Bahorski, City Manager FROM: Lee Whittenberg, Director of Development Services SUBJECT: STUDY SESSION — NEWSRACK REGULATIONS SUMMARY OF REQUEST: Conduct Study Session and provide direction to City Staff. BACKGROUND: Newspaper vending machines ( "newsracks ") on public sidewalks are a means of distributing speech that cannot be wholly prohibited by a community. Unfettered discretion over which publishers may place newsracks on public property and where the newsracks may be placed is also an unconstitutional prior restraint. The area of newsrack regulation has been extensively litigated throughout the country. Regulations regarding newsracks must be tailored to address certain constitutional issues. Regulations must: ❑ Be content - neutral — regulations cannot be based upon the content of the publication. (In addition, there are separate provisions of State law that regulate the display and sale of "harmful matter" as defined in the Penal Code.) ❑ Qualify as advancing a "substantial governmental interest ". ❑ Be narrowly tailored to promote a substantial governmental interest, such as safety — regulations cannot be overbroad. ❑ Allow for a reasonable number of locations for distribution of speech. The regulation of newsracks within a community is an area of ongoing controversy. Media publications often challenge newsrack regulations. Current Code Requirements: The City currently regulates the location of newsracks on public property through Chapter 11B of the Code of the City of Seal Beach ( "Code ") (a copy is provided as Attachment 1 for the information of the City Council). This chapter of the Code was adopted in 1990 and needs revision. The City is undergoing a complete revision to the Code, and the City Council has directed staff to proceed with this portion of the Code at this time. Study Session Issues for Council to Provide Direction to Staff: In preparing revisions to Chapter 11B there are several areas of policy direction the Council needs to provide to staff in the formulation of updated requirements. The Council should focus on the following major policy issues during this scheduled workshop: Policy Direction Requested re: Proceed with Revisions to current Code Requirements: The City Council as a body should initially provide direction as to whether the Council wishes staff to proceed with proposed revisions to the current Code requirements regarding newsracks. The cities which have avoided litigation have invited media representatives to participate in the initial stages of the process, and have undertaken a sometimes lengthy dialogue where the rights of free speech and providing reasonable access by the public to the speech are balanced with advancing the substantial governmental interests of safety, etc. Once again, any regulations adopted must be narrowly tailored to advance the identified substantial governmental interests. Maintaining the status quo has its own share of issues. If the City Council were to determine to not proceed with revisions to the current provisions of Chapter 11B, the Council needs to address the enforceability of the current Code provisions. The current regulations have not been enforced in a consistent manner. Both options— Proceeding with amendments to the current newsrack regulations or conducting an enforcement action regarding the existing newsrack regulations —will result in allocation of staff and City Attorney resources not currently allocated for these work tasks. It is unknown at this time as to the amount of staff resources that may be required to respond to the direction of the City Council. Upon direction being given by the City Council, staff will provide an estimate of the necessary staff allocations necessary to complete the desired action of the City Council. Other Community Actions regarding Regulation of Newsracks: The City Attorney has recently assisted the City of Buena Park in revising its newsrack requirements and has prepared a "preliminary draft" revision to the Seal Beach Code (Please refer to Attachment 2) based on certain provisions of the Buena Park ordinance. Based on the major provisions of the "preliminary draft" revision to the Seal Beach Code, staff is seeking policy direction from the City Council on the following major provisions of the "preliminary draft" revision to the Seal Beach Code: Study Session Staff Report CC 2 Study Session — Newsrack Regulations City Council Staff Report July 22, 2002 ❑ What areas of the City should be subject to newsrack regulations? Staff recommends that all areas of the City be subject to specified provisions regarding the location of newsracks on public property. However, staff would recommend development of a two- tiered regulation process. One set of regulations would establish controls within the "Main Street Specific Plan" area, and the other set of controls would apply to all remaining areas of the City. This approach would allow for greater control by the City of newsracks within the Main Street area, where major issues regarding spacing, design, and pedestrian safety issues exist due to the high pedestrian traffic levels, the existence of diagonal parking along the streets, extensive encroachments into the existing sidewalk areas, and the high concentration of existing newsracks within this area. There are currently no provisions within the "Main Street Specific Plan" regarding newsracks, and staff would recommend that if new regulations are considered by the City regarding newsracks that amendments be prepared for concurrent consideration to ensure consistency with the Specific Plan and any ordinance adoption. The remaining areas of the City do not experience the high pedestrian traffic levels, diagonal parking, extensive encroachments into the sidewalk area, or the high concentration of newsracks as does Main