Seal Beach, California June 1, 1970 The City Council of the City of Seal Beach, California met in re~ular session with ~myor Anderson presidin~. The meeting was called to order with the Pledge of Allegiance to the Flag. ROLL CALL Present: Mayor Anderson I Councilmembers Dreis, Fuhrman, Gummere, Hamilton Absent: None APPROVAL OF MINUTES Fuhrman moved, second by Hamilton, to approve the minutes of May 18, 1970, regular meeting as presented. AYES: Anderson, Dreis, Fuhrman, Gummere, Hamilton NOES: None Motion carried. APPROVAL OF DEMANDS Demands numbered 99S0 through 10063 of $66,815.30 were presented as npproved by the Finance Committee. Fuhrman moved, second by Dreis, that the demands be allowed and warrants drmon on the Treasury for the same. AYES: Anderson, Dreis, Fuhrman, r.ummere, Hamilton I NOES: None Motion carried. PUBLIC HEARINC,..ROSSMOOR PARK APARTMENTS The Mayor stated that this was the time for a public hearing to be held and asked the City Attorney to conduct the hearing. The City Attorney informed the' Council that Mr. Hirsch, the appellant, had telephoned requesting a continuance as he was ill and could not be present. Cummere-:moved, second by Fuhrman, to continue to the public hear~ng to June lS, 1970, at 8:00 p.m. AYES: Anderson, Dreis, Fuhrman, Gummere, Hamilton NOES: None Motion carried. COMMUNICATION-PROPOSITION 7 It was the order of the Chair, with consent of Council, to receive and file the communication from Californians for Yes on 7. PUC NOTICE The notice from the Public Utilities Commission re~arding rate application of the General Telephone Company was received and filed by order of the Mayor. MAYOR CONFERENCEF It was the order of the Mayor, with consent of Council, that the notice of the United States Conference of Mayors be received and filed. APPLICATION REVIEW-SCAG The communication from Southern California Association of Governments regarding City's application for federal grants was received and filed by the order of the Chair, with consent of Council. J.AFCO NOTICE It was the order of the }Iayor, with consent of Council, to receive and file the notice from the Local Agency Formation Commiss!on regarding dissolution of Los Alamitos-Rossmoor County Service Area Number 14. CORPS OF ENGINEERS' NOTICE It was the order of the Mayor, with consent of Council, to receive and file the communication from the Corps of EnBineers for permit to construct a concrete ~roin in Newport Bay. RESOLUTION-HUNTINGTON BF..ACIl-HARBOR DISTRICT Tt was the order of the Mayor, with consent of Council, to receive and file the resolution and communication from the City of Huntington Beach regarding dissolution of the Harbor District as previous action had been taken by this Council on the matter. SENATE BILL 104-STOP SIGNS The resolu~ion from the City of Huntington Beach opposing Senate Bill 104 was received. Fuhrman moved, second by Gummere, that a similar resolution be prepared for consideration of Council. ;. .a k~,-70 1.' fV. i.l .' , JOINT MEETING-CITY OF LOS ALAMITOS The communication from the City of Los Alamitos relative to a joint meeting on matters of mutual interest was received. Anderson moved, second by Fuhrman, that this matter be held over to July when the new Council was seated. AYES: Anderson, Dreis, Fuhrman, Gummere, Hamilton NOES: None Motion carried. COMMUNICATION-TOPICS PROGRA}! The communication from the State Department of Public Works relating to the Topics pro~ram was received. It was the order of the Mayor, with consent of Council, to hold this matter over for further information. APPROVAL ~ AUDITING SERVICES The proposal from Diehl, Evans and Company for auditing services was received. Anderson moved, second hy Gummere, to approve the proposal and authorize the City Manager to execute same. AYES: Anderson, Dreis, Fuhrman, GUllllllere, Hamilton NOES: Motion carried. None REQUE5T FOR TERMINATION OF LEAVE The request from Jerry Schoenenberger, Police Officer, requesting termination of leave of absence was received. Fuhrman