The meeting was called to order with the Salute to the Flag. ROLL CALk Present: Mayor Holden Councilmen Blackman, Hogard, Sales, Smith Absent: None Also present: Deputy City Attorney, Fritz Keeler City Manager, Bob Myers City Engineer, Bill Murphy APPROVAL OF MINUTES Hogard moved, second by Blackman to approve the minutes of July 19, 1971 as presented, and the minutes of July 27, 1971 as corrected with a sub-total being added denoting votes for candidates. I AYES: NOES: Blackman, Hogard, Holden, Sales, Smith None 'Motion carried APPROVAL OF DEMANDS Regular demands numbered 308 through 340 in the amount of $52,848.59 and payroll demands numbered 313 through 523 in the amount of $72,532.92 were presented as approved by ,~:tgl the Finance Committee. Smith moved, second by Sales that the demands be allowed and warrants be drawn on the Treasury for the same. AYES: Blackman, Hogard, Holden, Sales, Smith NOES: None Motion carried PRESENTATION Mayor Holden presented a plaque of the Seal Beach emblem to Miss Hildegard John, who is visiting Seal Beach from Darmstadt, Germany, through an educational program for teachers. Her Seal Beach hosts are Mr. and Mrs. Reno Lorenz and Mr. and Mrs. Mike Knapp. PROCLAMATION Mayor Holden proclaimed the week of September 6, "Kiwanis Kids' Week". I ORDINANCE NUMBER 853 - PUBLIC AND CLUB DANCES Ordinance Number 853 was presented for second reading by title "AN ORDINANCE OF THE CITY OF SEAL BEACH, CALIFORNIA, REGULATING PUBLIC AND CLUB DANCES HELD WITHIN THE CITY AND AMENDING THE CODE OF THE CITY OF SEAL BEACH BY THE ADDITION THERETO OF CHAPTER 19A ENTITLED "PUBLIC AND CLUB DANCES." Sales moved, second by Smith to waive further reading of Ordinance Number 853. AYES: Blackman, Holden, Sales, Smith NOES: Hogard Motion carried Unanimous vote of the Council is required to waive complete reading. The City Manager read Ordinance Number 853 in full. Sales moved, second by Smith to adopt Ordinance Number 853 as read. AYES: Blackman, Holden, Sales, Smith NOES: Hogard Motion carried ORDINANCE NUMBER 854 - REPEALS ORDINANCE NUMBER 825 Ordinance(Number 854 was presented to Council for second reading by title "AN ORDINANCE OF THE CITY OF SEAL BEACH, CALIFORNIA, REPEALING ORDINANCE NUMBER 825, "AN ORDINANCE ENACTING REQUIREMENTS FOR A LICENSE TO OPERATE A PUBLIC I I DANCE HALL." Smith moved, second by Sales to waive further reading of Ordinance Number 854. AYES: Blackman, Holden, Sales, Smith NOES: Motion carried Hogard I As there was not unanimous vote, Ordinance Number 854 was read in full. Smith moved, second by Blackman to adopt Ordinance Number 854 as read. AYES: Blackman, Holden, Sales, Smith NOES: Motion carried Hogard ORDINANCE NUMBER 855 - BUILDING PERMIT FEES Ordinance Number 855 was presented for second reading by title "AN ORDINANCE OF THE CITY OF SEAL BEACH, CALIFORNIA, A CHARTER CITY, AMENDING SECTION 5-7.9 OF CHAPTER 5 OF THE SEAL BEACH CITY CODE RELATING TO BUILDING PERMIT FEES." Hogard moved, second by Sales to waive further reading of Ordinance Number 855, deem that it has had second reading and be passed for adoption. I AYES: NOES: Blackman, Hogard, Holden, Sales, Smith None Motion carried RESOLUTION NUMBER 2017 - EXTENSION OF FREEWAY 605 Resolution Number 2017 was presented to Council entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, REQUESTING THAT THE STATE HIGHWAY COMMISSION DIRECT THAT THE HEARINGS BE REOPENED ON THE PROPOSED EXTENSION OF FREEWAY 605." Smi th moved, second by Hogard to adopt Resolution Number 2017. Discussion followed. AYES: Blackman, Hogard, Holden, Sales, Smith NOES: Motion carried None RESOLUTION NUMBER 2018 - SAND REPLENISHMENT REIMBURSEMENT I Resolution Number 2018 was presented to Council entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, REQUESTING FEDERAL FINANCIAL ASSISTANCE FOR BEACH EROSION CONTROL AND SAND REPLENISHMENT, AND RESPECTFULLY REQUESTING THAT CONGRESSMANiCRAIG HOSMER INTRODUCE FEDERAL LEGISLATION WHICH WOULD REIMBURSE THE 8-9-.71.. 