The 'meeting was called to order with the Salute I to the Flag. ROLL CALL Present: Mayor Hamilton Councilmen Anderson, Dreis, Fuhrman, Gummere Absent: None APPROVAL OF MINUTES Fuhrman moved, se~ond ?y D!eis, to_approve the minutes of July 22, 19~9 regular meeting as presented. AYES: Hamilton, Anderson, Dreis, Fuhrman, Gummere NOES: None Motion Carried. APPROVAL OF DEMANDS through .7514 of $15~,779.98 including payroll of $54,938.77 as approyed by the Finance Committee and th~t warrants be drawn on the Treasury for the same. Item VI of the Agenda was held over by order of the Chair. 8-4-69, ilf'~ REPORT - SPECIAL DISTRICTS - Supervisor David Baker Supervisor David Baker gave a report,9n special purpose districts in Orange County. Mr. Baker presented the Council a copy of the report, the , result of a four year study by his I office. The City Manager noted that at this Coubil's request some effort had been made to eliminate some special districts in this City. PUBLIC HEARINGS The Mayor asked that the City Attorney conduct the public hearing concerning appeal of Planning Commission Resolution 341. The City Attorney stated that this was the 'time and place for a public hearing to be held concerning appeal of Hellman Estates by A. C. Hennekam from decision of Planning Commission denying use variance application UV-7-69 for a newspaper distribution business in an unzoned area adjacent to Leisure World. The I City Clerk stated that all notices had. been posted as required by law and that one communication had been received from the Golden Rain Foundation pertaining to the matter. There was no communication from the audience. The Mayor closed the public hearing. Gummere moved, second by Fuhrman, to ratify Planning Commission Resolution Number 341. AYES: Hamilton, Anderson, Dreis, Fuhrman, Gummere NOES: None Motion Carried. I The Mayor asked the City Attorney to conduct the public hearing concerning the appeal of David\Stangeland from decision of. \ Plann~ng Co~mis~~on o~_~~~ varia~ce. The City Attorney stated that this was the time and place/for a public hearing to be held concerning the appeal of Leonard Olsen and David Stangeland of Planning Commission decision denying use'variance UV-8-69 for on-sale beer at a sandwich shop in a C-l zone, Planning Commission Resolution Number 347. The City Clerk stated that all notices had been posted as required by law, that a communication signed by Byron C and Margaret S. Ordway, 327 15th S~reet, patricia Buchanan, 323 15th Street, and Carolyn Preimsberger, 322 15th Street, Seal Beach had been received " 8-4-69 .' , . . 18 asking that the appeal be denied. The City Manager stated that a communication addressed to the Planning Commission - from the attorneys representing the owner of the Glider Inn Restaurant was received asking the appeal be denied. No other communications were received. The City Attorney stated that anyone in the audience who wished to speak to the matter could now do so. David Stangeland, 1510~ Pacific Coast I Highway, asked that the appeal be granted, that he could foresee no parking problem. Leonard B. Olsen, 319 12th Street, spoke for Leonard E. Olsen that the appeal be granted. Victor . Reinhold, 1510 Emerald Cove Way was opposed to granting the f appeal in that it would create traffic problems. Kenneth Nash, 305 Central Avenue, spoke for granting the appeal. Jack Salyer, Surfside Colony, spoke in agreement with Mr. Stangeland. L. H. Nelson, 1500 Emerald Cove Way, spoke in agreement with Mr. Reinhold. Margaret Ordway, 322 15th Street, referred to her letter and that granting the use variance would create a traffic and parking problero in the residential area. There were no other communications from the audience. I The Mayor declared the public hearing closed. Anderson moved, second by Dreis, that the matter be referred back to the Planning Commission for action on August 6 meeting with the recommendation that a 11:00 p.m. closing time, no entertainment and dancing clauses be added. AYES: Anderson, Dreis, Fuhrman, Gummere NOES: Hamilton Motion Carried. The Mayor asked the City Attorney to conduct the