The meeting was called to order with the Ple4ge of Allegiance. ROLL CALL Absent: Mayor Anderson Councilmembers Dreis, Guunnere, Fuhrman, Hamilton None Present: APPROVAL OF MINUTES Hamilton moved, second by Fuhrman, to approve the minutes of December 15, 1969, regular meeting as presented. ORAL COMMUNICATIONS Mayor Anderson stated thAt this was the time for oral communications, there being none, oral counnunications were closed. ,;-t. R2 12-22-69 CLAIM-WILBUR BURCKHALTER Fuhrman moved, second by Dreis, to deny the claim for damages of Wilbur Burckhalter as recommended by th~ City Attorney and that the claimant and insurance carrier be notified of Council action. AYES: Anderson, Dreis, Fuhrman, Gummere, Hamilton NOES: None Motion carried. CLAIM-FLORENCE RUTH M. FREF..DMAN Fuhrman moved, second by Dreis, that the notice of claim in Small Claims Court of Florence Ruth M. Freedman be denied and referred to the City Attorney. ORDINANCE NUMBER 794-CASH BASIS WORKING CAPITAL FUND Ordinance Nwnber 794 was presented for second reading by title, "AN ORDINANCE OF THE CITY OF SEAL REACH, CALIFORNIA, ESTABLISHING A CASH BASIS lolORKING CAPITAL FUND AND APPROPRIATING MONIES THERETO." Gummere moved, second by Dreis, to waive the second reading of Ordinance Nu~ber 794, deem that it has had second readin~ and be passed to adoption. Fuhrman moved, second by Hamilton, to amend Ordinance Number 794 to include a third section referrin~ to allocations from the general fund and establishing an accountability system. Discussion followed on the matter with Council concurrinR that an amending ordinance requiring a resolution for fund withdrawal be considered at next meeting. Mr. Fuhrman withdrew his motion with consent of the second. Mr. Hamilton stated that his vote was conditional upon presentation of the amending ordinance proposed. TRAMA Planning Commission Resolution Number 382 approving use variance UV-11-69 to permit an eating establishment with cocktail lounge and entertainment in a C-l zone was considered by Council. An amendment to Section 3e including employees as well as customers regarding rear door use was sug~ested. Hamilton moved, second by Gummere, to ratify Planning Commission Resolution 382 as amended. ORDINANCE NUMBER 80l-COMPENSATION FOR VOLUNTEER FIREMEN: Ordinance Number 801 was presented for first readinll by title, "AN ORDINANCIl OF THE CITY OF SF.AL BEACH, CALIl'ORNIA llMENDING ORDINANCE NUMBER 698, SECTION 9-12, RELATING TO COMPENSATION FOR VOLUNTIlI!R FIRJl}IENT" Hamilton moved, second by Anderson, to waive the first reading of Ordinance Number 801, deem that it has had first reading and be passed to second reading. AYES: Anderson, Dreis, Fuhrman, Gummere, Hamil ton NOES: None ~otion carried. APPEAL-PLANNING COMMISSION RESOLUTION 387 Planning Commission Resolution Number 387 denying Plan Review PR-36-69 for a 60 foot high flag pole at the Belmont 5avin~s and Loan site in the Leisure World Shopping Center was considered by Council. William J. Crawford, President of Belmont Savin~s and Loan, asked that Council grant the appeal. Robert Borders, Architect for the project, spoke on the matter. Hamilton moved, second by Anderson, to grant the appeal of Belmont Savin~s and Loan for a 60 foot high flag pole as requested. AYES: Anderson, Dreis, Fuhrman, Hamilton NOIlS: Gummere Motion carried. Mr. Hamilton left at 7:30 p.m. PIER AREA DEVELOPMENT The development of the pier area was di~cussed at length by Council. ~Ir. Alex Horowitz, 3491 Elm Avenue, Lon~ Beach proposed a development of the entire pier area with Mr. Frank Hale of Seal Besch Sportsfish~ng. Fuhrman I I 'Ra 12-22-69 moved, second by Gummere, to direct the City Manager to preparesa proposal for all three areas of the pier for consideration of Council and authorize the City I-lanager to nep;ot1ste with ~Ir. Horowitz and Mr. Hale regardinp; the same. AYES: Anderson, Dreis, Fuhrman, Gummere ABSENT: Hamilton Motion carried.
