Crumby P.E., Assistant City Manager /Public Works SUBJECT: APPROVE PLANS AND SPECIFICATIONS, AWARD CONTRACT FOR RIVER'S END STAGING AREA AND BIKEWAY ENHANCEMENT PROJECT NO. BP0901, AND APPROVE DESIGN AGREEMENT AMENDMENT NO. 1 SUMMARY OF REQUEST: The City Council is asked to: • Approve Plans and Specifications for the River's End Staging Area and Bikeway Enhancement Project No BP0901. • Adopt Resolution No. 6185 awarding a contract for the River's End Staging Area and Bikeway Enhancement Project No. BP0901 to Golden State Constructors in the amount of $1,624,191.85. • Approve Resolution No. 6186 approving Amendment No. 1 to Agreement to RBF Consulting for additional Coastal Commission permitting submission requirements in the amount of $31,620. BACKGROUND AND ANALYSIS: At the November 11, 2007 City Council Meeting, Council authorized the City Manager to sign an agreement with the Rivers and Mountains Conservancy (RMC). This agreement provides $2,000,000 to the City to provide enhancements to portions of the San Gabriel River trail system. Some of these enhancements include; a new paved surface for the bike trail, new pavement for the terminus of the River Trail at 1 Street and Ocean Avenue, seating, bike racks, redesigned parking with new landscaping and lighting and restroom upgrades. The majority of the Grant funds are set to expire by the end of the Fiscal Year 2011/2012. At the October 13, 2008 City Council Meeting, Council authorized the City to enter into an agreement with RBF Consulting to provide construction drawings and specifications, environmental documentation and to secure necessary permits. The process for securing a Coastal Commission Permit has been Agenda Item F cumbersome and took over 18 months to secure a hearing with the Commission. At the hearing, the Commission approved the City's tentative application for a permit conditioned on adhering to a number of special conditions that will require the City to provide the Commission with additional agreements, documents and plans. Many of these items are above the typical process for securing a Coastal Commission permit and will require an amendment to the design agreement to complete. On September 14, 2011, the City Clerk's office received six bids with the following results: RANK I CONTRACTOR BASE BID 1 I S Constru $1, 624,191.85 -- 2 _ Elite Bobc Ser Inc. $1,71 - -- 3 - - Exc Pavi Comp $ 1 ,8 78,239.7 5 _- 4 - -! Nobe st, In - -- j 4 -Con Engineer Inc _ — 1 $1,8 - _ $1 5 6 I Rancho Pacific Engineering, Inc. $2,155,732.61 Based upon the references, qualifications, work experience and cost, staff recommends selecting Golden State Constructors as the lowest responsive bidder at $1,624,191.85. It is anticipated that the City can secure the Coastal Commission Permit by the beginning of October, begin construction by the end of October and be completed by the end of Spring before the grant funds timeline expires. The City Attorney's office has approved a boilerplate template construction agreement to be used for this type of project. The contractor has signed the agreement and it is included in this staff report. Exhibits to that agreement, including bonds and insurance documents will be provided to the City upon award of contract. ENVIRONMENTAL IMPACT: This project complies with all requirements of the California Environmental Quality Act (CEQA). A Mitigated Negative Declaration document was prepared for the project and approved under Resolution #6111 on February 14, 2011. LEGAL ANALYSIS: The City Attorney has reviewed and approved the City's standard Design Professional Services Agreement. Page 2 FINANCIAL IMPACT: This project is funded through the Water Security, Clean Drinking Water, Coastal and Beach Protection Act of 2002 (Proposition 50) and administer to the City by the RMC. The City was awarded grants funds of $2,000,000 to cover the cost of design, construction, and inspection and there is no City match requirement. The cost for design, with the requested amendment is $330,443. The cost for inspection is anticipated at $40,000 which .leaves $1,629,557 for construction. The funds are sufficient to complete this project. RECOMMENDATION: It is recommended that the City Council: Approve Plans and Specifications for the River's End Staging Area and Bikeway Enhancement Project No BP0901. Adopt Resolution No. 6185 awarding a contract for the River's End Staging Area and Bikeway Enhancement Project No. BPO901 to Golden State Constructors in the amount of $1,624,191.85. Approve Resolution No. 6186 approving Amendment No. 1 to Agreement to RBF Consulting for additional Coastal Commission permitting submission requirements in the amount of $31,620.
