANCE NUMBER 848 - RESOLVING LAW REVISION COMMISSION
Ordinance Number 848 was presented to Council for second
reading and read in full by the City Attorney entitled
"AN ORDINANCE OF. THE CITY OF SEAL BEACH, CALIFORNIA,
DELETING CHAPTER 10 A, ENTITLED "LAW REVISION COMMISSION,"
FROM THE CODE OF THE CITY OF SEAL BEACH, CALIFORNIA,
THEREBY AMENDING THE CODE, AND REPEALING ORDINANCE NO.
818 IN ITS ENTIRETY." Holden moved, second by Sales to
adopt. Discussion followed: .

ORDINANCE NUMBER 849 - CASH BASIS WORKING CAPITAL FUND
Ordinance Number 849 was presented for second reading by
title "AN ORDINANCE OF THE CITY OF SEAL BEACH, CALIFORNIA,
AMENDING SECTION 1 OF ORDINANCE NO. 829, INCREASING THE
CASH BASIS WORKING CAPITAL FUND." Sales moved, second by
Holden to waive the second reading of Ordinance Number
849.

Ordinance Number 850 was presented to Council for second
reading and read in full entitled "AN ORDINANCE OF THE CITY
OF SEAL BEACH, CALIFORNIA, CREATING THE OFFICE OF DEPUTY CITY
TREASURER AND ESTABLISHING THE POWERS AND DUTIES THEREOF."
Sales moved, second by Smith to adopt Ordinance Number 860
as read. Discussion followed with members of the audience
speaking on the matter.

ORDINANCE NUMBER 851 - APPOINTING DEPUTY CITY TREASURER
Ordinance Number 851 was presented to Council for second
reading and read in full entitled "AN ORDINANCE OF THE CITY
OF SEAL BEACH, CALIFORNIA, ESTABLISHING THE COMPENSATION OF
THE DEPUTY CITY TREASURER AT $100.00 PER MONTH AND APPOINTING
JERDYS WEIR AS DEPUTY CITY TREASURER." Holden moved, second
by Sales to adopt Ordinance Number 851 as read. Discussion
followed with members of the audience taking part.

COUNCIL APPOINTMENTS
Mayor Holden appointed Lester L. Marshall as the City's
Consumer Representative to the Orange County Health Planning
Council, with consent of Counc~.
Baum moved, second by Sales to publish notice of vacancies
on Boards and Commissions, appointments to be made at the
next regular meeting.

The Council directed the City Manager to prepare a Resolution
for consideration of Council designating that representation

from each Councilmanic District be considered in appointments
to Boards and Commissions. ,.
Councilman Smith's motion to reappoint Mrs. Lanning to the
Planning Commission was held over to next meeting.
RESOLUTION NUMBER 2007 - AGREEMENT - SANITATION DISTRICT
NUMBER FOUR

Resolution Number 2007 was presented to Council entitled "A
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH,
CALIFORNIA, ENTERING INTO AN AGREEMENT WITH SANITATION
DISTRICT NUMBER FOUR OF ORANGE COUNTY." Holden moved,
second by Sales, to adopt Resolution Number 2007.

RESOLUTION NUMBER 2008 - V-9-71

Resolution Number 2008 was presented to Council entitled "A
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH
DENYING THE APPEAL (A-3-71) OF J. R. BRAITSCH/HOWARD SMITH
FROM PLANNING COMMISSION DENIAL OF VARIANCE (V-9-71) TO
PERMIT THE CONSTRUCTION OF APARTMENT UNITS WITH LESS THAN
THE REQUIRED NUMBER OF ON-SITE PARKING SPACES AND UTILIZING
AN EXISTING FRONT CURB CUT." Sales moved, second by H09ard
to adopt Resolution Number 2008.

COMPLAINT - AD VALOREM TAXES

Holden moved, second by Sales that the complaint for recovery
of Ad Valorem Taxes paid under protest; and for declaratory
relief - Atlantic Richfield Company, Humble Oil Company,
Orco Oil Company, the Signal Companies, the Termo Company,
Texaco, Inc., West Shore Petroleum Company, be referred to
the Orange County Counsel as recommended by the City Attorney.

AGREEMENT - SOIL TESTS

Smith moved, second by Holden to authorize the City Manager
to execute the agreement between the City and the County of

CALIFORNIA, A CHARTER CITY, NAMING THE ELECTION OFFICERS
AND POLLING PLACES FOR THE SPECIAL MUNICIPAL ELECTION IN
COUNCILMANIC DISTRICT ONE." Sales moved, second by Hogard
to adopt Resolution Number 2009.

Smith moved, second by Holden to award the bid to Ruggles
Construction Company for the unit price as bid in the
amount of $24,675.20, reject all other bids and authorize
the City Manager to execute the contract.

Sales moved, second by Holden, to award the bid for Project
#331, First Street Traffic Signal to William R. Hahn in the
amount of $38,277.00 as the lowest qualified bidder for the
unit price bid, reject all other bids and authorize the City
Manager to execute the contract. The City Manager noted that
50% of the cost will be shared by the County under the A.H.F.P.
Program.

COMMUNICATION - COSTA MESA TAX STATEMENT
Hogard moved, second by Baum that a Resolution be prepared
supporting the City of Costa Mesa in their action requesting
the Board of Supervisors of Orange County to rescind their
action allowing the County Tax Collector to "simplify" the
tax statements.

COMMUNICATION - STANDARD OIL COMPANY
I
Communication from the Standard Oil Company regarding oil
drilling off-shore of Seal Beach was read by the City Manager
to the Council. Discussion followed. Councilman Baum submitted
for the record a news paper editorial from the Los Angeles Times,
June 30, 1971: entitled "Bad Trend in Off-Shore Drilling". It
was the order of the Chair with consent of Council to receive
and file the communication from Standard Oil Company.
ORAL COMMUNICATIONS
The Mayor stated that this was the time for oral communications.
Tom Brady, 1607 Electric Avenue, informed the Council of a
hearing before the Los Angeles Planning Department regarding
oil drilling. The Council directed the City Manager to attend
the hearing.
There were no other oral communications. Oral communications
were closed.
