SUBJECT: HERON POINT SLOPE REPAIR FUNDING REQUEST
SUMMARY OF REQUEST:
It is requested that the City Council adopt Resolution No. 6177 approving Budget
Amendment No. 2012 -02 -01 authorizing the use of Park in Lieu Funds to repair
slope failure within Gum Grove Park.
BACKGROUND AND ANALYSIS:
During the winter storm season of 2010, the City of Seal Beach activated the
Emergency Operations Center due to severe winter storms. One of the
emergencies that occurred during those storms was a slope failure within Gum
Grove Park. The City has been working with Federal Emergency Management
Agency (FEMA) to have repair of this slope failure funded as a result of the
emergency event.
The City was successful in securing FEMA funding to repair the slope failure, and
on the May 9, 2011, awarded a construction contract to Post Earthworks
Construction for $64,392.86. This repair would not only rehabilitate the slope
failure, but also reroute the surface drainage to prevent a failure from occurring in
the future. See attached site map. The City submitted for a reimbursement of
$125,000 which was based upon the estimated construction cost, and
reimbursement for design and construction management. After the award of
construction, the City submitted authorization to FEMA to begin construction.
Subsequently, FEMA reduced the funding to approximately $17,768, which will
fund only repair of the slope and replanting of landscaping. Even though FEMA
has reduced the funding level, they have not given the City authorization to begin
with the reduced scope of construction.
Under FEMA's guidelines, the City cannot perform any construction work until
FEMA has responded with an approval to begin construction. As of the drafting
of this report, the City has had no response from FEMA, following several weeks
of weekly contacts to FEMA. Repeated attempts to gain approval from FEMA

have yielded a response of, "it is in the process ". If the City begins construction
work prior to FEMA approval, the City will lose the FEMA funds of $17,768.
The ultimate goal of the project is to have the repair complete prior to the
beginning of the upcoming rainy season. It is estimated that the construction will
last 30 -45 days to complete. In order to make this deadline, staff recommends
beginning construction no later than September 6, 2011.
ENVIRONMENTAL IMPACT:
This project has complied with all requirements of the California Environmental
Quality Act (CEQA).
FINANCIAL IMPACT:
On May 9, 2011, City Council awarded a construction contract in the amount of
$64,392.86 to Post earthworks Construction. Funds were budgeted from FEMA
reimbursements.
It is recommended that the project proceed with funding available within the Park
Improvement fund. This fund can only be used within City parks and exists from
contributions made from Park -In -Lieu. The estimated fund balance within fund
016 is currently at $144,158. After this requested expenditure, the account will
have a balance of $79,765.14. Funding of this project will not impact other
Capital Projects already funded by fund 016.
RECOMMENDATION:
It is recommended that the City Council adopt Resolution No. 6177 approving
Budget Amendment No. 2012 -02 -01 authorizing the use of Park in Lieu Funds to
repair slope failure within Gum Grove Park.

A RESOLUTION OF THE SEAL BEACH CITY COUNCIL
AUTHORIZING BUDGET AMENDMENT NO. 12 -02 -01 REVISING
THE FISCAL YEAR 2011/12 BUDGET
THE SEAL BEACH CITY COUNCIL HEREBY RESOLVES THAT:
Section 1 . The City Manager has requested the City Council amend its fiscal
year 2011/2012 budget to increase revenues and expenditures for the Heron
Pointe /Gum Grove Park Slope Repair (PR1101); and
Section 2. The City Manager has requested the City Council amend the fiscal
year 2011/2012 budget to increase revenues and expenditures as stated below.
The City Council hereby approves Budget Amendment No. 12 -02 -01 and directs
the City Manager to amend the FY 2011/2012 Budget to reflect the following
revisions and amendments:
