City erk Seal Beach, California November 29, 1971 I The City Council of the City of Seal Beach met in regular adjourned session at 8:00 p.m. with Mayor Holden calling the meeting to order with the Salute to the Flag. ROLL CALL Present: Mayor Holden Councilman Barnes, Blackman, Sales, Smith Absent: None Also present: Dennis Courtemarche, Acting City Manager Fritz Keeler, City Attorney Bob Neprud. Planning Department Jim VanDerhyden, Administrative Assistant ORDINANCE NUMBER 862 - COUNCILMANIC DISTRICTS At the request of the Council, Mr. Keeler affirmed the procedure required for first and second readings of Ordinances pursuant to the Charter, stating that on second reading an Ordinance must be read unless a unanimous vote to waive reading was given. Ordinance Number 862 was read in full entitled "AN ORDINANCE 1 OF THE CITY OF SEAL BEACH, CALIFORNIA, A CHARTER CITY, REAPPORTIONING THE COUNCILMANIC DISTRICTS OF THE CITY OF SEAL BEACH AND AMENDING SECTION 2-70 OF THE CODE OF THE CITY OF SEAL BEACH." An error was noted in the third paragraph of District One and paragraph two of District Three, Parcel B. A member of the Engineering Department present verified that the legal descriptions were correct as read. Discussion followed with members of the audience speaking on the matter. 11-29-71 ,~ 82 ~ Smith moved, second by Barnes to reject Ordinance Number 862 in its entirety, that the Council recess to Executive Session to prepare a new Councilmanic District Plan. The Deputy City Attorney then instructed the City Clerk to read again those portions of the Ordinance that had been incorrectly read, making the appropriate corrections. The Clerk read paragraph three, Councilmanic District No.1, including the Seal Beach Trailer Park in said description and read paragraph two, Councilmanic District Three, Parcel B, deleting Seal Beach Trailer Park from said description. Roll call on the motion: I AYES: NOES: Barnes, Smith Blackman, Holden, Sales Motion failed Sales moved, second by Blackman to adopt Ordinance Number 862 as read. AYES: NOES: Blackman, Holden, Sales Barnes, Smith Motion carried RESOLUTION NUMBER 2041 - SIGNATURE AUTHORIZATION Resolution Number 2041 was read in full entitled "A RESOLUTION 1 OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, A CHARTER CITY, PROVIDING AUTHORIZATION TO SIGN DEMANDS AND CHECKS FOR THE WITHDRAWL OF FUNDS ON DEPOSIT WITH THE BANK OS AMERICA, BRANCH #132; SECURITY PACIFIC NATIONAL BANK, BRANCH #250: SECURITY PACIFIC NATIONAL BANK, BRANCH #281; UNITED CALIFORNIA BANK, BRANCH #110; AND CROCKER CITIZENS BANK, BRANCH #363. Barnes moved, second by Smith to adopt Resolution Number 2041. AYES: NOES: Barnes, Blackman, Holden, Sales. Smith None Motion carried EXECUTIVE PERSONNEL SESSION The City Council recessed to Executive Personnel Session at 9:18 p.m. and reconvened at 10:34 p.m. with Mayor Holden calling the I meeting to order, CITY MANAGER Barnes moved to appoint Dennis Courtemarche as Acting City Manager. The motion failed for need of a second. 11-29-71 'r~_3 ... '.' ~ Sales moved to appoint Dennis Courtemarche as City Manager at the salary of $22,000 per year. Mr. Blackman seconded the motion. Discussion followed. AYES: NOES: Blackman, Holden, Sales, Smith Barnes Motion carried I CALIFORNIA PHYSICIANS SERVICE Sales moved, second by Barnes to authorize the City Attorney to settle the suit of California Physicians' Service vs. City of Seal Beach as agreed upon in Exeuctive Session. AYES: NOES: Barnes, Blackman, Holden, Sales, Smith None Motion carried ORAL COMMUNICATIONS Gordon Shanks, 215 Surf Place. spoke regarding information related to public hearing on lot coverage in College Park East. It was noted that the public hearing was continued to December I 27, 1971. Albert Del Guercio, College Park East, spoke regarding the sidewalks on Lampson Avenue and was informed that the City paid for those sidewalks pursuant to an agreement entered into by the City.
