OF MINUTES Hamilton moved, second by Dreis, to approve the minutes of the joint session of Council and Planning Commission December 1, 1969, as presented. The City Attorney conducted I the hearing concerning change of zone from M-2, ,1leavy Manufacturing, to R-4, High Rise Multiple Residential zone on Dow Chemical property. The City Clerk stated that all notices had been posted as required by law and that no communications had been received for or against the matter. There was no communication from the audience. Mayor Anderson closed the public hearing. ORDINANCE NUMBER 798-Z0NE CHANGE-DOW CHEMICAL PROPERTY nrdinance Number 798 was presented to Council for first reading by title, "AN ORDINANCE OF THE CITY OF SEAL BEACH MffiNDING ORDINANCE NUMBER 62B (ZONING) WITH THE AMENDMENT OF THE OFFTCTAL ZONING MAP BY CHANGING THE ZONE OF THE DOW CHEMICAL COMPANY PROPERTY FROM M-2, HF.AVY MANUFACTURING, TO R-4, HIGH RISE MULTIPLE RESIDF.NTTAL ZONE." Mrs. Murray, 1017 Seal Way, Seal Beach asked to speak when Item 9 of the Agenda, relating to First ~treet extension, was being considered. There were no other communications, ~he Mayor closed oral communications. CALIFORNIA SANCTUARY ACT OF 1969 It was the order of the Mayor, with concurrence of Council, to receive I and file the resolution of Laguna Beach urging enactment by Congress of ~3093, the California Marine Sanctuary Act of 1969. NOTICE-PUBLIC UTILITIES COMMI~SION It was the order of the Mayor, with concurrence of Council, to receive and file the notice of application of Southern Pacific Company to modify the requirements to use of backlights in connection with operation of grade crossing signals, Application #51205. "'6 12-15-69 NOTICE-CORPS OF ENGTNEERS It was the order of the Mayor, with concurrence of Council, to receive and file the notice of application made by Orange County Harbor District to dredge a portion of upper Newport Bay. REQUEST-BIAFRA RELIEF SERVICES FOUNDATION It was the order of the Mayor, with concurrence of Council, to receive , and file the communication from Biafra Relief Services Foundation requestin~ a day of prayer for the people of Biafra. COMMUNICATION-SEAL BEACH IMPROVEMENT GROUP The communication from the Seal Beach Improvement Group expressing their appreciation for Council's consideration relating to widening of Seal Way Alley was received and filed by order of the Mayor. VARIANCE-UV-11-69-PETER J. TRAMA Planning Commission resolution number 382 approving use variance UV-11-69 to permit an eating establishment with cocktail lounge and entertainment in a C-l zone was received. Dreis moved, second by Hamilton, to ratify Planning Commission Number 382. Discussion followed relating to the entertainment portion and noise decibels. Fuhrman moved, second by Ham:l,lton, to amend.'the motion to limit the noise factor to 85 decibels. Further discussion followed. Mr. Fuhrman withdrew his motion with consent of the second and Mrs. Dreis withdrew her motion with consent of the second. It was the order of the Chair to hold this item over to next meetinR. STATEMENT OF QUALIFlCATIONS-MBNICIPAL PRIMARY"ELECTION Hamilton moved, second by Fuhrman, to direct the City Clerk to notify each candidate who files a statement of qualification pursuant to Section 10012.5 of the Election Code, that he shall pay his pro-rata share of the costs of printing and handling such statement and further that each candidate shall post a deposit of $65.00 (Sixty-five dollars) to be applied toward such cost. PUBLIC HEARING SET-PP-1-69 It was the order of the Mayor that a public hearinll be set for January 5, 1970, at 8pp.m. concerning approval of Preci~e Plan PP-1-69 for property known as the Dm~ Chemical Property ad~acent to the San Gabriel River. (Planning Commission Resolution 385). It was the order of the Mayor to hold this matter over for further study. Item 20 of the Agenda was withdrawn with concurrence of Council relating to appointment of White Ilouse Fellow. COMMUNICATION-UNDERGROUND UTILITIES It was the order of the Mayor with concurrence of Council to receive and file the communication from the League of California Cities regarding Underground Utilit!es. COMMUNICATION-ORANGE COUNTY FLOOD CONTROL DISTRICT It was the order of the Mayor with concurrence of Council to receive and file the communication from the Orange County Flood Control I District relating to future joint powers agreement and the Comprehensive Plan for Local Drainage Financing in the County of Orange. COMMUNICATION-ARTHUR & HELEN BOYNTON The communication from Arthur and Helen Boynton,llll~ Seal Way, was read in full commending the City for their efforts in the protection of the beached and property during the recent high tides. The Mayor expressed his appreciation and ordered the communication received and filed. AGREEMENTS-LOS ALAMITOS WATER DISTRICT Hamilton moved, second by Dreis, to approve the Modification Agreement .', between the Los Alamitos Water District and the City of Seal Beach.