Street. Staff would recommend formulating a different set of standards for these substantially different areas of the community. Staff will need to conduct additional field surveys of these areas prior to formulating proposed standards and procedures for those areas outside of Main Street. ❑ Shall the City own the newsracks? Within the Main Street area, staff is recommending the City Council proceed with the proposed Code revision to include provisions that the City of Seal Beach will be the owner of the actual newsracks and will be responsible for the location and maintenance of the newsracks. This will allow the City to assure uniformity in design, proper location, and appropriate maintenance of the newsrack structures. Under this scenario, the City would install the newsrack structures and then issue a "license" to a publication distributor /publisher to use certain newsrack locations, with a license fee paid to the City that would be established to recover the initial capital expenditures involved in acquisition and installation of the newsrack structure and the long -term amortization, maintenance and replacement costs of the newsracks. The license fee would be established by the City Council to recover actual and related overheard costs discussed above and would be paid on a yearly basis in conjunction with the business license renewal process. License fees greater than those reasonably necessary to recover the discussed costs would raise constitutional issues. In the remaining areas of the City staff would recommend the City establish one to three approved newsrack designs that will allowable and appropriate location criteria. Study Session Staff Report.CC 3 Study Session — Newsrack Regulations City Council Staff Report July 22, 2002 The organization wishing to place a newsrack in these areas would obtain the necessary design, location and other required approvals and then locate their own approved newsrack at the approved location. Again, a license fee for the use of City property would be imposed each year at the time of business license renewal. The license fee in these areas would be substantially different than from the Main Street area, as there would be no acquisition, installation, amortization or maintenance costs incurred by the City. ❑ Establishing Approved Design/Location Criteria: ❑ Uniform Design Standards: Staff would recommend for Main Street that all newsracks shall be of a uniform design approved by the City and installed by the City. Based on a review of the current number of newsracks located within the Main Street Specific Plan area (approximately 123 existing in the three block area), it is recommended that grouped newsracks only be allowed, with a maximum of 4 double newsracks provided at a single location, which would mean that there would be space for eight publications at each grouping. ❑ Location Standards: Staff recommends that the Council consider establishing the allowable maximum number of newsracks on each block face along Main Street, Ocean Avenue, Central Avenue, Electric Avenue and Pacific Coast Highway, consistent with providing a forum for each currently existing lawfully placed publication. According to a preliminary survey, approximately 123 publications (including multiple duplication) are currently located in newsracks existing in the three - block area. A preliminary review of the location criteria set forth in the - "preliminary draft" ordinance has been prepared by the Engineering Department and mapped in an attempt to graphically depict the extent of areas that may be possible locations for newsracks under the proposed ordinance location criteria (Please refer to Attachment 3). As noted above, it is recommended that grouped newsracks only be allowed, with a maximum of 4 double rack installations. Based on a preliminary review of that graphic information, and without detailed field verification of the information so presented, the following location criteria is proposed for Council concurrence: . ❑ Maximum of 24 newsracks permitted along each .block face of Main Street between Pacific Coast Highway and Ocean Avenue, with a minimum 100 -foot separation between newsrack installations. This would allow a maximum of 24 newsracks on each side of Main Street in the 100, 200, and 300 blocks. ❑ Maximum of 4 newsracks permitted along each block face of the northerly side of Ocean Avenue, each side of Central Avenue, each side of Electric Study Session Staff Report.CC 4 Study Session — Newsrack Regulations City Council Staff Report July 22, 2002 Avenue, and the southerly side of Pacific Coast Highway between Main Street and the adjoining alleys. ❑ These criteria would allow a maximum of 144 newsracks along Main Street and a maximum of 48 newsracks along the cross streets; allowing a total maximum of 192 newsracks. ❑ The criteria would provide a sufficient maximum number of newsracks within the Main Street Specific Plan area to allow all currently existing publications to be accommodated within the proposed new newsrack locations, and provide sufficient additional capacity to accommodate future requests from new publications for newsrack locations. ❑ All of the above described newsracks would not be initially installed. There would be a sufficient number installed to accommodate all current users of newsracks, and additional installations would then occur as requests for additional spaces are received by the City. What Future Actions are Necessary to Proceed with the Revision Process? If the City Council authorizes staff to develop a proposed ordinance revision, the following additional actions will be undertaken by Staff in formulating and preparing proposed Code amendments for formal City Council consideration: ❑ Detailed field mapping of current newsrack locations, including