The meeting was called to order with the Salute to the Flag. ROLL CALL Present: }Iayor Anderson Councilmembers Dreis, Fuhrman, r,ummere, Hamilton I Absent: None APPROVAL OF DEMANDS Demands numbered 9736 throur,h 9833 of $117,730.05, including payroll of $51,988.41, were presented as approved by ,the Finance Committee. Fuhrman moved, second by Dreis, that the demands be all6wed and warrants drawn on the Treasury for the same. AYES: Anderson, Dreis, Fuhrman, Gummere, Hamilton NOES: None Motion carried. PUBLIC lIEARING-SURFSIDE STREETS Mayor Anderson stated that this was the time for a public hearing to be held and requested the City Attorney to conduct the hearing. The City Attorney stated that the public hearing concerned the request of the property I owners in Surfside Colony for assistan~e in enforcing City ordinances and vehicle Code provisions on private roads in Surfside pursuant to sections 21107.5 and 21107.7 of the California Vehicle Code. The City Clerk stated that notices had been posted as required by law and that a letter had been sent to Surfside Colony, Ltd. notifying them of the hearing. No communications had been received by the City Clerk on the matter other than the letter from Surfside Colony, Ltd. which initiated this action. Mr. Willard Morris, A 105, Surfside Colony spoke in favor of grantinr, the request and referred to a letter from Fire Chief Adams regarding his recommendations. Mr. Hamilton asked to see these recommendations, and asked the City Attorney if the letter from Surfside Colony, Ltd. constituted a petition. It was the opinion of the I City Attorney that the letter could be accepted as a petition as required in the vehicle code as the board of directors of Surfs ide Colony, Ltd. have the authority to speak for the shareholders. Mark West, 1201 Electric Avenue, Seal Beach, spoke on the matter. James Gavin, A 58, Surfs ide Colony spoke for r,ranting the request for the safety and welfare of the residents and indicated that the recommendations of the Fire Chief and the Police Department would be complied with. Denis Morgan, 301 14th Street, Seal Beach, spoke on the I 1 I. 5-4-70 1'43 matter. Sven Lindstrom, 215 14th Street, Seal Beach spoke on the matter. Paul Boisvert, 405 Opal Cove Way, Seal Beach, spoke on the matter. }Iimi Olhausen, C 44, Surfside, reported on meetings and cpmmittees relative to this matter and indicated that all recommendations proposed by City departments had been approved by the Board of Surfs ide Colony, Ltd. Mr. H~milton read the letter from Fire Chief Adams dated March 23, 1970, regarding his recommendations. Mr. Hamilton asked, as a matter of record, for the City Attorney's opinion regarding notification of the hearing. The City Clerk stated that a letter had been directed to the Board of Directors of Surfside Colony, Ltd. notifying them of the meeting. Mrs. James Gavin, A ?8, Surfside stated that the Board of Directors had full and complete power with full consent of the shareholders. The City Attorney ruled that all the property owners be notified individually and recommended that the public hearing be continued and such notices be given. Anderson moved, second by Dreis, to continue the hearing to May 18, 1970, at 8:00 p.m. and directed the City Clerk to notify the property owners of this date. AYES: Anderson, Dreis, Fuhrman, Gummere, Hamilton NOES: None PUBLIC HEARING-LOT CLEANING Motion carried. The City Attorney stated that this public hearing concerned lot cleaning of property located on Lot 18, Block 109, B.C. ,Tract, pursuant to Ordinance Number 783. The City Clerk stated that upon receipt of statement from the Director of Public Works notices of the public hearing were posted as required by law and that no further communication had been received on the matter. Mr. Stratford stated that complaints had