Further north are residential properties within the City of Seal Beach and City of Los Alamitos. SOUTH: Additional lease spaces within the Old Ranch Town Center in the General Commercial (GC) zone; Old Ranch Country Club golf course. WEST: Commercial /Retail lease spaces in the Shops at Rossmoor commercial development, within the General Commercial (GC) zone. EAST: Additional lease spaces within the Old Ranch Town Center in the General Commercial (GC) zone; Old Ranch Country Club golf course. ❑ As of August 11, 2011, Staff has received no comments, written or otherwise in response to the public hearing notices that were direct mailed and published with regard to this application. CUP 11 -10 12430 #E Seal Beach Boulevard PC Staff Report 2 Planning Commission Staff Report Conditional Use Permit 11 -10 12430 E' Seal Beach Boulevard August 17, 2011 DISCUSSI h _N`,.i.JANNTJ u1Nr 1. 13Hh9vl \1 + +4FVWlDh1 ?t.T,JPItiw The applicant is seeking approval to permit the on- premise sale of beer and wine at an existing sushi restaurant and grill located in the Old Ranch Town Center. The existing restaurant comprises approximately 1,545 square feet and is located towards west side of the Old Ranch Town Center development, between Z Pizza and Jamba Juice. The applicant is requesting approval for an on -sale beer and wine (Type 41) ABC license, which authorizes the sale of beer and wine for consumption on or off the premises where sold. Distilled spirits may not be on the premises, except for those distilled spirits used solely for cooking purposes. The license holder must operate and maintain the licensed premises as a bona fide eating place, and must make actual and substantial sales of meals during the normal meal hours that they are open, at least five days a week. With a Type 41 license, minors are allowed on the premises. Because of the nature of the applicant's business operation, the applicant wishes to provide the option of providing beer and wine to compliment food offerings within the restaurant. The restaurant's hours are currently from 11:00 a.m. until 9:00 p.m., seven days a week. Based on information received from the ABC, there is presently an over - concentration or undue concentration of existing alcohol licenses within the census tract. The maximum number of licenses allowed for census tract #1100.12, based on a census tract population of approximately 4,875 residents, has been exceeded by one license. ABC allows a maximum of 9 licenses within the census tract (6 on- premise licenses, 3 off - premise licenses) and there are currently 10 active licenses within the tract (7 on- premise licenses and 3 off - premise licenses). ABC bases the number of licenses allowed within a census tract on a combination of population figures within the census tract, as well as crime statistics. Staff has contacted Captain Tim Olson of the Seal Beach Police Department regarding the subject application, and Captain Olson has stated that SBPD does not anticipate any problems or have any objections with the issuance of an alcohol license at the subject address, as long as the applicant follows all ABC regulations with regard to sales and service of alcoholic beverages. Over Concentration of alcoholic beverage licenses has been an issue within the city in the past, particularly in areas with high crime reporting districts. The State's Alcoholic Beverage Control Act, Regulation 61.3, says that if an area has both high crime and an over concentration of ABC licenses, ABC can automatically deny an application for a liquor license. Several years ago, the City's Police Chief made a request to ABC that the City be placed under Regulation 61.3. The purpose of this request was to give ABC CUP 11 -10 12430 #E Seal Beach Boulevard PC Staff Report 3 Planning Commission Staff Report Conditional Use Permit 11 -10 12430 'E' Seal Beach Boulevard August 17, 2011 a basis on which to deny a license request. However, a City may approve a CUP application in an over concentrated area if it so desires. Staff believes the requested use is appropriate for the location. Given its location within a commercial center and the nature of the business, the distance to residential housing or adjacent properties at this location should not present any problems. There are no public areas within the commercial center at this location that abut residential areas and the rear building area that abuts residential properties and the north end of the center is separated from the residential area by an 8 foot solid block wall. Because this is a sit - down restaurant and not a bar, tavern, or restaurant with full - service alcohol, and because of the conditioned hours of operation, the potential for adverse impacts to the adjacent residential areas is minimal. Due to the overall design of this shopping center, the location of the business facing towards the interior parking lot area adjacent to Seal Beach Boulevard, and the fact that the nearest residential development is behind the business operation main activity areas and screened by the height of the block wall separating the shopping center from the residential areas, Staff believes the requested alcohol license with on- premise beer and wine is appropriate for this site. REC OMMENDATIO N .uaew+ay ;aicwanau «era.:i xaa .rai!en.w+movH Staff recommends the Planning Commission, after considering all relevant testimony, written and oral, presented during the public hearing, approve Conditional Use Permit 11 -10 via the attached Planning Commission Resolution No. 11 -24. Staff's recommendation is based on the following: ❑ CUP No. 11 -10 is consistent with the provisions of the Land Use Element of the City's General Plan, which provides a "Commercial - General" designation for the subject property and permits alcohol sales and consumption subject to the issuance of a Conditional Use Permit. The use as a sit -down restaurant with on- premise beer and wine sales is also consistent with the remaining elements of the City's General Plan as the policies of those elements are consistent with, and reflected in, the Land Use Element. Accordingly, the proposed use is consistent with the General Plan. ❑ The proposed use is conditionally permitted within the General Commercial (GC) zone and complies with all other applicable provisions of the Municipal Code. CUP 11 -10 12430 #E Seal Beach Boulevard PC Staff Report 4 Planning Commission Staff Report Conditional Use Permit 11 -10 12430 'E' Seal Beach Boulevard August 17, 2011 ❑ The building and property at 12430 'E' Seal Beach Boulevard are adequate in size, shape, topography and location to meet the needs of the use of the property. ❑ The location and operating characteristics of the proposed use is compatible with the character of the surrounding neighborhood, and would not adversely affect uses and properties in the surrounding neighborhood. ❑ The establishment, maintenance, and operation of the proposed use at the subject location would not be detrimental to the health, safety, and welfare of persons residing or working in the vicinity of the proposed use.