9 ? ,. ;'2b7l CITY OF SEAL BEACH FOR EXTRAORDINARY COSTS OF SAND REPLENISHMENT IN 1970." At the Mayor's request the Board of Supervisors, the Corps. of Engineers and representatives of the City had met to discuss reimbursement to the City for the cost of sand replenishment in 1970 and it was noted that both parties concurred with the City in this request. Sales moved, second by Hogard to adopt Resolution Number I 2018. AYES: Blackman, Hogard, Holden, Sales, Smith NOES: None Motion carried RESOLUTION NUMBER 2019 - RECOGNIZING THE ORANGE COUNTY CRIMINAL JUSTICE COUNCIL Resolution Number 2019 was presented by title "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, A CHARTER CITY, RECOGNIZING THE ORANGE COUNTY CRIMINAL JUSTICE COUNCIL AS THE REGIONAL CRIMINAL JUSTICE PLANNING BOARD." Hogard moved, second by Blackman to adopt Resolution Number 2019. None Motion carried I AYES: NOES: Blackman, Hogard, Holden, Sales, Smith RESOLUTION NUMBER 2020 - WEED ABATEMENT Resolution Number 2020 was presented to Council entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH CREATING A LIEN UPON CERTAIN PROPERTIES FOR THE COST OF WEED ABATEMENT." Discussion followed. Sales moved, second by Holden to adopt Resolution Number 2020. AYES: Blackman, Hogard, Holden, Sales, Smith NOES: None Motion carried RESOLUTION NUMBER 2021 - CANVASS OF SPECIAL ELECTION Resolution Number 2021 was presented to Council entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, A CHARTER CITY, ORDERING THE CANVASS OF THE SPECIAL MUNICIPAL ELECTION TO BE HELD IN COUNCILMANIC DISTRICT ONE ON THE 24th DAY OF AUGUST, 1971, TO BE MADE BY THE CITY CLERK OF THE CITY OF SEAL BEACH." Hogard moved, second by Smith to adopt Resolution Number 2021. I 8-9-1~ '~1 AYES: Blackman, Hogard, Holden, Sales, Smith NOES: None Motion carried PUBLIC HEARING SET - PLAN REVIEW PROCEDURE I Sales moved, second by Smith to set the public hearing to consider amending the Plan Review procedure, for 8:00 p.m., August 23, 1971 in Council Chambers AYES: Blackman, Hogard, Holden, Sales, Smith NOES: None Motion carried RESOLUTION NUMBER 2022 - MAYORAL APPOINTMENTS 1 Resolution Number 2022 was presented to Council entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, RESCINDING RESOLUTION NO. 1990, AND GIVING OFFICIAL NOTICE OF APPOINTMENTS BY THE MAYOR OF REPRESENTATIVES TO VARIOUS AGENCIES AND ORGANIZATIONS, AND FOR CERTAIN DUTIES." The Mayor stated that his appointments to the Finance Committee and the alternate representative to S.C.A.G. would be Mr. Blackman with Council consent and the remaining appointments to remain the same as Resolution Number 1990. Holden moved, second by Hogard to adopt Resolution Number 2022 as stated above. AYES: Blackman, Hogard, Holden, Sales, Smith NOES: None Motion carried APPOINTMENTS TO BOARDS AND COMMISSIONS It was the order of the Chair with unanimous consent of Council to postpone appointments to Boards and Commissions to next meeting. DELEGATE - LEAGUE OF CALIFORNIA CITIES CONFERENCE Sales moved, second by Hogard that Mayor Holden be our voting delegate to the League of California Cities Conference and Mayor ProTem Sales to be the alternate delegate. I AYES: NOES: Blackman, Hogard, Holden, Sales, Smith None Motion carried MUNICIPAL PIER SIGN It was the order of the Chair with consent of Council to defer this item as requested by the City Manager. 8-9-71 ,~e2 ANTI-POLLUTION ORDINANCE Council discussed status of anti-pollution ordinance for the beach and ocean area. Deputy City Attorney Keeler reported on same and further stated that an opinion from the Attorney Generals office was expected by the middle of the month on this subject, that his office would be prepared to give an opinion after that time. Further discussion followed. AGREEMENT - LIFEGUARD SERVICES - ORANGE COUNTY I Smith moved, second by Hogard to approve the Agreement between the County of Orange and the City of Seal Beach for lifeguard services for 1971-72 and authorize the Mayor to execute the Agreement. AYES: NOES: Blackman, Hogard, Holden, Sales, Smith None