verification of compliance of each newsrack with current provisions of the Code. ❑ Preparation of revised "preliminary draft" regulations based on City Council direction on the above - discussed issue points. ❑ Initiation of discussions with impacted publishers /distributors of publications currently located within newsracks in the City to present City proposals, receive comments and concerns, and revise "preliminary draft" regulations as determined appropriate. ❑ Provide updates to City Council as appropriate during the discussion process with impacted publishers /distributors of publications. ❑ Conduct additional City Council study sessions as determined appropriate. ❑ Place the ordinance on the City Council agenda for Council consideration. ❑ Schedule a public hearing before the City Council to formally consider any proposed revisions to the current Chapter 11B Code provisions. Study Session Staff Report.CC 5 Study Session — Newsrack Regulations City Council Staff Report July 22, 2002 FISCAL IMPACT: Proceeding with amendments to the current newsrack regulations or conducting an enforcement action regarding the existing newsrack regulations will result in allocation of staff and City Attorney resources not currently allocated for these work tasks. It is unknown at this time as to the amount of staff resources that may be required to respond to the direction of the City Council. It is estimated that the process outlined above would entail a 6 to 15 month process to complete. Upon direction being given by the City Council, staff will provide an estimate of the necessary staff allocations necessary to complete the desired action of the City Council. Staff does not believe that the proposed program will result in revenues to the City over and above those necessary to recover the direct and indirect costs of acquiring, installing, maintaining and replacing the newsrack structures. Constitutional issues arise if the license fees exceed the reasonable necessary to cover those costs. RECOMMENDATION: Conduct Study Session and provide direction to City Staff. As used in this chapter, "newsrack" means any self - service or coin - operated box, container, storage unit or other dispenser installed, used, or maintained for the display or sale of any written, photographic, or printed material, including, but not limited to, newspapers or news periodicals. (b) Street. As used in this chapter, "street" means all that area dedicated to public use for public street purposes and shall include, but not be limited to, roadways, parkways, and alleys. (c) Roadway. As psed in this chapter, "roadway" means that portion of a street improved, designed, or ordinarily used for vehicular travel. (d) Parkway. As used in this chapter, "parkway" means that area between the sidewalks and the curb of any street, and where there is no sidewalk that area between the edge of the roadway and the property line adjacent thereto. Parkway shall also include any area within a roadway which is not open to vehicular travel. (e) Sidewalk. As used in this chapter, '!sidewalk "" means any surface provided for the exclusive use of pedestrians. (f) Person. As used in this chapter, "person" means any individual, partnership, firm, association, corporation or other legal entity. 2400 , (Seal Beach 12/90) S 118-1 Seal Beach City Code S 11B-2 (g) Custodian. As used in this chapter, "custodian" means any person or persons who have the responsibility of placing, servicing or maintaining a coin - vending newsrack machine by depositing and /or removing material from said machine aryl /or by collecting monies from said machines. (Ord. No. 981, S1(part)) Section 11B-2. Installation: Use; Maintenance. (a) No person shall install, use or maintain any newsrack or other structure which projects onto, into or over any part of the roadway of any public street, or which rests, wholly or in part, upon, along or over any portion of the roadway of any public street. (b) No person shall install, use or maintain any newsrack which, in whole or in part, rests upon, in or over any public sidewalk or parkway when such installation, use or maintenance endangers the safety of persons or property, or when such site or location is used for public use, or when such newsrack unreasonably interferes with or impedes the flaw of pedestrian or vehicular traffic, including any legally parked or stopped vehicle, the ingress into or egress from any residence or place of business, or the use of poles, posts, traffic signs or signals, hydrants, mailboxes, or other objects permitted at or near said location, or when such newsrack interferes with the cleaning of any sidewalk by the use of mechanical sidewalk - cleaning machinery. Notwithstanding any other provision of this subsection, no newsrack shall be placed, installed, used or maintained. (1) Within ten feet of the point of intersection of the edge of a marked crosswalk and the curbline; (2) On or within fifteen feet of any sidewalk return at any street corner; (3) On those sidewalks that have been designated as official bicycle routes; (4) Within fifteen feet of any fire hydrant, fire call box, police call box or other emergency facility; (5) Within fifteen feet of any driveway; (Seal Beach 12/90) 2401 S 118-2 Newsracks S 118-3 • (7) Within six feet of any bus bench; (8) Within five feet ahead and twenty -five feet to the rear of any designated bus stop; (9) Within five feet of any curb which has legally been painted yellow, white or green for the purpose of regulating parking; (10) In any location whereby the cross space of the passageway of pedestrians on the sidewalk is reduced to less than five feet; (11) Within three feet of the imaginary lines that could be formed by extending the width of the entrance to a structure along lines perpendicular to the