ORAL COMMUNICATIONS The Mayor stated that this was the time for oral communication. Mr. Fuhrman read a letter from the City of Yorba Linda regarding Environmental' Quality Control Board. Ed Mischelle, Ocean Avenue, directed a statement to the Council. Tom Blackman, Beryl Cove Way, requested information regarding the special' audit and'was informed that a report would be forthcoming by,the end of the month. There were no other oral communications, oral commun~cations were I closed. Mr. Courtemarche made a statement of appreciation to the Staff. The meeting was called to order with the Salute to the Flag. AYES: Baum, Fuhrman, Hogard, Holden NOES: None VACANCY: One Motion carried ORDINANCE NUMBER 834 - ESTABLISHING OS-WR ZONE I Ordinance Number 834 was read in full by the City Attorney entitled, "AN ORDINANCE OF THE CITY OF SEAL BEACH ADOPTING A PARTIAL OPEN SPACE PLAN: ESTABLISHING AN "OPEN SPACE- WATER RECREATION" LAND USE ZONE (OS-WR ZONE): FIXING THE BOUNDARIES OF SAID ZONE AND ENUMERATING THE USES PERMITTED THEREIN; PROVIDING FOR THE CONSTRUCTION OF THIS ENACTMENT; PRESCRIBING PENALTIES FOR VIOLATIONS THEREOF; AND DECLARING THE URGENCY THEREOF." I APPROVAL OF MINUTES Fuhrman moved, second by Holden to approve the minutes of January 18, 1971 regular meeting, as presented. AYES: Baum, Fuhrman, Hogard, Holden NOES: None VACANCY: One Motion carried APPROVAL OF DEMANDS Demands numbered 12066 through 12180 in the amount of $28,508.27 were presented for approval as approved by the Finance Committee. Holden moved, second by Baum that the demands be allowed and warrants drawn on the Treasury for the same. Discussion followed. Mayor Baum proclaimed March 1971 as "Easter Seal Month" in the City of Seal Beach. PUBLIC HEARING - POSITION OF ASSISTANT CITY MANAGER The City Manager requested that the public hearing regarding the position of Assistant City Manager be held over to next meeting for further study. Baum moved, second by Fuhrman, to defer the public hearing regarding the position of Assistant City Manager to February 16, 1971 at 8:00 p.m. AYES: Baum, Fuhrman, Hogard NOES: Holden VACANCY: One Motion carried PUBLIC HEARING SET - PETER J. TRAMA I Baum moved, second by Fuhrman, that a public hearing be set for 8:00 p.m. February 16, 1971 concerning the appeal ,of action of the Planning Commission in denying a Use Variance to Peter J, Trama, Red On~dle Steak House, Discussion followed on the matter with members of the audience taking part. Baum, moved, second by Fuhrman, to waive the second reading of Ordinance Number 833, deem that it has had second reading and be passed for adoption. AYES: Baum, Fuhrman, Hogard, Holden NOES: None VACANCY: One Motion carried I RESOLUTION NUMBER 1950 - GRANTING EASEMENT - PUBLIC UTILITY Resolution Number 1950 was presented to Council entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, A MUNICIPAL CORPORATION GRANTING AN EASEMENT TO THE GENERAL TELEPHONE COMPANY FOR UTILITY PURPOSES." Baum moved, second by Fuhrman, to adopt Resolution Number 1950. AYES: Baum, Fuhrman, Hogard, Holden NOES: None VACANCY: One Motion carried RESOLUTION NUMBER 1951 - AUTHORIZING BANK SIGNATURES '\ Resolution Number 1951 was presented to Council entitled , "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, A CHARTER CITY, PROVING AUTHORIZATION TO SIGN DEMANDS AND CHECKS FOR THE WITHDRAWL OF FUNDS ON DEPOSIT WITH THE BANK OF AMERICA, BRANCH #132; SECURITY PACIFIC NATIONAL BANK, BRANCH 250; UNITED CALIFORNIA BANK, 1 BRANCH 110; AND CROCKER CITIZENS BANK, BRANCH 363." AYES: Baum, Fuhrman, Hogard, Holden NOES: None VACANCY: One Motion carried, GUM GROVE PARK LEASE The City Attorney outlined the lease agreement for the Hellman property known as the Gum Grove Park area and concurrent purchase of portion of the Pacific Electric Right of Way. -Baum moved, second by Fuhrman, to approve escrow instructions and proposed lease agreement. Discussion followed regarding appraisal of property to be purchased. AYES: Baum, Fuhrman, Hogard NOES: Holden VACANCY: One Motion carried RESOLUTION NUMBER 1952 - PARK LEASE/PROPERTY PURCHASE I Resolution Number, 1952 was presented to Council by title "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH AUTHORIZING THE EXECUTION OF ESCROW INSTRUCTIONS FOR PURCHASE OF REAL PROPERTY AND APPROVING FORM OF LEASE OF REAL PROPERTY." Baum moved, second by Fuhrman, to adopt Resolution Number 1952. Discussion followed with members of the audience speaking on the matter. Myers, City Manager was received in final form. The agreement was approved January 18, 