public hearing concerning Civil Service: Board Resolution 69-8 and 69-15. The City Attorney stated that this was the time and place for a public hearing to be held concerning amendments to Position elassification Plan adding new position clas- I " sification and job description of Fire Lieutenant, Civil Service Board Resolution Number 69-8; and Battalion Chief, Civil Service Board Resolution Number 69-15. The City Clerk stated that' all notices had been posted as required by law and that no communications for or against the matter had been received. There was no communication from the audience. APPOINTMENT - BOARD OF APPEALS Councilman Gummere referred to the letter from Mr. Del Guercio .. offering to serve on the Board of Appeals and stated that ... .....' . . ~. f".:. ~: .1 _ .; . Mr. Del Guercio would be available for an interview with Council. It was the order of the Chair that an interview be granted before the appointment to the Board. ORAL COMMUNICATIONS The Mayor stated that this was the time and place for oral I communications and asked that members of the audience wishing to speak to a specific matter on the Agenda please so indicate by signing a card at the City Clerk's desk. Four members of the audience indicated they wished to speak to Item 13 of the Agenda. RESOLUTION NUMBER 1797 - BEACHES AND SHORELT.NE Resolution Number 1797 was presented by title, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, RELATING TO BEACHES AND SHORELINE." Fuhrman moved, second by Dre~s, that Resolution Number 179~, be adopted. AYES: Hamilton, Anderson, ,Dreis, Fuhrman, Gummere NOES: NONE. Motion Carried. RESOLUTION NUMBER 1798 -. FINANCING, STATE IMPOSED PROGRAMS I Resolution Number 1798 was presented by title, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, REGARDING STATE IMPOSED PROGRAMS FOR LOCAL GOVERNMENT." Dreis moved, second by Fuhrman, to adopt..Resolution Number 1798. AYES: Hamilton, Anderson, Dreis, Fuhrman, Gummere NOES: None Motion Carried. 8-4-69 '20 RESOLUTION NUMBER 1799 - PARK NAME Resolution Number 1799 was presented by title, " A RESOLUTION OF THE CITY 'COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, OFFICIALLY DESIGNATING THE PUBLIC PARK LOCATED AT THE FOOT OF MAIN STREET, ADJACENT TO THE MUNICIPAL PIER, AS PRESIDENT DWIGHT D. LEAVE OF ABSENCE - JAMES LITTLE It was the, order or the/Mayor, with concurrence of Council, to refer the application of James M. LIttle, Patrolman, for one year medical leave bf 'absence to the City Attorney for his recommendations. ORDINANCE NUMBER U89 - REFUSE COLLECTION CHARGE Ordinance Number 789 was presented for second reading by tit-Ie, "AN ORDINANCE OF THE CITY OF SEAL BEACH, CALIFORNIA, _ AMENDING SECTIONS 10-20 AND 10-21 OF ARTICLE III, CHAPTER 10 OF THE SEAL BEACH CITY CODE, RELATING TO MONTHLY SERVICE' CHARGES BY 'CITY FOR REFUSE COLLECTION." I Dreis moved, second by Gummere, to waive the second reading of Ordinance Number 789, deem that it has had'second reading and be passed for adoption. Discussion followed. DISPATCHING Gummere moved, second by Fuhrman, to authorize the City Manager and/or Mayor to execute the agr~ement for consolidated emergency communications system with the cities of Huntington Beach, Fountain Valley, and Westminster. COMMUNICATION - CENSUS It was the order of the Mayor, with eoncurrence of Council to receive and file the resolution from the City 'of San Juan Capistrano relating to census questionnaire. A letter of protest was received by, Council from Frank Vessels, Jr., president of Los Alamitos Race Course regarding renaming of Los Alamitos Boule*ard. Discussion followed. REQUEST - HOUSE FOR T~SIENTS A communication was received by Council from John Anderson, 122~ 8th Street, ~eal Beach requesting permission to maintain a house for young transients in the City. The Mayor granted oral communication to David Philips, 118 8th Street, Peter Philips, 118 8th Street, Ethel Roberts, 122~ 8th Street, and John Anderson, 122~ 8th Street, as requested. All were proponents of the request. The Mayor referred to the City ordinance prohibiting such activity. Discussion followed.