edge of the curb or its vertical extension; (12) Within three feet of any area improved with lawn, flowers, shrubs or trees or within three feet of any display window of any building abutting the sidewalk or parkway or in such manner as to impede or interfere with the reasonable use of such window for display purposes; (13) In any manner so as to obstruct or impede access to the sidewalk, or a person going to or from an automobile. (Ord. No. 981, S1(part)) Section 11B -3. Standards. Any newsrack which, in whole or in part, rests upon, in or over any public sidewalk or parkway, shall comply with the following standards: (a) Size. No newsrack shall exceed four feet in height, thirty inches in width, or two feet in thickness. (b) Location. Newsracks shall only be placed near a curb or adjacent to the wall of a building. Newsracks placed near the curb shall be placed no less than eighteen inches nor more than twenty -four inches from the edge of the curb. Newsracks placed adjacent to the wall of a building shall be placed parallel to such wall and not more than six inches fraan such wall. No newsrack shall be placed or maintained on the sidewalk or parkway opposite a newsstand or another newsrack unless it is more than one hundred feet from the nearest opposite newsstand or newsrack. 2402 (Seal Beach 12 0) S 11B-3 Seal Beach City Code S 11B -5 (c) Attachments. No newsrack shall be chained, bolted or otherwise attached to any property not awned by the owner of the newsrack, or to any permanently fixed object, without submitting written permission from the owner of the property or object to the City. Newsracks may be chained or otherwise attached to one another; however, no such group of newsracks which extends more than nine feet may be joined together in this *manner, and a space of no less than three feet shall separate each group of newsracks so attached. No newsrack or group of attached newsracks allowed under this subsection shall weigh, in the aggregate, in excess of one hundred twenty -five pounds when empty. (d) Frames. All newsracks shall be situated on a frame and casing that meets the standards on file with the city, and which are open to public inspection. The frames and casings shall be placed in accordance with all provisions and standards adopted by the City. (Ord. No. 981, Sl(part)) Section 11B -4. Advertising. No newsrack shall be used for advertising signs or publicity purposes other than that dealing with the display, sale - or purchase of the written, photographic, or printed material, including, but not limited to newspapers or news periodicals, sold therein. (Ord. No. 981, S1(part)) Section 11B -5. Harmful Matter or Offensive Material. (a) Harmful Matter. (1) No person shall sell, offer for sale, or keep or maintain for sale any harmful matter, as such term is defined in Section 313, Chapter 7.6, Title 9, Part I of the Penal Code of California, in any newsrack on any public sidewalk unless - such sale or offer of sale is made or such matter is kept or maintained in the presence and under the supervision of an adult person authorized to prevent the purchase of such matter by a minor. (2) No person shall knowingly sell or offer to sell, within five hundred meters of any elementary school, high school, or public playground, or any part thereof, in any coin or slug operated vending machine or mechanically or electronically controlled vending machine which is located on a public sidewalk, any harmful matter displaying to the public view photographs or pictorial representations of the commission of the following acts: Sodomy, oral copulation, sexual (Seal Beach 12/90) 2403 S 11B-5 Newsracks S 11B-6 intercourse, masturbation, bestiality, or a photograph of an exposed penis in an erect or turgid state. (b) Offensive Material. No person shall sell, offer for sale, or keep or maintain any written, photographic or printed material including, but not limited to newspapers or news periodicals in any newsrack or on any sidewalk in such manner as to expose to the public view any of the following: (1) Any statements or words describing explicit sexual acts, sexual organs, or excrement, where such statements or words have as their purpose or effect sexual arousal, gratification, or affront; (2) Any picture or illustration of genitals, pubic hair, perineums, anuses, or anal regions of any person where such picture or illustration has as its purpose or effect sexual arousal, gratification, or affront; (3) Any picture or illustration depicting explicit sexual acts where such picture or illustration has as its purpose or effect sexual arousal, gratification, or affront; (4) "Explicit sexual acts," as used in this chapter, means depictions of sexual intercourse, oral copulation, anal intercourse, oral -anal copulation, bestiality, sadism, masochism, excretory functions in conjunction with sexual activity, masturbation or lewd exhibition of the genitals, whether any of the above conduct is depicted or described as being performed alone or between members of the same or opposite sex or between humans and animals, or other act of sexual arousal involving any physical contact with a person's genital, pubic region, pubic hair, perineum, anus or anal region. (Ord. No. 981, S1(part); Ord. No. 1019, S1) Section 11B-6. Maintenance. (a) Each newsrack shall be maintained in a clean and neat condition so as not to become mechanically inoperable or have cracked or broken coverings or casings. The newsrack shall be painted or covered with a protective coating so as to keep it from rust. 2404 (Seal Beach 12/90) S 11B-6 Seal Beach City Code • S 11B-9 (b) No issue or edition of any publication shall be allured to remain in any newsrack for a period in excess of four consecutive days past the date the next issue is published or disseminated, whichever