ROLL CALL I Present: Mayor Baum Councilmen Fuhrman, Hogard, Holden Absent: None Vacancy: One APPROVAL OF MINUTES Fuhrman moved, second by Hogard to approve the minutes of March 1,1971 regular meeting as presented. AYES: Baum, Fuhrman, Hogard, Holden NOES: None VACANCY: One APPROVAL OF DEMANDS --- Motion carried I Regular demands numbered 12437 through 12594 in the amount of $164,575.97 and payroll demands numbered 603 through 770 of March 1, 1971 for $59,613.06 were presented as approved by 3)',15,-.71 { ." PROPOSED ORDINANCES - REDEVELOPMENT AGENCY Upon Mr. Fuhrman's request proposed ordinances relating to Redevelopment Agency were withdrawn from the Agenda. RESOLUTION NUMBER 1959 - EMERGENCY ROAD - COLLEGE PARK WEST Resolution Number 1959 was presented entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, REQUESTING THE STATE DIVISION OF HIGHWAYS TO PROVIDE "EMERGENCY ONLY" VEHICULAR INGRESS AND EGRESS TO COLLEGE I PARK WEST". Fuhrman moved, second by Hogard to adopt Resolution Number 1959. AYES: Baum, Fuhrman, Hogard, Holden NOES: None VACANCY: One Motion carried RESOLUTION NUMBER 1960 - FEDERAL COURT ACTIONS - RUTAN & TUCKER 1 Resolution Number 1960 was presented entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH AUTHORIZING THE LAW FIRM OF RUTAN & TUCKER TO INTERVENE ON BEHALF OF THE CITY IN PENDING FEDERAL COURT ACTIONS AGAINST ROCKWELL MANUFACTURING COMPANY, AND OTHERS, FOR RECOVERY OF DAMAGES FOR AN ALLEGED CONSPIRACY FIXING PRICES ON WATER METERS IN VIOLATION OF FEDERAL ANTI-TRUST LAWS". RIGHT-OF-WAY Resolution Number 1961 was presented to Council entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH APPROVING A CORRECTED EXACT LEGAL DESCRIPTION OF REAL PROPERTY TO BE PURCHASED BY THE CITY UNDER SEAL BEACH CITY COUNCIL RESOLUTION 1952". Baum moved, second by Fuhrman to adopt Resolution Number 1961. Baum moved, second by Fuhrman to adopt Resolution Number 1962. AYES: Baum, Fuhrman, Hogard, Holden NOES: None VACANCY: One RESOLUTION NUMBER 1963 - CANVASS OF V.OTES Motion carried I Resolution Number 1963 was presented entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, ' A CHARTER CITY, ORDERING THE CANVASS OF THE SPECIAL MUNICIPAL ELECTION TO BE HELD IN COUNCILMANIC DISTRICT II ON 'THE 30th DAY OF MARCH 1971, TO BE MADE BY THE CITY CLERK OF THE CITY OF SEAL BEACH". Baum moved, second by Holden to adopt Resolution Number 1963. AYES: Baum, Fuhrman, Hogard, Holden NOES: None VACANCY: Motion carried One RESOLUTION NUMBER 1964 - CANVASS OF VOTES -- - I Resolution Number 1964 was presented entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, A CHARTER CITY, ORDERING THE CANVASS OF THE SPECIAL MUNICIPAL ELECTION TO BE HELD IN COUNCILMANIC DISTRICT IV ON THE 30th DAY OF MARCH, 1971, TO BE MADE BY THE CITY CLERK OF THE CITY OF SEAL BEACH". Fuhrman moved, second by Holden to adopt Resolution Number 1964. AYES: Baum, Fuhrman, Hogard, Holden I NOES: None One VACANCY: Motion carried APPOINTMENT - ORANGE COUNTY HEALTH PLANNING COUNCIL Baum moved, second by Fuhrman to defer to next regular meeting, the consideration of appointment of a consumer representative to Orange County Health Planning Council. AYES: Baum, Fuhrman, Hogard, Holden NOES: None VACANCY: One Moti on carri ed REQUEST - SEAL BEACH SWIM CLUB I Holden moved, second by Baum to approve the request by Seal Beach Swim Club to use beach area west of pier and adjacent waters for Third Annual Rough Water Swim Meet on Sunday, July 25, 1971. ~YES: Baum, Fuhrman, Hogard, Holden NOES: None VACANCY: One Motion carried PROPOSED AGREEMENT - SEWAGE PROJECT Holden moved, second by Baum to approve the agreement for engineering contract with V.T.N. for sewage project and authorize the City Manager to execute. Discussion followed, with Mr. Fuhrman speaking against the motion. Hogard,moved, second by Fuhrman to table the motion. RESOLUTION NUMBER 1965 - BENTSON I Resolution Number 1965 was presented entitled "/!. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, HONORING ~ES BENTSON FOR SERVICES RENDERED AS INTERIM CITY ATTORNEY." Fuhrman moved, second by Baum to adopt Resolution Number 1965. Holden spoke against the Resolution. Members of the audience spoke on the matter. AYES: Baum, Fuhrman, Hogard NOES: Holden VACANCY: One Motion carried LEGAL SESSION The Council recessed to Executive Legal Session at 8:45 p.m. The Council reconvened at 8:55 p.m. with the Mayor calling the meeting to order. Fuhrman moved, second by Baum, to direct the City Manager to issue no more occupancy certificates without obtaining the Environmental Reserve Tax. AYES: Baum, Fuhrman, Hogard, Holden I NOES: None VACANCY: One Motion carried ORAL COMMUNICATIONS The Mayor opened oral communications. Mr. Petrus Roelofs observed that the City was using non-biodegradable cups. Tom McKnew, Candleberry, spoke regarding the College Park Homeowners request for consideration of a noise barrier where the Garden Grove Freeway widening is proposed.' The City Manager stated that the staff was informed of the matter. The City Engineer was directed to attend the Homeowner's meeting with the Division of Highways I 3-15-71 / 4-5-71 .~~;...:~. ~~4 representative. There were no other oral communications, oral communications were closed.
