ATTEST: Seal Beach, California May 18, 1970 The City Council of the City of Seal Beach, California met in regular session with Mayor Anderson presiding. The meeting was called to order with the rledge of Allegiance. ROLL CALL , Present: Mayor Anderson Councilmembers Dreis, Fuhrman, Gummere, Hamilton Absent: None APPROVAL OF MINUTES Fuhrman moved, second by Dreis, to approve the minutes of April 20, 1970, and May 4, 1970 as presented. AYES: Anderson, Dreis, Fuhrman, Gummere, Hamilton NOES: None Motion carried. APPROVAL OF DmlANDS Demands numbered 9835 through 9949 of $89,158.62, including payroll df $45,151.91, was presented as approved by the Finance Committee. Fuhrman moved, second by Gummere, that the demands he allowed and warrants drawn on the Treasury for the same. AYES: Anderson, Dreis, Fuhrman, Gummere, Hamilton NOES: None Motion carried. ANNOUNCIDIENT The announcement was made that the Ad Hoc Committee on the Pacific Electric Right-of-Way Study would be hearing evidence pertinent to their study at their next meeting, that those wishing to speak on the matter should present their request in writing to the Committee via the City Manager's Office. PUBLIC HEARING-SURFS IDE STREETS(CONTlNUED) The City Attorney conducted the public hearing concerning enforcement of City ordinances and vehicle code provisions on private roads in Surfs ide Colony. The City Attorney stated that this hearinR was continued so as proper notification of the property owners in the area could be made. The City Clerk certified that such notification had been made on May 5, 1970 pursuant to Section 2205 of the tlunicipal Code. The City Clerk stated that communications had been received from Surfside Colony as listed in their cover letter dated May 13, 1970. No other communications had been received. The City Attorney read proposed ordinance #811 in full for information of the Council and the audience. Sven Lindstrom, 215 14th Street, Seal Beach inquired as to the City's responsibility for the improvements recommended. Mr. Morris, A105, Surfside stated that the recommended easements would be no problem. Joseph Kray, Huntington Beach, spoke on the matter. Roger West, 1201 Electric Avenue, Seal Beach, Julie Dorr, 231 6th Street, Seal Beach, Tom Brady, 1607 Electric Avenue, Seal Beach spoke in opposition. Hal Chauncy, A108 Surfside stated that the Surfside residents would adhere to the recommendations of tIle Police and Fire Departments and they would continue to maintain the roads and beaches. Mr. Morris requested the Council to adopt the proposed ordinance. Members of the Council further discussed the matter with the recommendations of the Fire Chief of prime concern. The City Attorney ruled that to consider contingencies in advance of an ordinance would be out of order. Hamilton requested that, if the ordinance passed, those recommendations be hrought for consideration of Council at next meetinR. Anderson and Gummere spoke in favor of the ordinance. There was no other communication. The Mayor closed the public hearing. ORDINA."ICE NUMBER 811-VEIIICLE CODE FOR PRTVATE ROADS Gummere moved, second by Dreis, to adopt Ordinance Number 811 as read entitled, "AN EMF.RGENC'l ORDINANCE OF THE CITY OF SEAL BEACH PROVIDING FOR APPLICATION OF CALIFORNIA VEIIICLE CODE AND CHAPTER 13 OF THE SEAL BEACH MUNICIPAl. CODE TIffiOUGlI CERTAIN PRIVATE ROADS BY ADDING CHAPTER 13, Al.TICLE XIII TO THE MUNICIPAL CODE." AYES: Anderson, Dreis, Fuhrman, Gummere, lIal1lilton NOES: None Motion carried. ".j"m 5-18-70 1l"{.? -. PRESENTATION Mr. David Baker, Supervisor of the Second District, Orange County, presented the new Orange County Flag to the City. Mayor Anderson accepted for the City. The Mayor called a five minutc recess at 9:05 p.m. The meeting reconvened at 9:10 p.m. PUBLIC IlEARINr..-ROSSNOOR PARK APARTMENTS I The City Attorney stated that this was the time and place for a public hearing to be held concerning the appeal A-2-70 of Rossmoor Park Apartments to decision of Planning Commission. A letter from Robert Hirsch on behalf of the appellant was received requesting Council to delay the hearing. It was the order of the Chair to hold this item to end of meeting. ORAL COMMUNICATIONS Mayor Anderson stated that this was the time for oral communications. Sven Lindstrom, 215 14th Street, Seal Beach requested information relating to the Ad Hoc Committee of the P.E. Right-of-Way Study. Barney Jeffreys, a member of this Committee, and the City Manager spoke to this question. Harry Schuck, 930 Coastline Drive, Seal Beach, Norma Pranter, 3l6~ 14th Street, Seal Beach, Mary Pitt, 1140 Coastline Drive, Seal Beach all requested to speak when Item 14 of the Agenda was being considered by Council. Jack Klempner, 213 13th I fitreet, Seal Beach inquired about matters of public record. Art West, 1201 Electric Avenue, Seal Beach spoke regarding the Ad Hoc Committee for the P.E. Right-of-Way. Study. Gordon Shanks, 215 Surf Place, Seal Beach, requested to be heard when Items 11 and 12 of the Agenda werc considered by Council. Tom Brady, 1607 Electric Avenue, Seal Beach, requested to be heard when Item 11 of the Agenda was considered by Council. There were no other communications. Mayor Anderson declared Oral Communicat4ons closed. MOSQUITO ABATEMENT DISTRICT MINUTES It was the order of the Mayor, with consent of Council, that the ~wsquito Abatement District minutes of April 30, 1970, be received and filed. PUBLIC UTILITIES COMMISSION DECISIONS It was the order of the Mayor, with consent of Council, to receive and file I Public Utilities Commission Decisions: 77169 regarding motor vehicles stopping at r.rade c~ossings, and 77187 regardin~ extensions of electric and communications lines for public utilities underground. 