is sooner. - (c) No newsrack shall remain in a condition wherein it does not contain the publication which it is designated to disseminate for a period of five consecutive days or longer. (Ord. No. 981, Sl(part); Ord. No. 1019, S2) Section 11B -7. Identification. (a) Within thirty days after the ordinance codified herein bees effective, every person or custodian who places or maintains a newsrack in the City shall have his or its name, address and telephone number affixed thereto in a place where it may be easily seen. If the person or custodian is a corporation, then the name, address and telephone number of the distributor must be affixed in a place where it can be easily seen. (b) Within thirty days after the ordinance codified herein becomes effective, if any coin-vending newsrack machine is not properly identified as to the owner or custodian thereof, a copy of Section 11B-7 of the Seal Beach Municipal Code shall be sent by certified mail, return receipt requested, to the publisher of the publication sold in the machine, and a copy of said section will be posted on said machine. (Ord. No. 981, S1(part)) Section 11B -8. Indemnification. Every person or custodian who places a newsrack on public property in the City shall file a written statement with the City Clerk satisfactory to the City Attorney, whereby he agrees to indemnify and hold harmless the City, its officers, directors or employees from all loss, liability or damages, including expenses and costs, for bodily or personal injury and for property damage sustained by any person as a result of the location, installation, use, maintenance, removal or storage of such newsrack within the City. (Ord. No. 981, S1(part)) Section 11B -9. Business License Required. It shall be unlawful for any person or custodian, whether as a principal or agent, clerk or employee, either for himself or for any other person or body corporate or as an officer of any corporation or otherwise, to place or permit the placement of any publication in a newsrack within the City unless either the said person (Seal Beach 12/90) 2405 S 11B-9 Newsracks S 11B-1O r or custodian or the publisher of any written, photographic or printed material stored or dispensed in a newsrack has a valid business license with the City. (Ord. No. 981, S1(part)) Section 11B -10. Notice: Removal: Storage. (a) Notice. If any public officer designated by the City Manager determines that a newsrack is installed, used or maintained in violation of the provisions of this chapter or that a newsrack displays offensive or harmful matter in violation of the provisions of this chapter, he shall take reasonable steps to notify the owner or custodian thereof as follows: (1) The newsrack is in violation of the provisions of this chapter for reasons set forth in said notice; and (2) The owner or custodian must within three days of receipt of notice remove the newsrack or the offensive or harmful matter; or (3) The owner or custodian must within three days of receipt of notice request in writing that the City Manager set a hearing within five days thereafter to determine upon sworn testimony whether the newsrack, or the offensive or harmful matter displayed within it, violates the provisions of this chapter; and (4) The public officer shall remove the newsrack or the offensive or harmful matter and store it as provided in subsections (b) and (c) unless the owner or custodian removes the newsrack or the offensive or harmful matter pursuant to part (2) of this subsection or requests a hearing pursuant to part (3) of this subsection. (b) Removal. After complying with the notice requirements provided for in subsection (a), the public officer shall remove the newsrack or the offensive or harmful matter displayed within it unless the owner or custodian removes the newsrack or the offensive or harmful matter displayed within it or requests the hearing as provided in subsection (a). If the City Manager determines at said hearing that the newsrack or the offensive or harmful matter displayed within it violates the provisions of this chapter, the owner or custodian of the newsrack shall within twenty -four hours after the decision remove the newsrack or the offensive or harmful matter displayed within it. Section 11B-2 Definitions. • For the purposes of this chapter, the words and phrases set forth in this section shall be construed as defined herein unless the context clearly indicates a different meaning is intended, or unless a different meaning is specifically defined for such word or phrase. (b) "Block" means that public right -of -way abutting on one side of a street and lying between the two nearest intersecting streets or between the nearest intersecting street and the termination of such public right -of -way. (c) "City- approved newsrack model" means the standard K -Jack Engineering Company model series 50, or an equivalent model approved by the director, painted .a color, equivalent to K -Jack Engineering Company "Mack Truck Green." (d) "Curb" means the raised edge adjacent to a roadway between thesidewalk znd the roadway. (e) "Department" means the development services department. - (f) "Director" means the director of development services or the, designee thereof. • (g) "Driveway approach" means the portion of a public right -of -way, including curb returns or depressed curbs, providing vehicular access to , private roadway, building or other facility. (h) "Explicit sexual acts" means depictions of• sexual 'intercourse, oral copulation, anal intercourse, oral -anal copulation, bestiality, sadism, masochism or excretory functions in conjunction with sexual activity, masturbation,,or lewd .exhibition of genitals, whether any of the above conduct is depicted or described'as being performed alone or between members of the same or opposite sex or between humans and animals, or any other act of sexual arousal involving any physical contact with a person's, genitals, pubic region, pubic hair, perineum, anus or anal region. (i) " Newsrack" means any self - service or coin - operated box, container, storage unit or other dispenser installed, used or maintained for the display, sale or distribution of a publication. • (j) "Owner.?