1971 by Resolution Number 1942. Members of the audience spoke on the matter. COUNCIL MEETING DATE I The memorandum regarding a change in Council Meeting schedule for February 15th to February 16th due to legal holiday was duly noted, with comments that regular Council-Meetings be changed to first and third Tuesdays at a future,date. COMMUNICATION - BEVERLY CASARES Mrs. Casares spoke regarding her communication and referred to procedures regarding the vacancy on the Council. Disc~ssion fol~owed. AYES: NOES: VACANCY: Hogard, Fuhrman Baum, Holden One I Motion failed COMMUNICATION - SCAG NOMINATION The Communication from Councilman Jack Green of Huntington Beach seeking nomination as a representative to SCAG (Southern California Association of Governments) was received. It was the consensus of the Counci'l that Mr. Fuhrman, our delegate to SCAG, support Mr. Green as requested. COMMUNICATION - STATE DIVISION OF HIGHWAYS It was the order of the Chair to receiye and file the communication from State of California, Division of Highways advising City of acquisition of property' within the City. COMMUNICATION - CITY OF LOS ALAMITOS I It was the order of the Chair, with consent of Council, to direct the City Manager to negotiate with Mr. Krause in I 1 I Los Alamitos regarding their proposal for additional signing on the freeway for Los Alamitos Blvd. The Mayor called a recess' at'9:40 p.m. The City Council reconvened at 9:50 p.m. with'the Mayor calling the meeting to order. COMMUNICATION - SOUTHERN CALIFORNIA GENERAL ASSEMBLY , Baum moved, second by Fuhrman, that a letter be drafted supporting Camarillo in their action regarding the Southern California General Assembly. AYES: NOES: VACANCY: Baum, Fuhrman, Hogard, Holden None One Motion carried COMMUNICATION - CITY OF COSTA MESA It was the order 'of the Chair to receive and file resolution from City of Costa Mesa urging SCAG to consider adoption of policy to oppose any bills which do not involve local government in decision making process. COMMUNICATION - CITY OF WESTMINISTER It was the order of, the Chair to receive and file letter from City of Westminister to State Legislators attempting to create an awareness of the financial problems of cities. ' COMMUNICATION - MARINA DRIVE BRIDGE The communication from Bill R. Jones, 110 Surf Place, calling attention to undesirable conditions on Marina Drive Bridge was received by Council. Discussion on the matter followed with Mr. Kris Lindstrom presenting pictures of the area in question. Discussion continued with members of the Council, the Staff, and members of the audience taking part. It was th~ consensus of the Council that the City Manager negotiate with Long Beach on the problem and report back to Council. COMMUNICATIONS - ENVIRONMENTAL QUALITY CONTROL BOARD The Chairman of the Environmental Quality Control Board presented three resolutions for consideration of Council.' Baum moved, second by Fuhrman, to accept Resolution Number 71-1 of the EQCB 2-1-71 {) ';' h .r'~60 2-1-71 , ',' :,' i Ii, : :l61. urging the investigation of the setting of a maximum allowable temperature for the Lower San Gabriel Tidal Prism,-that this Council express approval of the resolution as presented. AYES: NOES: VACANCY: Baum, ,Fuhrman, Hogard, Holden None One Motion carried I It was the order of the Chair with consent of Council that Resolution 71-2 of the EQCB urging the City Council to take certain actions with reference to rat infestation be received, that actions requested be investigated and report back to Council. EQCB Resolution Number 71-3 urging local action through a recycling program to alleviate the problems of litter, solid waste and exhaustion of natural resources was received by Council. Discussion followed with members of the audience speaking on the matter. Baum moved, second by Fuhrman, that this Council be in favor of any action expended for recycling program and support Resolution 71-3. Sven Lindstrom, 215 - 14th Street, spoke regarding the City's lobbyist. Bill Miller, 4540 Fir Circle, informed the Council of a special meeting of the Los Alamitos School Distri-ct and, urged members of ,the City Council to attend. ,Frank Clinton, Seal Way, commended the City Treasurer regarding recent rulings from the Superior Court. Ed Mischell, Ocean Avenue, spoke regarding legal costs. Gordon Shanks, 215 Surf Place, spoke relative to the Brown Act. Tom Blackman, Beryl Cove Way, spoke regarding the recall. Charles Humphrey, spoke regarding purchase of the P. E. Right of Way. Tom Brady spoke regarding Council matters.
