Hamilton moved, second by Gummere, that the City Manager prepare a resolution in support of Mr. Hinshaw's stand. AYES: ABSENT: Anderson, preis, Hamilton, Gummere Gemmi 11 Motion carried. The Council decided to hold over to next meeting the setting of public hearing for the 1968-69 Budget. Councilman Gummere referred to item 10 of the agenda, communication from Costa Mesa urging support of Assembly Bills 1604 and 1474, and moved that we support'the City of Costa Mesa"on this issue, that the ~ity Manager advise Costa Mesa and representatives in Sacramento by letter to that effect. Hamilton seconded the motion. The meeting was called to order with the Pledge of Allegiaace. ROLL CALL Present: Gummere, Dreis, Hamilton Absent : Anderson, Gemmill Hamilton moved, second by Dreis, to excuse the absence of Councilman Anderson and Gemmill. 302 AYES: ABSENT: Gummere, Dreis, Hamilton' Anderson, Gemmill Motion carried. The City Attorney and City Manager arrived at 12:15. AWARD OF BID-PROJECT WS-6-05-0183 Vice Mayor Gummere turned the meeting over to the City Attorney to state legal facts involved in the matter. The City Attorney stated the facts of the bids and informed the Council of HUD requirements. Mr. Phillip Bush, Attorney for Sanitary Pipeline, and Mr. William Poole representative of Sanitary Pipeline Company made statements regarding capability, and qualifications of Sanitary pipeline,to do the job as required.' There was discussion by members of Council, City Attorney and representatives of Sanitary Pip~line. Mr. Bob Drayton, 210 W. 7th Street, Los Angeles, Attorney for Bovee & 1 Crail, the second 'lowest bidder, stated the facts of qualifications per specification of his client. 'After more discussion, the City Attorney requested legal conference with the City Gouncil. Vice Mayor Gummere adjourned the meeting for legal conference at 1:00 p.m. I- The meeting reconvened at 1:32 p.m~. The City Attorney recommended to Council three alternatives regarding Project WS-6-05-0183: the first, to accept the low bid with waiver of specification of experience'requirements and list of suppliers; the second, to accept the bid of Bovee & Crail, their bid be~ng technically correct in all respects; and third, to rejec~ all bids, subject to approval of HUD, direct the City Manager to re-advertise for bids, subject to the approval of HUD. " , Hamilton noted that three of the six bidders did not comply to specifications and since the size and import mf(the contract was considerable moved that all bids be rejected with the concurrence of HUD, and directed the City Manager to advertise for bids, subject to the approval of HUD. Mrs. Dreis seconded the motion. I AYES: ABSENT: Gummere, Dreis, Hamilton Anderson, Gemmill Motion carried. ORANGE COUNTY FLOOD CONTROL DISTRICT PERMIT Dreis moved, second by Hami~ton, to approve the permit for District project Los Alamitos 'Channel and Basins and authorize the City Manager to execute the agreement. Hamilton moved seQond by Dreis, to hold a study session of the 1968-69 Budget at 9:00 a.m., Saturday, June 15, 1968, and to set the Public Hearing for the 1968-69 Budget at 10:00 a.m., Saturday, June 29, 1968. AYES: Absent: Gummere, Dreis, Hamilton Anderson, Gemmill Motion Carried. RESOLUTION NO. 1676 - CANVASS - GENERAL MUNICIPAL ELECTION The City ~anager presented proposed Resolution No. 1676 by title -"A , RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, A CHARTER CITY, RECITING THE FACTS OF THE GENERAL MUNICIPAL ELECTION HELD IN SAID CITY ON THE FOURTH DAY OF JUNE, 1968, DECLARING THE RESULTS THEREOF, AND SUCH OTHER MATTERS AS ARE PROVIDED BY LAW."