= =,means the person to whom a newsrack permit is issued. For purposes of this chapter, "owner' = shall be synonymous with permittee. (k) ' Parkway" means that area between the sidewalk and the curb of a street. Where .�, there is no sidewalk, "parkway" means that area between the edge of the roadway and the ro pperty line adjacent thereto. "Parkway" includes any roadway area that is not open to vehicular travel. • (1) "Public right -of -way" means any place of any nature that is dedicated to use by the public for pedestrian or vehicular travel. "Public right -of -way" includes without limitation: DRAFT (07/22/02) 697714.1 - Page 2 of 11 - a street, sidewalk, curb, gutter, intersection, parkway, highway, alley, lane, mall, court, way, avenue, boulevard, road, roadway, viaduct, subway, tunnel, bridge, thoroughfare, park, square or any similar public way. (m) "Roadway" means that portion of a street improved, designed or ordinarily used for vehicular travel. (n) "Sidewalk" means any surface improved, designed or ordinarily used for pedestrian travel. (o) "Street" is defined as set forth in California Vehicle Code Section 59 •'< . Section 11B -3 Newsrack Permit. (a) Requirement. No person shall place a newsrack on any public right -of -way without first obtaining a newsrack permit for such newsrack. .ti �w (b) Application. Applications for newsrack permits shall be filed with the director upon a city - provided form. The application shall be signed by the applicant and shall contain the following information: `' (1) Name, address and telephone number of the applicant. • (2) Brand name of the newsrack and a description of how it will be installed. (3) A precise diagram "showing the proposed location for the newsrack and the location and number of all other newsrac existing on the same block. (4) The name of the publication to be contained in the newsrack. (5) A city attorney - approved written statement obligating the applicant to indemnify, defend, and hold harmless the city and its officers, employees and agents against any and all claims, demands :losses, costs, expenses, obligations, liabilities, damages, recoveries, and deficiencies that the .city»shall incur or suffer as a result of the applicant's newsracks. Such obligation shall include payment of interest, penalties and reasonable attorneys fees. . 11 6) A certificate of endorsement evidencing that a comprehensive liability insurance policy has been issued for the period of the requested newsrack permit by an insurance company that both (i) is admitted and licensed to do business in the State of California; and (ii) is rated A or better according to the most recent A.M. Best Co. Rating Guide. The policy limits of ' such insurance shall not be less than $1,000,000.00 combined single limit or equivalent. Such 'policy shall name the city as an additional insured; shall specify that it acts as primary insurance arid= °that no insurance held or owned by the designated additional insureds shall be called upon to cover a loss; and shall contain a provision that no termination, cancellation or change of DRAFT (07/22/02) 697714.1 - Page 3 of 11 - coverage of insured or additional insureds shall be effective until after 30 days notice thereof has been given in writing to the director. (7) Business License. Every applicant for a newsrack permit shall present proof of receipt of a business license or proof of application for such license. (c) Fee. Each newsrack permit application shall be accompanied by a nonrefundable application fee. This fee shall be established by city council resolution and shall not exceed the actual cost of processing a newsrack permit application. (d) Approval or Denial. The director shall, within 10 city business days of the of an application, approve and issue a newsrack permit if there are no grounds fodenial; otherwise the permit shall be denied. Notice of the approval or denial of thepermit shall be given to the applicant in writing. If the application is denied, the - director shall attach to the notice a statement of the reasons for the denial. The times set forth in this section shall not be extended except upon written consent of the applicant. (e) Grounds for Denial. The director may deny an application for a newsrack permit for any of the following causes: (1) Failure to complete the application (2) Knowing submission of a' fraudulent statement of material fact. (3) Failure to comply with the placement or concentration standards of this chapter. (4) The proposed newsrack.is not the city- approved newsrack model. (5) Within l,year pn 'or to the date of the application, the city has impounded a newsrack previously maintains 1 by the applicant on the block listed in the application. (f) Term. Each newsrack permit shall be valid for one year from the date of issuance unless revoked. ,.,,, • (g) Appeals.' Any interested person may request an administrative hearing regarding the issuance, • dema1i of issuance, renewal or denial of renewal of a newsrack permit. Newsracks located on public right -of -way shall comply with the following placement standards: (a) Newsracks shall not be placed: (1) Within 20 feet of any marked crosswalk; r . , ate (2) Within 20 feet of the curb return of any unmarked crosswalk; (,.