Gummere moved, second by Fuhrman, to reappoint Mr. Hamilton as the City's representative to the District for the next two year term ending December 31, 1970. The meeting was called to order with the Pledge of Allegiance. ROLL CALL Present: Mayor Gummere Councilmen Anderson, Dreis, Fuhrman Absent: Councilman Hamilton Gummere moved, second by Anderson, to excuse the absence of Mr. Hamilton. AYES: NOES: Absent: Gummere, Anderson, Dreis, Fuhrman None Hamilton Motion carried. 400 APPROVAL OF MINUTES Anderson moved, second by Fuhrman, to approve" the minutes of the December 2, 1968 regular meeting, as presented. APPROVAL OF DEMANDS Regular Demands "115463 through 115592 of $99,99"1.95 and Payroll Demands 115377 through 115513 of $42,013.41 were presented by the Mayor as approved by the Finance Committee. ORAL COMMUNICATIONS Leo C. Moony, 206 lOth Street, Seal Beach-addressed the Council with regard to condition of sidewalks in" the" area of Electric and Main, and weed condition at 10th and Central. Councilman Anderson offered to-look""into the matter with him. There were no other 1 communications, the Mayor closed oral communication. PETITION - HELLMAN PROPERTY The City"Manager presented a petition- signed" by homeowners in the Crestview Avenue area and submitted by Robert Wenger relating to mud condition on the Hellman Estate. The City Manager reported that the Hellman owners had agreed to fence the area "in question and that the City would fence that portion at Avalon Street. Robert Wenger, 1205 Crestview Avenue, Seal Beach "spoke at length on the condition set forth in the petition. It was the order of . the Mayor, with concurrence of Council, to receive and file the petition. NOTICE OF HEARING - WESTMINSTER Gummere moved, second by Anderson, to support the Planning I Commission of the City of Westminster relating to the public hear- ing notice on Zone change R-140 and authorize the City Manager to direct a letter to the City of Westminster regarding this action. COMMUNICATION - WESTMINSTER - TRANSFER OF TERRITORY It was the order of the Mayor, with concurrence of Council, to refer 401' for study the communication from the City of westminster regarding the proposed transfe~ o~.territory along Bolsa Chica Road. Council Item *8 - C~mmunication from ~ity of El Segundo relating to 1 closing Mexican/American border to minors. RESOLUTION NUMBER 1736 - COMMENDING ADMINISTRATION DR. HAYAKAWA. The City Manager pres~nted.resolution from City of San Clemen~e commending the actions of Dr. S. I. Hayakawa in his adminis~ration of San Francisco State College. The City Attorney read in full Resol~tion Number 1736 entitled "A" RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SE~ BEACH, CAL~FORNIA, COMMENDING THE STAND OF DR. S. I. HAYAKAWA IN .HIS ADMINISTRATION OF SAN FRANCISCO STATE COLLEGE AND URGING ALL THOSE IN ACADEMIC AUTHORITY TO GIVE FULL SUPPORT TO THE ACTING PRESIDENT OF SAN FRANCISCO STATE COLLEGE." APPLICATION - ABC LICENSE - COMMINOS It was the order of the Mayor to refer to the Planning Commission the application for On-Sale General Bona Fide ~ating Place ABC license from Mic~ael W. Comminos at 1600 Pacific Coast Highway. 