FEE WAIVER REQUEST
SUMMARY OF REQUEST:
It is requested that the City Council provide staff direction regarding the waiver of
the County of Orange water service connection fee for the new Los Alamitos
Pump Station.
BACKGROUND AND ANALYSIS:
The Orange County Flood Control District is currently reconstructing a flood
control pump station at the Los Alamitos Retarding Basin located south of Island
Village in the City of Long Beach. (See attached map.) The flood control pump
station will improve the operation of the Retarding Basin which will improve flood
control capacity primarily in the City of Seal Beach. The County is reconstructing
the pump station to meet 100 -year storm flows.
The existing pump station was old and did not meet current storm water
protection levels. In 1995, a severe storm caused flooding in Seal Beach. The
existing station currently has a 2 -inch water meter connection to provide water for
the site. The water is mainly for a bathroom, mechanical equipment and for
maintenance services.
The new station requires a 4 -inch water meter connection. The City's approved
fee schedule outlines a water meter connection fee of $126,660. Since the
previous station currently has a 2 -inch connection, the City's policy applies a
credit of $37,329 to the new fee. By subtracting the 2 -inch fee of $37,329 from
the 4 -inch fee $126,660, the County is required to pay $89,331.
The County is currently requesting the City of Seal Beach waive the fee of
$89,331.

Historically, the City has not billed the County for their water connection or water
use on both storm drain pump stations. Consequently, there are no records if the
County has ever paid the initial 2 -inch buy -in charge. The waiver of these fees
was established before the City adopted the current fee schedule in 2004. The
City Council has the authority to waive any fee within this schedule.
FINANCIAL IMPACT:
Per the approved 2009/10 Fee Schedule, Resolution No. 5898, any new
development, including government agencies, is required to pay a water service
connection fee. This fee is to buy -in to the City's water system. The Orange
County Flood Control District is requesting that the City waive a fee of $89,331.
The water system is an enterprise account that collects revenue to deliver a
specific service (domestic water delivery). Waiver of these fees will impact the
reserve of the water fund.
RECOMMENDATION:
It is recommended City Council provide direction on the County's request.

Subject: Los Alamitos Pump Station Project — Water Meter Connection Charge
Dear Mr. Crumby:
Thank you for meeting with Rick Francis and me on May 3, 2011 to discuss the Los Alamitos Pump
Station's waterline connection. Based on our meeting and a subsequent field meeting with staff at
the project site, it appears that there are alternatives that can provide a more cost effective solution
for the Orange County Flood Control District's (District) waterline connection as well as the City's
own water line relocation project.
Pursuant to the City's water service fee schedule, we are required to pay $89,331 for a new water
service connection. I understand that this amount is based on the proposed 4 -inch meter fee of
$126,660, with a credit of $37,329 for the removal of our existing 2 -inch meter.
As you are aware, the 1995 storms flooded nearby homes and streets in Seal Beach, caused millions
of dollars in damage, and displaced hundreds of families. In response, we accelerated our $22
million pump station construction project, which, when completed, will convey 100 -year storm flows
and improve regional flood protection for the surrounding area. Since our project provides direct
benefit to the Seal Beach community, I would like to request a public agency waiver of the City's
new water connection fee. Please let me know if the City can honor our waiver request.
