II The City Council of the City of Seal Beach met in regular adjourned session at McGaugh School Auditorium. The meeting was called to order at 8:20 p.m. with the Pledge of Allegiance to the Flag. ROLL CALL Present: Mayor Baum Councilmernbers Fuhrman, Gumrnere, Hogard, Holden Absent: None APPROVAL OF MINUTES Holden moved, second by Fuhrman, to approve the minutes of August 17, 1970, regular meeting as corrected by the City Clerk. AYES: Baum, Fuhrman, Gummere, Hogard, Holden NOES: None Motion carried. II ORDINANCE NO. 816 - REDEVELOPMENT AGENCY - Council Item 1. Ordinance No. 816 was read in full entitled "AN ORDINANCE OF THE CITY OF SEAL BEACH AMENDING SECTION 2-47 AND 2-48 OF THE CITY CODE." Fuhrman moved, second by Baum, to adopt Ordinance 816 as read. RESOLUTION NUMBER 1884 - OPPOSING INCREASED AIR ACTIVITIES LONG BEACH Resolution Number 1884 was presented to the Council by title "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, EXPRESSING OPPOSITION TO INCREASED AIR ACTIVITY OVER THIS COMMUNITY." RESOLUTION NO. l885-EXPENDITURE RESTRICTIONS Resolution No. 1885 was presented to Council entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEAqH, CALIFORNIA, RESCINDING RESOLUTION NO. 1877, AND PLACING CERTAIN RESTRICTIONS ON EXPENDITURES ALLOWED IN THE 1970-71 BUDGET." Fuhrman moved, second by Baum to adopt Resolution 1885. Councilman Holden spoke against the motion. AYES: Baum, Fuhrman, Hogard NOES: Gummere, Holden Motion carried. I BEACH EROSION CONTROL Communications from Councilman Hogard and from Assistant City Engineer Bill Murphy were received by Council. Gummere moved, second by Holden to authorize the City Manager to execute an agreement with Moffatt and Nichol in the amount of $2,700 for a study and report on the beach erosion problem. TAX RATE - 1970-71 Gummere moved, second by Hogard, that the tax rate for the City II of Seal Beach be retained at $1.35 assessed valuation. ORDINANCE NO. 817 - TAX RATE 1970-71 Ordinance No. 817 was il!ead in full entitled "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, FIXING AND DETERMINING THE RATE OF TAXES TO BE LEVIED FOR MUNICIPAL PURPOSES OF THE CITY OF SEAL BEACH FOR FISCAL YEAR 1970-71, AND DECLARING THE URGENCY THEREOF, AND THAT THIS ORDINANCE SHALL TAKE EFFECT IMMEDIATELY." COMMUNICATION - ALBERT DEL GUERCIO Mr. Del Guercio spoke regarding his communication to the Council. The Mayor asked that he be seated. Gummere moved, second by Holden that Mr. Del Guercio be allowed to continue. AYES: Gummere, Holden NOES: Baum, Fuhrman, Hogard . Motion, fai'ied. 8-24 -70 ~~: Discussion continued on the matter. The Mayor quoted portions of the Charter. It was the order of the Chair that the comrnuni- cation from Mr. Del Guercio be received and filed. Jim Clark, 4840 Ironwood'Avenue, requested to speak on the matter and was denied his request. REQUEST - LEAVE OF ABSENCE I The request from Mrs. Marion Shanker for a leave of absence during the month of September was received by the Council. Fuhrman moved, second by Hogard to grant the leave of absence as requested by Mrs. Shanker, and as recommended~by the Chief of Police. Mr. Del Guercio spoke .on the' matter. ,',. ',. Fuhrman moved, second by Hogard, to deny the claim and refer the matter to the insurance carrier and that the claimant be notified of Council action. NOTICES - CORPS OF ENGINEERS The notice of application from Orange County Sanitation District from the Corps of Engineers and applications from Orange County Harbor District corps of Engineers were ordered received and filed by the Chair with the consent of Council. REQUEST - CITY MANAGER - PERSONNEL Memorandum from the City Man~ger was received regarding the replacement of Crossing Guards in accordance with Resolution 1885. Fuhrman moved, second by Hogard, to authorize the replacement of these crossing guards. NOES: None Motion carried. I AYES: . It was the Chair's view that business at hand be conducted expeditiously. Holden moved, second by Gummere, to remove the Mayor from that office. The motion was not recognized by the Mayor. Uppn Mr. Hogard's request, the Mayor directed the City Manager to make inquiries about bus.service to Long Beach State College and the Veteran's Hospital. It was the order of the Chair to. receive and file the communication. REPORT - SENATE 1053 - TIDELANDS BILL It was the order, of the Chair to receive and file the report on Senate Bill 1053. FIRE INSURANCE APPRAISAL Communication from the City Manager regarding proposals for the apprais!l-l of fire insurance for'.City property was received by'.Council.. Gummere moved" second by'Hogard, to authorize the City Manager to enter into an'agreement with General 'Appraisal Company and authorize the City Manager to execute said agreement. ORAL COMMUNICATIONS I Councilman Fuhrman read a letter from a College Park West resident requesting help for the bussing of school children. ,The Mayor directed the City Manager and the City Attorney to study the problem as to avenues' open for the City. Jack Klempner, 15th St.,' spoke on the matter. Terry Jones, 192 Yale Lane, spoke f,or an overpass with regard to this matter. Councilman Gummere asked what results had transpired from the' meeting of the City Attorney with Mr. Jensen of Modular Technology Co. Discussion followed. The meeting reconvened at 11:00 p.m. with Mayor Baum calling the meeting to order. Councilman Gummere questioned the place of meetings for the hearing on the license matter for M. E. Robertson. Mr. Del Guercio directed' his questions regarding the subpeonas issued and quoted sections of the Charter relating thereto. Beverly Casares, 420'Coastline Drive, directed her questions to the Mayor and to Councilman" Fuhrman on specific items. Replies were' given to her quest~ons~ Frank Clinton, Seal Way, directed his questions to the' Council' with regard to a permanent City Manager and' as to the meetings here at MCGaugh School. Mel Kavin, 1410 Catalina, spoke on'the matter of agenda changes. Sven Lindstrom, 215 14th St., spoke with regard to the Redevelopment Agency and the R & B Development. Mrs. Roger West, 1201 Electric, spoke regarding the posting ~f the agendas. Jean Dorr, 231 6th Street, spoke regarding the' General Plan. Mike Knapp, 645 Sandpiper, spoke regarding oral communications, and changes in the agenda. Jim Clark, 4840 Ironwood" spoke on the matter of agenda changes. ORAL COMMUNICATIONS Councilman Hogard commended the police on their efficiency. Oral Communications were closed by'~he Mayor at 12:10 a.m. The City Council went into executive legal session at 12:10 a.m. The Council reconvened at 12:40 a.m. Fuhrman moved, second by Gummere, to amend the agenda to include an item regarding Diehl, Evans and Company, auditors. The meeting was called to order with the Salute to the Flag. I Councilmernbers Baum, Fuhrman, Gummere, Hogard, Holden present. Absent: ' None Mayor Baum stated that the purpose of the special meeting was to authorize the Mayor to issue subpeonas in the M.'E. Robertson Dance License Appeal hearing matter, pursuant to City Charter Section 410. The notice of special meeting was as follows:- Seal Beach, California August 28, 1970 Morton A.
