The meeting was called to order with the Pledge of Allegiance. I ROLL CALL Present: Absent : Anderson, Gemmill, Gummere, Hamilton, Dreis None MINUTES Hamilton moved, second by Dreis, to approve the minutes of the March 4, 1968, regular meeting, as presented. AYES: NOES: Anderson, Gemmill, Gummere, Hamilton, Dreis None Motion carried. Payroll demands *2831 through *2954 of $35,125.11, and regular demands *3149 through *3272 of $36,314.50, as approved by the Finance Committee were presented. II PUBLIC HEARING-VACATION OF PORTION OF LOS ALAMITOS BOULEVARD The City Attorney conducted the public hearing on the vacation of a portion of Los Alamitos Boulevard. The City Clerk stated that notices had been posted and that no communications for or against the issue had been received. There was no communication from the audience. The Mayor declared the public hearing closed. The City Attorney recommended that Resolution Number 1641-"A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, ORDERING THE VACATION OF A PORTION OF LOS ALAMITOS BOULEVARD, BEINGi,A PORTION OF SUPERSEDED STATE HIGHWAY LOS ALAMITOS BOULEVARD, ROAD 07-0RA-605, IN THE CITY OF SEAL BEACH," be held over to next meeting. PUBLIC HEARING-WEED ABATEMENT II The City Attorney conducted the protest hearing on Weed Abatement. The City Clerk stated that all notices had been posted and that no communication had been received on the issue. There was no communication from the audience. The Mayor closed the public hearing. 2,60 PUBLIC HEARING-POSITION CLASSIFICATION The City Attorney conducted the public hearing on changes in classification plan as recommended by the Civil Service Commission. The City Clerk stated that the notices had been posted and that no communication had been received, for or against the issue. There I was no communication from the audience. The Mayor declared the public hearing closed. RESOLUTION NO. 1642-POSITION CLASSIFICATION The City Attorney presented Resolution No. 1642 by tit1e-"A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, AMENDING RESOLUTION NUMBER 1561 BY ADDING CERTAIN POSITIONS TO THE WAGE AND SALARY SCHEDULE." Gemmill moved, second by Dreis, to adopt Resolution No. 1642. AYES: NOES: Anderson, Gemmill, Gummere, Hamilton, Dreis None Motion carried. RESOLUTION NO. 1643-POSITION CLASSIFICATION The City Attorney presented Resolution No. 1643 by.' title-"A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH AMENDING THE POSITION I CLASSIFICATION PLAN BY ADDING THERETO CERTAIN POSITIONS RELATING TO WATER UTILITY OPERATIONS." Gummere moved, second by Dreis, to waive the second reading of Ordinance No. 748, deem that it has had the second reading and be passed for adoption. RESOLUTION NO. l646-GRANT DEED The City Attorney presented Resolution No. 1646 by title-"A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, ACCEPTING A GRANT DEED FROM LAKEWOOD RANCHO AND LOS COYOTES LAND CO." PLANNINC COMMISSION RESOLUTION NO. 204 The City Attorney presented for ratification Planning Commission Resolution No. 204, approving variance UV-1-68 to allow construction and operation of a Jack-in4the-Box restaurant in the Cl-service commercial zone (McFarland). I Mr. Ralph Allen, Food Makers, Inc., discussed the landscape plan wi th Council. Gemmill moved, second by Dreis, to ratify the action taken by the Planning Commission in their Resolution No. 204. JJ RESOLUTION NO. 1647 AND NO. 1648 The City Attorney presented Resolution No. 1647 by title-"A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, A CHARTER CITY, ACCEPTING A Q6IT CLAIM DEED FROM THE UNITED STATES OF AMERICA. II The City Attorney presBated Resolution Ne. 1648 by title-"A RESOLUTION OF THE C~TY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, A CHARTER CITY, AUTHORIZING THE EXECUTION AND RECORDING OF A WARRANTY DEED FOR A PARCEL OF LAND TO THE UNITED STATES OF AMERICA." RESOLeTION NO. 1649-WATER REVENUE BONDS The City Attorney presented Resolution No. 164~ by title-"A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, DIRECTING THE CITY CLERK TO PUBLISH NOTICE INVITING BIDS FOR WATER REVENUE BONDS IN THE PRINCIPAL AMOUNT OF $700,000. DuBourdieu Economy Builders $81,345.00 80,949.00 74,225.00 74,460.00 79,923.00 74,267.00 67,884.00 The City Attorney noted that the low bidder, Economy Builders, listed few sub-contractors. Mr. R. W. Dunne, partner, EcoDomy Builders, 907 W. Anaheim Street, Wilmington, California, assured the Council that the items not listed on his bid as being sub-contracted would be performed by Economy Builders as general contractors. The City Attorney requested the letter dated March 18, 1968, to .'the City Manager from Economy Builders, to included in the minutes: "We are prepared to sign a contract with the City of Seal Beach for the construction of Fire Station Number 3. We are aware of, and agree that, the contract wi~l be contingent upon the definite and final acquisition of the site property by the City. Should the City of Seal Beach fail to secure the property, the contract will not be binding upon it. (Signed: R. W. Dunne, partner)." Mr. Dunne further stated that he understood that any award for the contract would be with the understanding that the city would not execute the contract or be under any obligation to execute it if possession of the land was not obtained by the City. Hamilton moved, second by Dreis, to award the contract to the lowest responsible bidder, Economy Builders, for total bid of $67,884.00 (consisting of lump sum base bid $57,945.00, Alternate Div. No. 1- $5,989.00; Alternate Div. No. 2-$4,055.00; and Alternate Div. No. 3- $795.00) contingent upon acquisition'of title, declare all other bids rejected and authorize the City Manager to execute the contract. COMMUNICATION-NEWPORT BEACH-PRESERVATION OF BEACHES The City Manager read communication from the City of Newport Beach asking fo~ support of their Resolution No. 6715 opposing offshore drilling operations and declaring a policy of preservation and protection of the tidelands area of Newport Beach for recreational purposes. Gemmill moved, second by Gummere, that the City Manager prepare a resolution for the next meeting, supporting the Newport Beach action. MORRIS-SURFING REGULATIONS The City Manager read communication from Mr. & Mrs. G. W. Morris, 1319 Seal Way, Seal Beach, requesting relaxed surfing restrictions. There was a short discussion with Mr. Morris, the Council, and Mrs. Jo MaGilvry, 1000 Mar Vista Avenue, taking part. The City Manager read the surfing regulations now in effect. Gemmill moved, second by Gummere, that the Mayor appoint a committee to study the problem. AYES: NOES: Anderson, Gemmill, Gummere, Hamilton, Dreis None Motion carried. The Mayor appointed Councilman Hamilton, Councilman Gemmill, the City Manager, Mr. Morris, and Mr. Espoy to serve on the committee; Mayor to serve as alternate. BUILDING DEPARTMENT REPORT It was the order of the Mayor to receive and file the Building Department report for the month of February, 1968.
