The meeting was called to order with the Salute to the Flag. ROLL CALL I Present: Mayor Hamilton Councilmen Anderson, Dreis, Fuhrman, Gummere Absent: None APPROVAL OF MINUTES Anderson moved, second by Fuhrman, to approve the Minutes of August 4, 1969 regular meeting as presented. AYES: Hammlton, Anderson, Dreis, Fuhrman, Gummere NOES: None Motion Carried. APPROVAL OF DEMANDS Regular demands *7515 through *7616 of $98,440.00 including payroll of $52,019.58 was presented as approved by the Finance Committee. Fuhrman moved, second by Dreis, that the I demands be allowed and warrants drawn on the Treasury for the same. AYES: Hamilton, Anderson, Dreis, Fuhrman, Gummere NOES: None Motion Carried. PUBLIC HEARINGS The Mayor opened the public hearing concerning the appeal of Stan Miller/North Sails to decision of Planning Commission on Variance V-19-68. The City Attorney conducted the public hearing. The City Clerk stated that all notices had been posted as required by law and that no communications for or against the matter had been received. Stan Miller, 913 Electric Avenue, Seal Beach requested a continuation of the variance I for six months when the additional building planned would be completed and the variance would no longer be requrred. There was no other communication from the audience. The Mayor closed the public hearing. 8-18-69 2-\ Anderson moved, second by Gummere, to refer the appeal of Stan Miller back to the Planning Commission with the recommendation to extend the variance as requested. AYES: Hamilton, Anderson, Dreis, Fuhrman, Gummere NOES: None Motion Carried. The Mayor opened the public hearing concerning changes in Civil Service Rules and Regulations. The City Manager conducted the public hearing. The City Clerk stated that all notices had been posted as required by law and that no communications had been received for or against the matter. There was no communication f~om the audience. The Mayor closed the public hearing. ORDINANCE NUMBER 790 - CIVIL SERVICE RULES AMENDED Ordinance Number 790 was presented for first reading by title, "AN ORDINANCE OF THE CITY OF SEAL BEACH AMENDING THE SEAL BEACH CITY CODE, CHAPTER 7, SECTION 37: DELETING CHAPTER 7, SECTION 38, HOLmDAYS AND SAYS OFF." PAY PLAN: AND ADDING THERETO SECTION 38, HOLDAYS AND DAYS OFF." Gummere moved, second by Fuhrman, to waive the first reading of Ordinance Number 790, deem that it has had first reading and be passed to second reading. AYES: Hamilton, Anderson, Dreis, Fuhrman, Gummere NOES: None Motion Carried. APPEAL - DAVE STANGELAND - UV-8-69 Planning Commission Resolution Number 352 reaffirming denial of Use Variance UV-8-69 for on-sale beer at a sandwich shop in a C-I zone was received. Anderson moved, second by Gummere, to overrule the decision of the Planning Commission and grant the variance with the stipulation that there be an 11:00 p.m. closing time, that no entertainment be allowed, and that a block wall be constructed at the rear of the property. Discussion followed. Mr. Victor Rheinhold, 15mO Emerald Cove Way, spoke supporting the Planning Commission decision. I I I 8-18-~5 Dave Stangeland stated that adequate parking was available. Further discussion followed relating to parking and traffic. AYES: Anderson, Dreis, Gummere NOES: Hamilton, Fuhrman Motion carried. APPEAL - SERBAN - V-22-69 I Planning Commission Resolution Number 353 reaffirming denial of Variance V-22-69 was received. Anderson moved, second by Gummere, to overrule the Planning Commission decision and grant the variance. Discussion followed with Carl Irwin 636 Island View, Seal Beach, architect for Mr. and Mrs. Serban on the project spoke for the variance. Tom Gallagher, 1405 Seal Way, Seal Beach spoke for granting the variance. Further discussion followed relating to fire safety. Anderson withdrew his motion with consent of the second. It was the order of the Chair to hold the matter over to the next meeting. PUBLIC HEARING SET - UNIFGRM FIRE CODE It was the order of the Chair, with concurrence of Council, I to set the public hearing concerning adoption of 1966 Uniform Fire Code with amendments by reference for 8:00 p.m. S~ptember 2, 1969, at 211 Eighth Street, Seal Beach. COMMUNICATIONS - RENAMING LOS ALAMITOS BOULEVARD .' Communications from the City of Los Alamitos, William H. Kraus, City Managerl Los Alamitos Naval Air Station, Captain L. D. Ruth; and Assemblyman John V. Briggs requesting reconsideration of the renaming of Los Alamitos Boulevard from the San Diego Freeway to Bradbury Road was received. Dale Kroessen, Mayor of the City of Los Alamitos addressed the Council requesting reconsideration of the matter. Mayor Hamilton stated that the matter would be considered by this Council. COMMUNICATION - J. W. DUNN, JR. - BEACH PROBLEMS I Communication from J. W. Dunn, Jr., 1501 Seal Way, relating to beach problems was received. Mr. Dunn stated that the situation had been relieved by additional police patrolmen on the walk, and added that a property owners meeting including absentee landlords would be held to inform them of the situation. 