I Approved: , Seal Beach, California August 17, 1970 The City Council of the City of Seal Beach, California met in regular session at 8:15 p.m. with Mayor Baum presiding. The meeting was called to order with the Pledge of Allegiance. ROLL CALL Present: 'Mayor Baum Councilmen Fuhrman, Gummere, Hogard, Holden I Absent: None APPROVAL OF MINUTES The minutes of August 3, 1970, regular council meeting and August 10, 1970, regular adjourned council meeting were received b~dCouncil. Mr. Fuhrman directed the City Clerk to amend and correct the minutes in specified areas. Holden moved, second by Fuhrman, to approve the minutes of August' 3, 1970, and August '10, 1970, as amended and corrected. AYES: Baum, Fuhrman, Gurnrnere, Hogard, Holden NOES: None Motion carried. Holden moved that the extraneous recording equipment be removed from Council Chambers. Discussion followed. No action taken. Gummere moved, second by Holden, that this meeting adjourn to McGaugh School due to capacity c~owd. Discussion followed. The motion'was not recognized by the Mayor. It was the order of I the Mayor that the City Council'adjourn to McGaugh School at ' 8:25 p.m. The meeting reconvened at 9:00 p.m. at the McGaugh: School auditorium with Mayor Baum calling the meeting to order. I II I 8-17-70 216(:~r. .. -." APPROVAL OF DEMANDS Demands numbered 10633 through 10770 of $96,997.58 including payroll of $58,942.72 was presented. to Council as approved by the Finance Committee. Fuhrman moved,' second by Gummere, that the demands be allowed and warrants drawn on the Treasury for the same. AYES: Baum, Fuhrman, Gummere, Hogard, Holden NOES: None Motion carried. Mr. Hogard6read a statement relating to recent events of this Council. Tom Blackman, 421 Beryl Cove Way, directed his remarks to the statement. Mr. Hmlden directed his remarks to the statement as read by Mr. Hogard. Mr. Baum..directed that the record include Mr. . Holden's statement regarding the Golden Rain Foundation instituting a conflict of interest policy over a year ago with regard to employees and further referred to the motion of July 6, 1970, nominating him Mayor. Mr. Fuhrman read a letter addressed to him from Mr. McCracken and asked the City Attorney for recommendation on same. Mr. McCracken made a statement on the matter. The City Council recessed to Executive Legal Session at 9:22 p.m. The Council reconvened at 10:07.p.m. with Mayor Baum presiding. Police Chief Lee Case clarified..points' with regard to the Police ,. Department. Baum moved, second by Fuhrman, to amend the Agenda to include consideration of the Marina Palace matter as Item 1, that the Redevelopment Agency, Ite~ 10, be considered as Item 2; that Item 4 of the Agenda regarding items from Mr. Fuhrman be , considered as Item 3; and that Agenda Item 9, Boards ands Commissions, be Item 4. AYES: Baum, Fuhrman, Hogard NOES: Gummere, Holden Motion carried. DECISION-MARINA PALACE-AMENDED AGENDA The Interim City Manager read his decision of August 14, 1970, regarding the matter of the public dance license issued to M. E. Robertson, Marina Palace. Mr. Robertson, Marina Palace, made a statement on this matter, duly cau~ioned by the Interim City Attorney with regard to the pending hearing on the matter. 8-17-70 l2i\~( APPEAL-M. E. ROBERTSON-AMENDED AGENDA The appeal from the order of Interim City Manager of August 14, 1970, in the matter of public ,aance-license issued to M. E. Robertson, dba, Marina Palace"received by the City Clerk at 3:00 o'clock p.m. on August 17, 1970, was received by Council. Gummere moved, second by Holden, that the hearing on the above I matter be set for Wednesday, August 26, 1970, at 7:30 o'clock p.m. Discussion followed. John Hamilton, 1712 Harbor Way spoke on the matter. Albert Del Guercio spoke on the matter. AYES: Baum, Fuhrman, Gummere, -Hogard, Holden NOES: None Motion carried. Mr. Robertson inquired about subpeonas for the hearing, the City Attorney clarified the point. Gurnrnere moved, second by Holden, that .the hearing on the Marina Palace matter be set for Wednesday, August 26, 1970, at 7:30 p.m. and that it be held at the McGaugh School Auditorium. AYES: Baum, Fuhrman, Gummere, Hogard, Holden NOES: None Motion carried. ORDINANCE NUMBER 8l6-REDEVELOPMENT., AGENCY-Agenda Item 10 I Ordinance Number 816 was presented and 'read by the Mayor entitled "AN ORDINANCE OF THE CITY OF SEAL BEACH AMENDING SECTIONS 2-47 AND 2-48 OF THE CITY CODE DECLARING A NEED FOR THE REDEVELOPMENT AGENCY AND DESIGNATING FIVE APPOINTIVE RESIDENT ELECTORS AS MEMBERS THEREOF." Baum moved, second by Fuhrman, that Ordinance Number 816 be declared to have had its first reading and be pas'sed to second reading. Mr. Fuhrman inquired as to the reasons for the ordinance. Tom Blackman, 421 Beryl Cove Way, spoke against the ordinance. Councilman Holden spoke against the ordinance. Jean Dorr, 231 6th Street, commented on the discussion. John Hamilton, 1712 Harbor Way, spoke against the ordinance. Albert Del Guercio spoke against the ordinance. Moira Lindstrom 215 14th Street spoke for the ordinance. Jay Covington, 4557 Candleberry, spoke for the ordinance. Thomas McKnew, 4748 Candleberry, spoke against the I ordinance. Beverly Casares spoke against the ordinance. AYES: Baum, Fuhrman, Hogard NOES: Gummere, Ho!!