moved, second by Dreis, that the request be granted and the leave be terminated on June 15, 1970. AYES: Anderson, Dreis, Fuhrman, Gummere, Hamilton NOES: Motion carried. None APPF~ - PLAN REVIEW PR 16-70 The appeal of Grant n. Hornbeak, 468 Schooner Way, Seal Beach, to Planning Commission decision on Plan Review PR-16-70 was received. The City Attorney presented a letter from the Architectural Review Board approving the proposed chan~e. Discussion followed. Hamilton moved, second by Fuhrman, to uphold the Planning Commission decision. Terry Barton, Chairman of the Planninp, Commission, stated that thelletter from the Architectural Review Board was not presented to the Commission. Ralph Jensen, 247 Corsair Way, authorized agent for the appellant, spoke for granting the appeal. Further discussion followed. }~. Hamilton with- drew his motion with consent of the second and moved that this matter be referred back to the Planning Commission as nm. evidence had been presented at this time. James Terry, 401 Galleon Way, Ellsworth Carlston, 319 Galleon Way, Robert Gerrity, 425 Galleon Way, Jack Reese, 424 Corsair Way, Gary Donaldson, 448 Schooner Way spoke for ~ranting the appeal. AYES: Anderson, Dreis, Fuhrman, Gummere, Hamilton I NOES: None RESOLUTTON NUMBER l856-LOS ALAMITOS AIR STATION ~fotion carried. Resolution Number 1856 was presented by title, "A RESOLUTION OF TilE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, REQUESTING THE ORANGE COUNTY BOARD OF SUPERVISORS TO CONDUCT PUBLIC HEARINCS FOR ANY AIR-RELATED ACTIVITIES PROPOSED BY THE COUNTY AT TIlE NAVAL AIR STATION, LOS ALAr-IITOS." Fuhrman moved, second by Dreis, to adopt Resolution Number 1856. AYES: Anderson, Dreis, Fuhrman, Cummere, Hamilton NOES: None COMM[nIICATION-ZONE CODE VIOLATIONS Motion carried. A communication from Edward A. ~ischell. 1603 Ocean Avenue, relative to possible violation of zoning code was received. Discussion followed. Anderson moved, second by Fuhrman, that the Building Inspector be directed to inspect those units named for such violations. III John Bender, 213 16th Street, spoke relative to possible violations of the zoning code. AYES: Anderson, Dreis, Fuhrman, Gummere, Hamilton NOES: None COMPLAINT-CAR WASH Motion carried. A report was received regarding the complaint on the noise from the Seal Beach Car Wash. A communication from Mrs. Schuck on the matter was received. Mrs. Pranter presented~pet~tions on the matter to the Council for the record. Donald Salem spoke on the matter. Mrs. Schuck spoke on the matter. Discussion followed. Gummere moved, second by Dreis, to accept the report of Ogden Laboratories regarding noise level of the car wash. AYES: Anderson, Dreis, Cummere, Hamilton 1 NOES: Fuhrman Motion carried. RESOLUTION NUMBER l857-SURFSIDE PARKING Resolution Number 1857 was presented to Council by title; "A RESOLUTION OF TIlE CITY COUNCIL OP THE CITY OF SEAT. BEACH RESTRICTING AND PROHIBITING CURB PARKING ON PORTIONS OF THE STREETS IN THE SURFSIDE AREA IN THE CITY OF SEA!. BEACH." Gummere moved, second by Hamilton to adopt Resolution Number 1857. AYES: NOES: Anderson, Dreis, Fuhrman, Gummere, lIamilton None }fotion carried. ..a r.1i'-1-70 , \"" l AGREEMENT-SCHOOL DISTRICT-LIGHTING The amended agreement with the Seal Beach School District for softball diamond lighting was presented for consideration of Council. Anderson moved, second by Hamilton, to approve the agreement as amended. AYES: Anderson, Dreis, Fuhrma~, Gummere, Hamilton NOES: None Hotion carried. I CLAIM-BEATRICE HAWKINS The claim for personal injuries from Beatrice Hawkins was received by Council. The City Attorney recommended that the claim be denied and the claimant and the Insurance carrier be notified of Council action. Hamilton moved, second by Fuhrman, to deny the claim as recommended by the City Attorney. PROGRESS REPORT-CITY }~NAGRR It was the order of the Mayor, with consent of the Council, to receive and file the report from the City ManaRer on the ProRress of the City, with commendations.
