Upon the recommendation of the City Manager and Director of Public Works. it was moved by Leonard and seconded by Griswold to employ Engineering Science Incorp'orated to make a study of the ..' existing sewage plant capacity. California August 19. 1963 The City Council of the City of Seal Beach met in regular session at 8:00 p!m. with Mayor Pro-tem Leonard presiding. The meeting was called to.order with the Pledge of Allegianoe. Present: Mayor Pro-tem Leonard Councilmen: Nescher. Anderson. Griswold Absent: Mayor Gemmill It was moved by Anderson and seconded by Nescher to approve . the minutes of August 5. 1963 as presented. AYES: . ABSENT: Nescher. Anderson, Griswold. Leonard Gemmill Motion carried. Payroll demands No. 391 to 485 inclusive and regular demands No. 3461 to 3518 inclusive, totaling $93.040.64 as approved by the . Finance Committee were,presented. It was moved by Anderson and seconded by Griswold that the resignation of Jack Randall as a member of the Civil Service Commission Nescher. Anderson. Upon the advise of the City 'Attorney it was moved by Griswold and seconded by Nescher that the City Council deny the claim of Floyd Mitchell for damages and to so advise Mr. Mitchell in uare of his attorney. AYES: ABSENT: Nescher. Anderson. Griswold. Leonard Gemmill Motion carried. The hearing on the appeal of the Biyu license suspension was delayed until 8:30 for lack of the. presence of the parties involved. The Council acknowledged the presence of the court reporter from Pina and Manning. I Mrs. yiola Mendoza. 126 Main Street. as chairman of the Artist's Coop Group. offered to repaint the Sun Room. if the City would furnish the paint. The Council accepted the offer and re- ferred it to the City Manager. Mr. Sullivan. Attorney representing Mr. and Mrs. Neel in the Biyu license suspension hearing. addressed the Council on behalf of his clients, contending that the findings of the City Manager are without basis of fact. The City Attorney recommended that Mr. Sullivan present his side of the case in regards to his finding of facts. A general discussion of procedures followed. The City Manager answered all the charges. ~ further general discussion followed.. The Mayor Protem declared a five minute recess. The meeting reconvened at 9:15 p.m. It was moved by Nescher and seconded by Anderson to hear the arguments of Mr. Sullivan. AYESl Nescher. Anderson, Griswold. Leonard ABSENT: Gemmill I Motion carried. Mr. William's letter of suspension of August 8. 1963 was presented to the court reporter for his record. Mr. Sullivan presented his arguments in behalf of his clients. Mr. Griswold disqualified himself from making a decision in the matter as he had given testimony in the earlier hearing. Mr. Sullivan continued his arguments. The City Attorney outlined the City Manager's position in the matter and the findings of specific charges. The City Manager presented his arguments in suspending the license. Mr. Sullivaa presented his rebuttal. The Mayor Pro-tem declared a five minute recess. It was moved by Anderson and seconded by Nescher that the City Managers decision be upheld at a thirty day suspension and that the appeal be denied. AYES: . Nescher. Anderson. Leonard DISQUALIFIED: Griswold ABSENT: Gemmill Motion carried. Mr. Sullivan asked if Mr. Leonard ~~s~, vote~ should be disqualified because of attendance at some of the hearings. Griswold. Leonard Gemmill Motion carried. The reports of the City, Officers for the month of July. 1963 were received and filed. The City Manager reported that the failure of the Seal Beach Post and Wave to properly publish the legal notices advertising for bids had disqualified bid openings on the signalization of Bay Blvd. and Leisure World. Leonard' , Gemmill Motion carried. The City Attorney reported that the attorney for the Post Lege] and Wave had ignored his calls in regard to settling the matter of Advel being a legal newspaper. The City Manager presented a proposed detachment of Bolsa , Bolsl Chica Road by exclusion or deannexation. Mr. Biby of Douglas Air- craft Corporation told of the employment probabilities and:the Chicl ROad traffic problems involved. ceed as outlined. The progress of the pro~osed City Charter was disc~ssed. It was decided that each Councilman select five committmen from this . Char Cit' .......... area and the City Manager select ten committeemen from Leisure World to discuss the proposed charter. The City Manager presented a petition requesting one hour parking for 8th and lOth Streets from Ocean Avenue and Ocean Avenue from 8th to 11th Streets with ~arking permits for residents of the area. It was moved by Nescher and seconded by Anderson thaj one Park !!!L 188 hour parking be established in the arem from 7:00 a.m. to 6:00 p.m. with parking permits. AYES: ABSENT: Nescher, Anderson.