8-18-69 , .., If' ....,... Mrs. Mabel Shaw, Seal Beach Liquor Store, informed the Council that the situation had improved and commended the Police Department. The City Manager stated that members of the Council would like to attend a property owners meeting as proposed. ORAL COMMUNICATIONS I The Mayor stated that this was the time and place for .. oral communications. Mr. Tom Gallagher,s~405 Seal Way, spoke on dedication of property for widening Seal Way alley. A petition received by the Mayor at the beginning of this meeting from Crestview Avenue citizens relating to motorcycle noise on Hellman property was read in full by the City Manager. It was the order of the Chair that this matter be referred to the City Manager for action. There was no other communication from the audience, oral communications were closed. COMMUNICATIONS It was the order of the Mayor, with concurrence of Council I to receive and file the following as previous action had been taken by this Council: The resolution of City of Tustin relating to State Imposed Programsl Resolution of City of Costa Mesa regarding Corps of Engineers project on Santa Ana riverl Resolution of City of €eBparMesa regarding beaches and shorelinel and Resolution from City of Newport Beach objecting to State Legislation regarding employee benefits at city expense. The Notice from Local Agency Formation Commission re Midway City Sanitary District was ordered received and filed by the order of the Mayor, with concurrence of Council. The Communication from Cypress Chamber of Commerce re Fiesta Parade Fair, October lO-12, 1969, was ordered received and I . filed by order of the Mayor with concurrence of Council. 8- 18-69,:) "ft.? ' TRANSFER OF OWNERSHIP - SEAL BEACH DISPOSAL Communication from Sea~ Beach Disposal, E. H. Schleining regarding transfer of ownership was ordered received and filed by order of the Mayor with concurrence of Council, I as no action was required. , RESOLUTION NUMBER 1800 - ASSIGNMENT OF EASEMENT Resolution Number 1800 was presented by title " ]I;, RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH AUTHORIZING THE ACCEPTANCE OF AN ASSIGNMENT OF EASEMENT FROM THE COUNTY OF ORANGE." Fuhrman moved, second by Dreis, to adopt Resolution Number 1800. AYES: Hamilton, Anderson, Dreis, Fuhrman, Gummere NOES: None Motion Carried. RESOLUTION NUMBER 1801 - ORANGE COUNTY FLOOD CONTROL PERMITS Resolution Number 1801 was presented by title, "A RE'SOLUTION I OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFOR!IA, AUTHORIZING AND DIRECTING THE DIRECTOR OF PUBLIC WORKS, OR THE CITY MANAGER, TO EXECUTE ALL ORANGE COUNTY FLOOD CONTROL PERMITS ON BEHALF OF THE CITY OF SEAL BEACH, EXCEPT THOSE PERTAINING TO EASEMENTS." Gummere moved, second by Dreis, to adopt Resolution Number 1801. AYES: Hamilton, Anderson, Dreis, FUhrman, Gummere NOES: None Motion Carried. RESOLUTION NUMBER 1802 - STATE HIGHWAY MAINTENANCE Resolution Number 1802 was presented by title, " A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH APPROVING AGREEMENT FOR MAINTENANCE OF STATE HIGHWAY IN THE CITY OF SEAL BEACH." Fuhrman moved, second by Hamilton, to adopt resolution Number 1802. I AYES: Hamilton, Anderson, Dreis, FUhrman, Gummere NOES: None Motion Carried. AGREEMENT - IDENTI-KIT Anderson moved, second by D~eis, to authorize the City Manager to execute the agreement between the Orange County Peace Officer Association, Inc., and the City of Seal Beach for use 8-18-69 28 of Identi-Kit. AYES: Hamilton, Anderson, Dreis, Fuhrman, Gummere ' NOES: None Motion Carried. CLAIM - ARTHUR ANDERSON On recommendation of the City Attorney, the claim of Arthur Anderson for damage to personal property was forwarded to the Insurance Carrier by order of the Chair, with concurrence of Council. The claimant to be notified I of Council action. PLANNING COMMISSION RESOLUTION 351 - UV-9-69 Gummere moved, second by Dreis, to ratify Planning Commission Resolution Nu~er 351 approving UV-9-69 for redevelopment of a manufacturing use in a C-2 zone (Bernsteins). AYES: Hamilton, Anderson, Dreis, Fuhrman, Gummere NOES: None Motion Carried. Items 17 and 19 of the Agenda were held by order of the Mayor. TAX RATE - 1969-70 Fuhrman moved, second by Hamilton, to reduce the tax rate for 1969-70 two cents to $1.33 for each $100 of taxable I property in the City. Discussion followed. The City Attorney ruled on procedure. Fuhrman withdrew his motion with . consent of the second. ORDINANCE NUMBER 791 - TAX RATE 1969-70 Ordinance Number 791 entitled "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, FIXING AND DETERMINffiNG THE RATE OF TAXES TO BE LEVIED FOR MUNICIPAL PURPOSES AND TO PAY THE BONDED INDEBTEDNESS AND INTEREST OF THE CITY OF SEAL BEACH FOR FISCAL YEAR 1969-70, AND DECLARING THE URGENCY THEREOF, AND THAT THIS ORDINANCE SHALL TAKE EFFECT IMMEDIATELY. was read in full b~etheeCity Manager. Gummere moved, second by Dreis, to adopt Ordinance Nu~ber I 791 as read. Fuhrman moved, second by Hamilton, to amend Ordinance Number 791, Section 3.2 to read $.2412 on each $100 of taxable property of said City instead of $.2612 on each $100 of taxable property in said City. 8- 18-f!9 Discussion followed.