Motion carried AGREEMENT - LIFEGUARD SERVICES - HARBOR DISTRICT Hogard moved, second by Holden to approve the Agreement between Orange County Harbor District and the City of Seal Beach for lifeguard services for 1971-72 and authorize the Mayor to execute the Agreement. AYES: NOES: Blackman, Hogard, Holden, Sales, Smith None Motion carried AGREEMENT - INTER-CONNECT SIGNAL SYSTEM City Engineer presented the request from Los Alamitos for approval of agreement for an inter-connect signal system, which would affect two signals within the Seal Beach area. Hogard moved, second by Sales to authorize the City Manager to execute the Agreement, subject to the review by the City Staff. .1 AYES: NOES: Blackman, Hogard, Holden, Sales, Smith None Motion carried 8-9-L~ 23 I DISCUSSION - RECYCLE CENTER A petition concerning the recycle center located in Seal Beach Center was received by Council. The report from Bill Little, Administrative Assistant, regarding the recycling center pilot program was received. Discussion followed with members of the audience speaking on the subject. Holden moved, second by Sales that appropriate signs be posted to alleviate some of the problems at the center. AYES: Blackman, Hogard, Holden, Sales, Smith NOES: None Motion carried Further discussion on the matter continued. It was the consensus of the Council to continue a recycling program, the Staff to report to Council on alternate methods for the recycling program as soon as possible. DISCUSSION - FIRST STREET SIGNAL William L. Robertson requested the Council to consider paving an exit area for emergency exit from the Electric Circus West establishment. Discusssion followed with the City Engineer. reporting on the First Street Signal program. No action was taken by the Council. CLAIMS FOR PERSONAL INJURIES Sales moved, second by Blackman to deny the claims of Hugh Rupp, Everett Robert Barnett and Robert C. See and refer same to our insurance carriers as recommended by our Ci ty Attorney. AYES: Blackman, Hogard, Holden, Sales, Smith NOES: None Motion carried REQUEST - SEAL BEACH LIONS CLUB Hogard moved, second by Sales to approve the request from the Seal Beach Lions Club for use of the Sun ,Room and assistance in posting banner for their annual Fish Fry, September 4, 5, and 6. AYES: Blackman, Hogard, Holden, Sales, Smith NOES: None Motion carried 1 1 '~i-71 REPORT - CALIFORNIA COUNCIL ON CRIMINAL JUSTICE It was the order of the Chair with consent of Council to receive and file the communication informing the City that the application for grant for the Orange County co-ordinated law enforcement radio system had been approved. RESOLUTION NUMBER 2023 - SALARY RATES Resolution Number 2023 was presented to Council entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, ' CALIFORNIA, A CHARTER CITY, ESTABLISHING SALARY RATES, A SALARY AND WAGE SCHEDULE, AND OTHER PAYMENTS FOR EMPLOYEE BENEFITS, AND REPEALING, ON THE EFFECTIVE DATES SPECIFIED, ALL RESOLUTIONS IN CONFLICT THEREWITH." Smith moved, second by Sales to adopt Resolution Number 2023. Smith moved, second by Sales, to waive further reading of Ordinance Number 856 and pass it to second reading. Gordon Shanks, 215 Surf Place, spoke regarding the Code of Ethics and proposed topless-bottomless ordinance as previously requested by the-Law Revision Commission. The City Attorney reported on same. Julie Dorr, 231 - 6th Street requested an investigation fee for business licenses. Jay Covington, 4557 Candleberry, spoke regarding unification of the Los Alamitos - Seal Beach School Districts. Jean Dorr, 231 - 6th Street directed her questions to Councilman Blackman regarding City Manager and P. E. Right-of-Way. Paul Boisvert, 405 Opal Cove Way spoke on school unification and requested the City Attorney to rule regarding the return of public documents to the City. William L. Robertson spoke regarding the City Attorney's review of those ordinances adopted one year prior to April 1971. There were no other oral communications. Oral communications were closed.
