Persico, AICP, Director of Development Services SUBJECT: REQUEST FOR INITIATION OF CITY BOUNDARY LINE ADJUSTMENT (ANNEXATION 11 -01) PURSUANT TO CORTESE - KNOX - HERTZBERG ACT DETACHING 71.24 ACRES OF UNINHABITED TERRITORY SUMMARY OF REQUEST: That the City Council initiate Local Agency Formation Commission (LAFCO) proceeding to detach 71.24 acres of uninhabited territory from Seal Beach, which will ultimately be incorporated into the City of Long Beach. BACKGROUND AND ANALYSIS: On July 12, 2010, the City Council adopted Resolution No. 6030 initiating a joint boundary line adjustment between Long Beach, Seal Beach and Los Alamitos. The original proposal affected seven separate areas, with five in Seal Beach. Since that time the number areas has been reduced to three in Seal Beach; all of which are uninhabited. In addition to being uninhabited, the three areas are largely along and in the San Gabriel River and River bike trail as follows: Area Al = 44.51 acres south of Marina Drive bridge along the west side of the San Gabriel River rock revetment in the Ocean. Area A4 = 5.79 acres north of PCH along the east side of the Haynes cooling channel. Area A5 = 20.94 acres north of the 22 Freeway on the west side of the San Gabriel River which includes a 1.5 acre park, which is maintained and used by Long Beach. The City Council is being asked to adopt a new resolution for just the three affected areas listed above and a resolution redistributing property tax revenues for the largely vacant land. Agenda Item D ENVIRONMENTAL IMPACT: This action is exempt from the California Environmental Quality Act under Section 15061 (b)(3) due to the fact that there is no potential to significantly effect the environment. LEGAL ANALYSIS: The City Attorney has reviewed and approved as to form. FINANCIAL IMPACT: There is no lose of tax revenue because the land is publicly owned or within the San Gabriel River bottom. RECOMMENDATION: That the City Council adopt Resolution No. 6192 (Initiating Annexation /Detachment) and Resolution No. 6193 (Property Tax Sharing). Further, that the City Council authorize the City Manager to file and sign the necessary applications with the Local Agency Formation Commission (LAFCO). SUBMITTED BY: Mark H. Resolution No. 6193 (Property Tax Agreement) Page 2 RESOLUTION NUMBER 6192 A RESOLUTION OF THE SEAL BEACH CITY COUNCIL MAKING APPLICATION TO AND REQUESTING THE LOCAL AGENCY FORMATION COMMISSION OF ORANGE COUNTY TO TAKE PROCEEDINGS PURSUANT TO THE CORTESE -KNOX- HERTZBERG LOCAL GOVERNMENT REORGANIZATION ACT OF 2000 TO DETACH APPROXIMATELY 71.24 ACRES OF PROPERTY IN THREE AREAS AND FILE ANNEXATION NO. 11 -01 WHEREAS, City of Seal Beach ( "City ") desires to initiate proceedings pursuant to the Cortese- Knox - Hertzberg Local Reorganization Act of 2000, Division 3, commencing with Section 56000 of the Government Code, for the annexation (and /or detachment) of unincorporated territory to the City; and WHEREAS, the City will file an application with the Local Agency Formation Commission to detach 71.24 acres of uninhabited property in three areas as set forth in Exhibit 1 (Al, A4 and A5), attached hereto and by this reference incorporated herein; and WHEREAS, the proposal includes changes to the boundary line between the County of Orange and the County of Los Angeles. This proposal is processed pursuant to Article 4, Chapter 2, Division 1 of Title 3 of the Government Code (Section 23200 et seq). The proposal also includes a detachment from the City of Seal Beach, detachments from the City of Long Beach, annexations to the City of Long Beach, annexations to the City of Seal Beach and annexation to the City of Los Alamitos. These proposals are processed pursuant to the Cortese -Knox- Hertzberg Local Government Reorganization Act of 200 (Government Code Section 56000 et seq). All proposals are linked and no proposal shall be effective until all proposals are effective. The two county ordinances shall state that they shall not become effective until every city change of organization is effective. Each city change of organization shall not become effective until all city changes of organization are recorded and the two county ordinances are effective; and WHEREAS, the Orange County and Los Angeles County Boards of Supervisors are proposing to make changes to five (5) areas in the boundary line between the County of Orange and the County of Los Angeles; and WHEREAS, this proposed annexation or reorganization be subject to the following terms and conditions: the annexation shall be consistent with Government Code Section 56375.3. (a) and other applicable law existing as of the date of the filing of this Resolution; and WHEREAS, the reason for the proposal is to provide boundary adjustments of uninhabited areas so that the border between Los Angeles County and Orange County is more closely aligned with the Coyote Creek Flood Channel and will allow for better service delivery and improved public safety; and WHEREAS, this action is exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to the CEQA Guildelines, California Code of Regulations, Title 14, Section 15601 (b)(3) because there is no potential that the proposed changes in the city boundaries will have a significant effect on the environment NOW THEREFORE, BE IT RESOLVED, that the City Council of the City of Seal Beach, California, does hereby approve the Resolution of Application for Annexation No. 11 -01, and requests the Local Agency Formation Commission of Orange County take proceedings for the detachment of 71.24 acres in three areas from the City, as shown in Exhibits Al, A4, and A5, attached hereto and incorporated herein by this reference, according to the terms and conditions Resolution Number 6192 stated above and in the manner provided by the Cortese - Knox - Hertzberg Local Government Reorganization Act of 2000. The City of Seal Beach and Long Beach have jointly requested a boundary adjustment to allow for the more orderly provision of public services. Section 2 . Section 99 (b)(6) of the Revenue and Taxation Code requires jurisdictions involved in any such boundary change to agree to a property tax redistribution prior to certification of such change in boundary. Section 3 . The City of Seal Beach concurs with the City of Long Beach that the tax revenues accruing for the territory being annexed to the City of Long Beach be allocated in total to the City of Long Beach. Section 4 . The redistribution of property tax only involves the 71.24 acres in three areas covered by Annexation 11 -01 (Resolution 61xx). Section 5 . The Council hereby instructs the Director of Development Services to file a notice of determination with the County of Orange and authorizes staff to proceed with all steps necessary to implement the Project.
