AGENDA APPROVAL By Motion of the Planning Commission this is the time to notify the public of any changes to the Agenda, re-arrange the order of the Agenda, and provide an opportunity for any member of the Planning Commission or staff to request an item be removed from the Consent Calendar for separate action. CONSENT CALENDAR Items on the Consent Calendar are considered to be routine and are enacted by one motion unless prior to enactment a member of the Planning Commission or staff requests a specific item be removed from the Consent Calendar for separate action. 1. Approve Planning Commission Meeting Minutes of June 1, 2011 SCHEDULED MATTERS PUBLIC HEARING 2. Zone Text Amendment 11-1 Citywide Applicant/Owner: City of Seal Beach Request: For the modification, deletion, and addition of text to various Sections within Title 11 (Zoning Code) of the City of Seal Beach Municipal Code. The proposed amendments would affect various zoning districts, development standards, and procedures. Recommendation: Approval, subject to conditions, and adoption of Resolution 11-8. The meeting was 1 9 held in the City Council Chambers and began with the Salute to the Flag. 10 ROLL CALL 11 12 13 Present: Chairperson Massa-Lavitt, Commissioners Bello, Everson, and Galbreath 14 15 Also 16 Present: Department of Development Services 17 Mark Persico, Director 18 Jerry Olivera, Senior Planner 19 Steven Flower, Assistant City Attorney 20 21 Absent: Commissioner Cummings 22 23 Mr. Persico requested a motion to excuse Commissioner Cummings’ absence. 24 25 MOTION by Bello; SECOND by Galbreath to excuse Commissioner Cummings from the 26 Planning Commission meeting of June 15, 2011. 27 MOTION CARRIED: 4 – 0 – 1 28 AYES: Massa-Lavitt, Bello, Everson, and Galbreath 29 NOES: None 30 ABSENT: Cummings 31 32 ORAL COMMUNICATIONS 33 34 35 Chairperson Massa-Lavitt opened oral communications. 36 37 Mark Hjelm stated that he had questions regarding patio enclosures. He provided information on this item and noted 2 that after working with the new Title 11 Zoning Code (ZC), Staff had found some errors, 3 omissions, or inconsistencies within the text, and Zone Text Amendment 11-1 presents 4 the proposed language to amend or correct the discrepancies found to date. This is to 5 be a bi-annual process to ensure that all Title 11 guidelines read clearly and correctly. 6 Mr. Olivera than indicated that he would briefly review the Zone Amendments as 7 outlined in the Staff Report for the following items: 8 9 1. Security Lighting 10 2. Allowable Fence Heights 11 3. Garage Widths on 25-ft. Wide Corner Lots 12 4. Bay Windows 13 5. Swimming Pools and Hot Tubs 14 6. Parking of Recreational Vehicles and Boats 15 7. Definition of “Landscape” 16 8. Measurements Involving a Structure 17 9. Structural Alterations or Additions to Single-Unit Residences Require a Conditional 18 Use Permit (All Residential Districts) 19 10. Off-Street Parking and Loading (Parking Standards for Shopping Centers) 20 11. Legislative Actions (Language Clarification) 21 12. Patio Enclosures on Nonconforming Residential Structures 22 23 Mr. Persico requested that Mr. Olivera begin with Item 12 so that he could respond to 24 Mr. Hjelm’s questions regarding patio enclosures. 25 26 Commissioner Questions 27 28 Commissioner Everson suggested that the discussion begin with Item 12 and that the 29 Commission make a decision on the standards for patio enclosures. 30 31 Public Hearing 32 33 Chairperson Massa-Lavitt opened the public hearing. 34 35 Rhonda Hjelm commented that from a safety and aesthetic perspective, removing the 36 existing railing from her second floor patio would not make sense, but the proposed 37 percentage limitations for the patio walls sound appropriate. 38 39 Mr. Persico recommended that the Commission vote on Item 12 prior to continuing with 40 the other approvals. 41 42 MOTION by Everson; SECOND by Bello to approve the proposed text amendment for 43 patio enclosures on nonconforming residential structures, as amended. 44 MOTION CARRIED: 4 – 0 – 1 45 AYES: Massa-Lavitt, Bello, Everson, and Galbreath 46 3 of 5 City of Seal Beach Planning Commission Meeting Minutes of June 15, 2011 NOES: None 1 ABSENT: Cummings 2 3 4 The Commission then discussed Items 1 through 11 to determine whether the language 5 as presented in the Staff Report should be adopted as presented or modified. 6 7 At 8:50 p.m. Chairperson Massa-Lavitt requested that the Commission take a 5-minute 8 recess. 9 10 The meeting reconvened at 8:55 p.m. 11 12 There being no one else wishing to speak, Chairperson Massa-Lavitt closed the public 13 hearing. 14 15 The final determination of the Planning Commission for Items 1 through 11 is as follows: 16 17 1. COMMISSION CONCERNS Commissioner Galbreath commented on having received a "cold call" from a contractor wishing to acquire new business, and who claimed to currently be working on a City project.