* (3) Within 15 feet of any driveway approach; _ " (4) Within 10 feet of any fire hydrant, fire call box; •police,call box or other emergency facility; (5) Within 10 feet ahead of and 40 feet to the rear of any sign marking a designated bus stop; (6) Within 10 feet of any bus bench orbus shelter; (7) Within 10 feet of any mailbox; utility pole, telephone pedestal or any other permanent fixture located in the public rightaof; way4 (8) Within three feet ofany area improved with lawn, flowers, shrubs or trees; (9) Within the feet of any display window of any building abutting the sidewalk or parkway or in such "a 'planner as to impede or interfere with the reasonable use of such window for display purposes; (10) At any location whereby the clear space for the passageway of pedestrians is reduced to lescthan four feet; (4°°1) / At, any location whereby the clear space for the passageway of pedestrians is reduced to 1ess,:than five feet for a length of more than thirty feet; * (1 Adjacent to or on the curb abutting any fire access lane; DRAFT (07/22/02) 697714.1 - Page 5 of 11 - (13) Within the limits of any portion of curb painted yellow, white or green. (b) Newsracks shall be placed between 18 inches and 24 inches from the curb. (c) No newsrack shall unreasonably interfere with or impede the flow of pedestrian or vehicular traffic. No newsrack shall interfere with the cleaning of any sidewalk by the use of mechanical sidewalk cleaning machinery. s (e) No newsrack shall project into a roadway. (f) No newsrack shall interfere with or impede ingress4nto,4r egress from any residence or place of business. x' Section 11B -5 Concentration Standards. ,,4'4 Newsracks located on public right -of -way shall comply.with the following concentration standards: (a) No more than 16 newsracks shall be located on any one block. No more than eight newsracks shall be located within a space,, of feet in any direction within the same block. (b) At each location having two or more newsracks, the newsracks shall be vertically stacked in groups of two. :: (c) No newsrack used for the distribution of a particular publication shall be placed, installed, used or maintained within Apace of 200 feet in any direction of another newsrack used for the distribution of.tlte same' publication on the same block. This prohibition shall be inapplicable, and the director shalt not deny a newsrack permit due to noncompliance with this prohibition, if the director•finds that less than eight newsracks have been located within a space of 200 feet in any direction on that block at that location for a period of 60 days or more. Section 11B- &Operafidn Standards. • Newsracks located on public right -of -way shall comply with the following operation .standards: (a) . Newsracks shall be the city- approved newsrack model. APF • (b) Each newsrack shall have conspicuously affixed thereto the name, address and telephone number of the owner thereof. DRAFT (07/22/02) 697714.1 - Page 6 of 11 - (c) Each newsrack shall have conspicuously affixed thereto the annual permit tag issued by the department. (d) No newsrack shall be abandoned. (e) The liability insurance required by this chapter shall not be reduced or cancelled (f) No newsrack shall contain an advertising sign. Notwithstanding the preceding, the name and logo of the publication distributed in a newsrack may be stenciled upon the front and back of such newsrack. (g) No newsrack shall be chained, bolted or otherwise attached t any " property without the express written permission of the owner of such property:° Notwithstanding the preceding, each newsrack shall be bolted to the sidewalk upon which it is maintained unless it is vertically stacked upon another newsrack pursuant to this chapter. N4 . t$ (h) Each newsrack shall be maintained in a clean and neat - condition and in good repair at all times. The owners of vertically stacked newsracks, shall be jointly responsible for maintenance of the shared components of such newsracks. ,,Occurrence of any of the following conditions on a newsrack shall constitute evidence that the newsrack is not being maintained in a clean and neat condition or in good repair: (1) Graffiti. (2) Broken or unreasonably misshapen structural components. (3) Cracks, dents or discoloration of the display window. (4) Substantial accumulation of dirt, grease rust or corrosion. (5) Substantial amount of chipped, faded, peeling, or cracked paint. (6) Substantial amount of tearing, peeling or fading of any paper or cardboard parts or inserts of the newsrack. (i) 4 Publications offered for sale in the newsrack shall not be displayed or exhibited in a manner that exposes to public view from any public right -of -way any of the following: (1) Any statements or words describing explicit sexual acts, sexual organs or ' excrement ''where such statements or words have as their purpose or effect sexual arousal, ,gratification or affront. • DRAFT (07/22/02) • 697714.1 - Page 7 of 11 - (2) Any picture or illustration of genitals, pubic hair, perineum, anus or anal region of any person where such picture or illustration has as its purpose or effect sexual arousal, gratification or affront. (3) Any picture or illustration depicting explicit sexual acts where such picture or illustration has as its purpose or effect sexual arousal, gratification or affront. .- Section 11B -7 Transition Program. 