City Manager FROM: Linda Devine, City Clerk SUBJECT: PLANNING COMMISSION, RECREATION & PARKS COMMISSION, AND AD HOC GENERAL PLAN /LOCAL COASTAL PLAN CITIZENS ADVISORY COMMITTEE - ACCEPT RESIGNATIONS AND DECLARE VACANCIES SUMMARY OF REQUEST: Accept the resignations of Erin Bello as District 3 representative on the Planning Commission, Leonard DeLay as District 2 representative on the Recreation and Parks Commission, and Gayle Colden as District 5 representative on the AdHoc General Plan /Local Coastal Plan Citizens Advisory Committee. Declare vacancies of the unexpired terms for the Planning Commission and the Recreation & Parks Commission and a vacancy on the AdHoc GP /LCP Citizens Advisory Committee. BACKGROUND AND ANALYSIS: The Director of Development Services was notified by Erin Bello that due to her work schedule she will be resigning as District 3 representative on the Planning Commission - this was effective immediately; and was notified by Gayle Colden that due to a conflict in her schedule she will not be able to participate in the AdHoc GP /LCP Committee. Councilman Sloan received a letter of resignation from Leonard DeLay, his representative on Recreation and Parks Commission - effective August 1, 2011. In accordance with Government Code §54974 (Maddy Act) whenever an unscheduled vacancy occurs in any board, commission, or committee for which the legislative body has the appointing power, a special vacancy notice shall be posted and appointment to the board, commission, or committee shall not be made by the legislative body for at least 10 working days after the posting of the notice. Agenda Item C Page 2 FINANCIAL IMPACT: No impact. RECOMMENDATION: Declare the positions vacant. Direct the City Clerk to post the "Notice of Special Vacancy" for the required ten day period; thereafter the appointment to fill the vacancies may be made August 8, 2011.
