SUBJECT: MUNICIPAL CODE REVISION RELATING TO
WHEELED DEVICES ON PUBLIC AND PRIVATE
PROPERTY
SUMMARY OF REQUEST:
Waive further reading and adopt Ordinance No. 1608 amending Municipal Code
Section 8.05.040 Wheeled Devices on Sidewalks.
BACKGROUND AND ANALYSIS:
The City Council considered this matter on May 9, 2011 and introduced the
subject ordinance. It is now appropriate to adopt the subject ordinance.
FINANCIAL IMPACT:
The potential negative or positive fiscal impacts of the proposed Municipal Code
amendment, if any, would be minor.
RECOMMENDATION:
Waive further reading and adopt Ordinance No. 1608 amending Municipal Code
Section 8.05.040 Wheeled Devices on Sidewalks.

ORDINANCE NUMBER 1608
AN ORDINANCE OF THE CITY OF SEAL BEACH AMENDING
SECTION 8.05.040 OF THE SEAL BEACH MUNICIPAL CODE
RELATING TO WHEELED DEVICES ON PUBLIC AND PRIVATE
PROPERTY
THE SEAL BEACH CITY COUNCIL DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Section 8.05.040 of the Seal Beach Municipal Code is
amended to read as follows:
§ 8.05.040 Wheeled Devices Prohibition
A. Wheeled Device: For the purpose of this section, a "wheeled
device is any wheeled device propelled by human or mechanical
power. "Wheeled device" includes without limitation: bicycles, roller
skates, scooters, segways, and skateboards. "Wheeled devices"
does not include: cars, trucks and equivalent vehicles; baby
strollers; shopping carts utilized for transportation of goods;
wheelchairs; and motorized tricycles and motorized quadricycles
utilized by persons otherwise unable to move about as pedestrians
by reason of physical disability.
B. Prohibition: No person shall ride or operate a wheeled
device in any of the following locations:
1. City sidewalks
2. Public property other than sidewalks where signs
prohibiting such activity are conspicuously posted.
3. Privately owned sidewalks used for pedestrian traffic
where signs prohibiting such activity are conspicuously posted.
C. Infraction: Any person who rides or operates a wheeled
device in violation of this section shall be guilty of an infraction.
PASSED, APPROVED AND ADOPTED by the City Council of the City of Seal
Beach at a regular meeting held on the 13th day of June , 2011.