-~en Motion carried. I I I 8-17-70 '2..~ PROPOSED ORDINANCES-MR. FUHRMAN-Agenda Item 4. Mr. Fuhrman requested that the. proposed ordinances relating to Boards and Commissions and conflict. of interest be referred to the City Attorney for his recommendations'. It was the order of the Chair that those items be referred to the City Attorney as requested. RECONSIDERATION-RESOLUTION 1867-Agenda Item 4c Mr. Fuhrman read Resolution 1867 and Resolution -1342 with ~egard to the Bluebell Park acquisition. Fuhrman moved, second by Baum, that Resolution 1867 be amended, deletiug those portions thereof that referred to Lots 116 through 125 of Tract 6177, and that renegotiation be initiated with S & S Construction Company for acquisition of the park on a cash'basis. The eity Attorney made a recommendation on the matter. Councilman Gummere spoke against the motion, refer~ed to the park donated by S & S Construction Company and read several communications relating to the matter. Lee Risner, 845 Driftwood; Martha Schieblauer, 124 1st Street; Mr. Gollison, Beachcomber Drive, spoke.to the matter. Chris Lindstrom, 215 14th Street, made a. statement. Mr. Holden spoke against the motion. Further discussion followed with members of the Council and the City Attorney taking' part. Fuhrman withdrew his motion, with consent' of the second. It was the order of the Mayor that the City Manager and the City Attorney review those documents with regard to the City's position with S & S Construction Company regarding acquisition 'of parks, that a report be brought to Council at the next regular meeting. Mr. Blackman made a statement relating to the previous discussion. BOARDS AND COMMISSIONS - APPOINTMENT,S ,~ Agenda Item 9 Fuhrman moved, second by Hogard, that nominations be made by Councilmanic District in numerical order. Discussion followed. The Mayor declared a short recess at 12:00 o'clock midnight. The meeting reconvened at 12:18 a.m. with Mayor Baum calling the meeting to order. The Mayor stated that nominations were now open for Planning Commissioner, term to expire June 30, 1974. Mr. Fuhrman withdrew his previous motion with consent of the second. Mr. Hogard nominated Miss Julie Dorr as a member of the 8-17-70 ~1'1 Planning Commission. Mr. Fuhrman ,seconded the motion. The Mayor declared Miss Julie Dor~ to be a member of the Planning Commission, term to expire June 30, 1974, with consent of the Council. Gummere moved, second by Holden, to amend the Agendatto consider Agenda Item 8, Tentative Tract Map approval, out of order at this time. Discussion followed. I AYES: Fuhrman, Gummere, Hogard, Holden NOES: NoMe ABSTAIN: Baum Motion carried. APPROVAL - TENTATIVE TRACT,'MAP #7264 Holden moved, second by Gummere, to approve tentative tract map *7264. Mr. Fuhrman spoke to the motion regarding park and recreation fees. Bernard Solomon, 3106 E. Willow Street, Long Beach, spoke to the Council on the matter. Mr. Neprud, Planning Department, stated the_park fee"~equirements under present ordinances. Further discussion followed. Holden moved, second by Gummere, to amend the motion to include a $75.00 per unit park and recreation fee. Hogard moved, second by Holden, to amend the Agenda to consider agenda item 3B out of order relating to replacement of lifeguards. AYES: Baum, Fuhrman, Gummere, Hogard, Holden NOES: None Motion carried. PERSONNEL - LIFEGUARD REPLACEMENT - Agenda Item 3b I Holden moved, second by Hogard, that the City Manager be. authorized to replace two lifeguards as requested. II The City Council of the City of Seal Beach met in regular adjourned session at McGaugh School Auditorium. The meeting was called to order at 8:20 p.m. with the Pledge of Allegiance to the Flag. ROLL CALL Present: Mayor Baum Councilmernbers Fuhrman, Gumrnere, Hogard, Holden Absent: None APPROVAL OF MINUTES Holden moved, second by Fuhrman, to approve the minutes of August 17, 1970, regular meeting as corrected by the City Clerk. AYES: Baum, Fuhrman, Gummere, Hogard, Holden NOES: None Motion carried. II ORDINANCE NO. 816 - REDEVELOPMENT AGENCY - Council Item 1. Ordinance No. 816 was read in full entitled "AN ORDINANCE OF THE CITY OF SEAL BEACH AMENDING SECTION 2-47 AND 2-48 OF THE CITY CODE." Fuhrman moved, second by Baum, to adopt Ordinance 816 as read.