4' ; •r,r • (a) Owners of newsracks lawfully placed on public right -of -way as of the effe date of this section shall have 60 days from such date to re -apply for a newsrack.ppeAit for each such newsrack and to bring each approved newsrack into compliance with this chapter. l tr (c) Location prioritization. The director shall approve newsracks by lottery in the event that both (i) two or more publications seek the same location` for a newsrack; and (ii) there is insufficient space at the location to accommodate all such publications. The lottery shall be conducted by placing into a container the names of all of the applicants and.drawing names from the container one at a time until the number of available newsrack spaces at the location reaches zero. The director shall give advance written notice to the applicants of the time and place of the lottery, and shall allow members of the public to witnessthe - lottery., (d) Height prioritization. In determining which. publications shall be permitted in the upper newsrack space at a particular location: for :which..demand for upper newsrack space exceeds supply, the director shall approve applications on:a first -come, first - served basis. Section 11B -8 Summary Impoundment. _ '' The director may summarily impound any newsrack that poses an imminent danger to pedestrians or vehicles. On the day. of such impoundment, the department shall send the owner identified on the newsrac notice of the seizure and the opportunity for an administrative hearing. If the owner files a written hearing request with the city clerk within 10 days of such notice, then the.citq manager shall conduct an administrative hearing regarding the propriety of the summary impoundments , 8` DRAFT (07/22/02) 697714.1 - Page 8 of 11 - Section 11B -9 Non - Summary Impoundment. Whenever any newsrack is found to be in violation of this chapter, but the violation does not present an imminent danger to pedestrians or vehicles, the department shall affix a notice of violation tag upon such newsrack and shall send a written notice of violation to the owner identified on the newsrack. The notice shall state the nature of the violation and shall indicate that failure to correct the violation or to file a written hearing request with the city clerk within .:� 10 days may result in impoundment of the newsrack. The director may impound such newsrack if the owner has not corrected the violation or filed a written hearing request within theisallottect period. If the owner files a timely written hearing request with the city clerk, then the, city manager shall conduct an administrative hearing regarding the existence of the violation. .1:" ' Section 11B -10 Administrative Hearing. (a) The city manager shall be responsible for conducting admimsArative hearings related to the implementation of this chapter. This responsibility may not be delegated. (b) In addition to other matters designated in this chapter, (c) The city manager shall conduct an administrative' hearing and take the matter under submission for decision no later than 15 city business d ys following the timely filing of the request for hearing, unless the requestor and owner (if different than the requestor) consent in writing to an extension. At least 10 days prior, to such Bearing, written notice thereof shall be mailed to the requestor and owner (if different than the requestor). (d) Administrative hearings °shall \ be conducted in accordance with procedures established by the city manager. All parties involved shall have a right to: (1) offer testimonial, documentary and tangible evidence bearing on the issues; (2) be represented by counsel; and (3) confront and cross - examine witnesses. Any relevant evidence may be admitted that is the sort of evidence upon which reasonable persons lie accustomed to rely in the conduct of serious affairs. Any hearing under this paragraph may be continued for a reasonable time for the convenience of a party or a witness: (e) The city manager shall, within 10 city business days from the conclusion of the administrativehearing render a written decision supported by findings. The time period set forth in this sectiOSshall'not be extended except upon written consent of the requestor and the owner, (if different than the requestor). The decision of the city manager shall be final. Notice of the decision and acopy thereof shall be mailed to the requestor and the owner (if different than the requestor). Such notice shall contain the substance of the following statement: "You are hereby notified that the time within which judicial review of this decision may be sought is • governed by California Code of Civil Procedure Section 1094.8." . Section 11B -11 Return of Impounded Newsracks. DRAFT (07/22/02) 697714.1 - Page 9 of 11 - (a) Newsracks that have been summarily impounded shall be returned to the owner without charge if a timely hearing request was filed and the city manager determined that the seizure was improper. Otherwise such newsracks shall be returned upon payment of the impound fee and filing of a written request therefore within 30 days of the date of the seizure or, if applicable, the date of the city manager's administrative hearing decision upholding the seizure. (b) Newsracks that have been non - summarily impounded shall be returned Ito: the owner upon payment of the impound fee and filing of a written request therefore within 30 days , of the date of the seizure. , , (c) The amount of the impound fee shall be set by city council resolution. • f • Section 11B -12 Disposal of Impounded Newsracks. The department may sell or otherwise dispose of any newsrack provided that both (i) 30 days have elapsed since the impoundment or city manager decision affirming the impoundment; and (ii) the owner of the newsrack has failed to pay the impound fee. The proceeds of such disposal shall be deposited in the city's general fund. " • *. Section 3. Severability. If any section, subsection, subdivision, sentence, clause, phrase, or portion of this Ordinance, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have adopted this Ordinance, and each section, subsection,• subdivision, sentence, clause, phrase, or portion thereof, irrespective of the fact that any <one or more sections, subsections, subdivisions, sentences, clauses, phrases, or portions thereof be'declared invalid or unconstitutional.