5-18-70 1,49 PUBLIC UTILITIES APPLICATIONS It was the order of the Mayor, with consent of Council, to receive and file Public Utilities Applications: 49835 - increase in rates for General Telephone Company, and 51774 - increase in rates for Pacific Telephone and Telegraph Company. ARMY CORPS OF ENGINEERS-NOTICE I It was the order of the Mayor, with consent of Council, to receive and f.ile the notice from the Army Corps of Engineers of application from Canal Front Property Owners Association, Sunset Beach, to construct bulkhead. LAFCO NOTICE It was the order of the Mayor, with consent of Council, to receive and file the notice from the Local ARency Formation Commission regardinR proposed Annexation Number 51 to the City of Westminster. LOS ALAMITOS NAVAL AIR STATION A resolution from the City of Buena Park requesting the Board of Supervisors to conduct public hearings for any air-related activity proposed for the Naval Air Station at Los Alamitos was received by Council. Gummere moved, second by Anderson, that a similar resolution be prepared for consideration of Council at next meeting. A resolution from the Orange County Board of Supervisors regarding ocean and shoreline development and request~rlg coastal cities to select an elective representative to serve on an ocean and shore line steering committee was received by Council. Dreis moved, second by Anderson, to appoint 11r. John Uamilton to serve on this commi t tee. AYES: Anderson, Dreis, Fuhrman, Gummere, Hamilton NOES: None RESOLUTION NUMBER l855-SAMPLING PUBLIC WATERS I Resolution Number 1855 was presented to Council by title, "A RESOLUTION OF Motion carried. THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, SUPPORTING THE ORANGE COUNTY HEALTH DEPARTMENT IN CONTINUING ITS BACTERIOLOGICAL SAMPLING OF PUBLIC WATERS WITHIN ITS JURISDICTION." Anderson moved, second by Gummere, to adopt Resolution Number l8~5. AYES: NOES: Anderson, Dreis, Fuhrman, Gummere, Hamilton None Motion carried. 5-18-70 \f50 CONFIRMATION OF WEED ABATEMENT ASSESSMENT Ilamilton moved, second by Dreis, to confirm the weed abatement assessment of $48.98 for Lot 18, Block 109, Bay City Tract. I APPLICATIONS-FIREWORKS STANDS Anderson moved, second by Gummere, to approve those applications presented to operate fireworks stands during the July 4th period subject to completion of required forms. ORDINANCE NUMBER 810~DRESSING Ordinance Number 810 was read in full entitled, "AN EMERGENCY ORDINANCE OF THE CITY OF SEAL BEACH, CALIFORNIA, AMENDING CllAPTER lS, SECTION lS-7, OF THE CODE OF THE CITY OF SEAL BEACH, CALIFORNIA, PROHIBITING DRESSING IN AUTOMOBILES, PUBLIC TOILETS, EL CETERA." Gordon Shanks and Tom Brady spoke against the proposed ordinance. The Council discussed the matter. It was the order of the ChAir, with concurrence of the Council, to hold this item over for I further information. PLANNING COMMISSION RESOLUTION 433-UV-3-70 Planning Commission resolution approving Use Variance Number UV-3-70 allowing construction of an eight story hotel on a C-3 Commercial Manufacturing Zone (Narland Corporation) was received by Council. Gord6n Shanks spoke on the matter. Terry Barton, Chairman of the Planning Commission, spole on the matter. Gummere moved, second by Dreis, to affirm Planning Commission Resolution #433. Council. Gummere moved, second by Anderson, to approve the ~ontract and authorize the Mayor to execute same. Discussion followed. 'I 1 I 5-1B-70-ftJ;1 REPORT-CAR WASH The City Manager stated that the data furnished the Council relative to the noise from the Car Wash was an informal report and that another test was scheduled for Thursday on the matter. The Mayor stated that this item could be keptnon the Agenda and those persons wishing to speak on this item could be notified. Mr. Harry Schuck elected to speak at this time. Mr. Schuck quoted from Los Angeles ordinance and resolutions relative to ambient noise and reauested that the next be made on a Sunday. Mr. Mcqueen, owner of the Seal Beach Car Wash, spoke against a Sunday test. Further discussion followed. It was the order of the Mayor, with consent of Council, to hold this item over until completion of the scheduled test. AGREEMENT-PROJECT545-COUNTY OF ORANGE Gummere moved, second hy Dreis, to approve the Memorandum of Agreement between the City of Seal Beach and the County of Orang~ for Project #545, First Street- Marina Drive to Pacific Coast Highway-and authorize the Mayor to execute same. AYES: Anderson, Dreis, Fuhrman, Gummere, Hamilton NOES: None ~otion carried. PUBLIC HEARING-ROSSMOOR PARK APARTMENTS It was noted that Mr. Hirsch was still not present for the hearing continued from earlier in the meeting.