been received on the property which initiated this action. Ralph Perrigo, 4565 Ironwood, Seal Beach, asked ahout the weed abatement program in general. There were no other communications on the matter. Mayor Anderson declared the public hearing closed. ORAL COMMUNICATIONS Mayor Anderson stated that this was the time ~or oral communications. Donald Salem, 141 Dolphin, Seal Beach presented pictures relative to his communication on the agenda. Julie Dorr, 231 6th Street, Tom Brady, 1607 Electric Avenue, and Mrs. Harry Schuck, 933 Coastline, were granted permission to speak relative to agenda item on car wash. There were no other communications, oral communications were closcd. PROCLAMATIONS Mayor Anderson proclaimed !1ay 23 and May 24 as "Poppy Days." Mayor Anderson proclaimed the week of May 3 to May 9 as "Correct Posture Heek," as requested by California Chiropractic Association. It was moved by Dreis, second by Fuhrman, to adopt Resolution Number 1851. AYES: Anderson, Dreis, Fuhrman, GUIllll'.ere, IIamilton NOES: None Motion carried. RESOLUTION NUMBER l852-CO}IMENDING SAM MQJAZ Resolution Number 1852 was presented to Council entitled, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, A CIIARTER CITY, COm-lENDING SAM MOJAZ FOR ASSISTANCE TO THE CITY BY 'PERFORMING AN ACT OF HEROISM AND OUTSTANDING CITIZENSHIP." It was moved by Gummere, seoond by Dreis, to adopt Resolution Number 1852. AYES: Anderson, Dreil:s, Fuhrman, Gummere, Hamilton NOES: Motion carriet\. None RESOLUTION NUMBER l853-TAX LEVY FOR FIRE PROTECTION Resolution Number 1853 was presented to Council by title, "A RESOLUTION OF THE CITY COUNCIl. OF THE CITY OF SEAL BF.ACn, CALIFORNIA, A CHARTER CITY, PETITIONING THE BOARD OF SUPERVISORS OF THE COUNTY OF ORANGE TO EXCLUDE ALL PROPERTY liITHIN THE INCORPORATED LIMITS OF SAID CITY FROM COUNtY TAX LEVY FOR SUPPORT OF FIRE PROTECTION IN THE COUN'l'Y PURSUANT TO THE PROVISIONS OF GOVERNMENT CODE SECTION 26643. n It was moved by Fuhrman, second by Dreis, to adopt Resolution Number 1853. RESOLUTION NUMBER l854-PROPOSITION 7 BOND INTEREST RATE Resolution Number 1854 was presented for consideration of Council by title, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SF.AL BEACII, CALIFORNIA, A CHARTER CITY, ENDORSING THE PASSAGE OF PROPOSITION . PUC NOTICE It was the order of the Chair, with consent of 'Council, to receive and file the I nottte from the Public Utilities Commission regarding proposed amendment to general order 98A to prohibit smoking aboard equipment of passenger stage corporations operated in this State. PUBLIC HEARTNG SET Tt was the order of the Chair, with consent of Council, to set a public hearing for May 18, 19~0, at 8:00 p.m. in Council Chambers concerning the appeal of Rossmoor Park Apartments, A-2-70, to decision of the Planning Commission. ORDINANCE NUMBER 8l0-AMENDING MUNICIPAL CODE The City Attorney asked that proposed Ordinance Number 810 be held over to next meeting. It was the order of the Chair, with consent of Council, to hold this matter over to next meeting. INSURANCE APPRAISAL PROPOSAL III It was the order of the Chair, with consent of Council, to hold this item over to next meeting as requested by the City Manager. COMPLAINT-CAR WASH The City Manager stated that the tests concerning this item were just received and asked this item be held over for study and report. It was the order of the Chair, with consent of Council, to hold this matter over to next meeting. }~RINA COMMUNI~Y CENTER-ACCEPTANCE Gummere moved, second by Fuhrman, to approve the acceptance of the Marina Community Center. The City Manager's report was read in part and both communications were received and filed. APPROVAL OF DmlANDS Demands numbered 9835 through 9949 of $89,158.62, including payroll df $45,151.91, was presented as approved by the Finance Committee.