402 PERMIT - ORANGE COUNTY FLOOD CONTROL DISTRICT It was moved by Fuhrman, second by Dreis, to renew the County Flood Control Permit and that the City Manager be authorized to execute same. I AIRPORT LAND USE COMMISSION The City Manager presented Resolution of the Board of Supervisors of Orange County, this item held over from last meeting. The Mayor reported that the League of Cities had appointed an ad hoc committee and that a report from this committee would be forthcoming. The Mayor ordered, with concurrence of Council, to receive and file the resolution. VARIANCE UV-6-68 - PETER J. TRAMA The City Manager. presented Planning Commission Resolution *263 approving Use Variance to permit an eating establishment with. cocktail lounge in C-l Zone. Restrictions included in the resolution were noted. Anderson moved, second by Dreis, to approve Planning Commission Resolution Number 263. RESOLUTION NUMBER 1737 - CIVIL OBEDIENCE The City Manager presented Resolution Number 1737 by title "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, CALLING. FOR RESPECT FOR LAW AND ORDER AND CIVIL OBEDIENCE." Gummere moved, second by Fuhrman, to adopt Resolution No. 1737. AYES: NOES: ABSENT: Gummere, Anderson, Dreis, Fuhrman None Hamilton Motion carried. RESOLUTION NUMBER 1738 - STREET LIGHTS The City Manager presented Resolution Number 1738 by title, "A I RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, A CHARTER CITY, REQUESTING THE ,.ORANGE COUNTY BOARD OF SUPERVISORS TO EXCLUDE A STRIP OF LAND WITHIN THE CITY OF SEAL BEACH FROM ORANGE COUNTY STREET LIGHTING MAINTENANCE DISTRICT NO. 14." RESOLUTION NUMBER 1739 - ELECTION RESULTS - CHARTER The City Manager presented Resolution Number 1739 by title, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, RECITING THE FACTS OF THE SPECIAL ELECTION HELD IN SAID CITY ON THE FIFTH DAY OF NOVEMBER, 1968, DECLARING THE RESULTS THEREOF, AND SUCH OTHER MATTERS AS ARE PROVIDED BY LAW." and presented the County Clerk's certificate of canvass. Fuhrman moved, second by Dreis, to approve the County Clerk certificate of canvass results of the City of Seal Beach Special Municipal Election consolidated with the General Election Held November 5, 1968. AWARD OF BID - AQUATIC PARK WATER & SEWER MAIN The City Clerk read the bids for the Water & Sewer Main, Aquatic Park, opened December 2, 1968 at 2:00 p.m. as follows: G. R. McKervey/Gallagher Inc. $353.783..30 $353,789.30 $360,531.90 $365,019.90 with correction in tabulation amount should be Hood Corporation with correction in tabulation amount should be Fuhrman moved, second by Gummere, to award the bid to the lowest responsible bidder, McKerv~y/Gallagher in the amount of-$353,789.30, declare all other bids rejected contingent upon the approval of the County, and authorize the City Manager to execute the contract. AWARD OF BID - CATHODIC PROTECTION - RESERVOIR The City Manager read the bid received rom Electro-Rustproofing Corporation for cathodic protection of water reservoir in the amount of $4,695.00. This mid was opened December 2, 1968 at 2:00 p.m. by the City Clerk. The City Engineer's memorandum I recommending the bid be accepted was submitted. Furhman moved, second by Dreis, to award the bid to Electro-Rustproofing as the lowest responsible bidder and authorize the City Manager to execute the contract. ORDINANCE NUMBER 775 - REQUIRED SHOWING FOR VARIANCES The City Manager presented Ordinance Number 775 for second reading by title, "AN ORDINANCE OF THE CITY OF SEAL BEACH, CALIFORNIA, AMEND- ING ARTICLE 20, SECTION 2002 OF ORDINANCE NO. 628 (ZONING), REQUIRED SHOWINGS FOR VARIANCES." Gummere moved, second by Anderson, to waive the second reading of I Ordinance Number 775, deem that it has had second reading and be passed for adoption. REQUEST FOR EXCUSED LEAVE Dreis moved, second by Fuhrman, to grant an excused leave to Councilman Anderson for the month of January through February 3, 1968. The City Manager reported that the truck referreq to had been removed from the street and that the garage operated on a legal non-conforming use permit. BUILDING DEPARTMENT REPORT The Mayor commending the Building Department for the 4~ million dollai increase in value of permits over last year, and ordered that the report be received and filed.
