SUBJECT: CONDUCT A SECOND PUBLIC HEARING TO
INTRODUCE ORDINANCE NO. 1613 - 2010 CITY
COUNCIL REDISTRICTING
SUMMARY OF REQUEST:
That the City Council conduct a second public hearing to introduce Ordinance
No. 1613 establishing new City Council Districts as a result of the 2010 Census.
BACKGROUND AND ANALYSIS:
The City Council appointed a Redistricting Subcommittee consisting of Mayor Pro
Tern Miller and Councilmember Shanks. The Subcommittee met on July 26 and
September 19, 2011, and made a recommendation to the City Council on
September 26, 2011, as follows:
1) That no changes be made to Districts 2, 4, and 5; and
2) That the boundary between Districts 1 and 3 be modified by moving
the blocks of 4 th , 5th and 6 Streets between Central Avenue and
Marina Drive from District 3 to District 1. The change would result in
moving 241 residents from District 3 to District 1.
During the September 26th City Council public hearing, several options were
discussed to further modify the boundary between District 1 and 3. At the
conclusion of the hearing staff was directed to explore options to include the
property along the north side of Central Avenue between 4 Street and 2 nd Street
into District 1. The Council also directed staff to consider including the property
on the west side of 4 Street between Central and Marina into District 1.
Staff examined both suggested changes. Including the properties on the north
side of Central into District 1 is relatively straightforward because that area is
within one Census block group that contains 33 residents. However, including
the property on the west side of 4 Street into the District is difficult, given that
the Census block group also includes the Marina Palms apartment complex at
350 Marina Drive. That block group includes 123 residents, and moving all the

residents would make District 1 too large. Therefore, the final recommendation
would move 274 residents from District 3 to District 1. The areas to be moved
are: 0 Stn and 6 th Streets between Central Avenue and Marina Drive, and the
north side of Central Avenue between 2 nd and 4 th Street. The two tables below
show the existing District population distribution and the recommended District
population distribution.

The attached maps show the boundaries for all five City Council Districts, but
only Districts 1 and 3 are being modified.

ENVIRONMENTAL IMPACT:
This action is exempt from the California Environmental Quality Act, because it is
not defined as a "project" under CEQA.
LEGAL ANALYSIS:
The City Attorney has reviewed and approved as to form.
FINANCIAL IMPACT:
There is no fiscal impact created by a potential Council District boundary change.
RECOMMENDATION:
That the City Council close the public hearing and Introduce Ordinance No. 1613
establishing new City Council District boundaries for Districts 1 and 3, and
keeping the existing District boundaries for Districts 2, 4 and 5.

ORDINANCE NUMBER 1613
AN ORDINANCE OF THE CITY OF SEAL BEACH
ESTABLISHING CITY COUNCIL DISTRICT BOUNDARIES AS A
RESULT OF THE FEDERAL 2010 DECENNIAL CENSUS
THE CITY COUNCIL OF THE CITY OF SEAL BEACH ORDAINS AS FOLLOWS:
SECTION 1. City Charter Section 515 provides, in relevant part:
"The five (5) members of the City Council shall be elected by districts, the
boundaries of which shall be as defined by ordinance adopted by the City
Council.
In 1980 and each 10th year thereafter, the City Council shall appoint a committee
to study and report to the City Council on the advisability of redistricting the City.
Upon receipt of any such committee report, and at any other time deemed
necessary or desirable in order that the district boundaries be in accordance with
constitutional requirement, fair and logical, the City Council may by ordinance
change and redefine the boundaries of any or all of such districts. The
boundaries so defined shall be established in such manner that the district shall,
as nearly as practicable, constitute natural areas of contiguous and compact
territory and provide fair representation on the City Council."
SECTION 2. California Elections Code Section 21620 states:
"If the members of the governing body of a chartered city are nominated or
elected 'by districts' or 'from districts,' as defined in Section 34871 of the
Government Code, upon the initial establishment thereof, the districts shall be as
nearly equal in population as may be according to the latest federal decennial
census or, if the city's charter so provides, according to the federal mid - decade
census or the official census of the city, as provided for pursuant to Chapter 17
(commencing with Section 40200) of Part 2 of Division 3 of Title 4 of the
Government Code, as the case may be. After the initial establishment of the
districts, the districts shall continue to be as nearly equal in population as may be
according to the latest federal decennial census or, if authorized by the charter of
the city, according to the federal mid - decade census. The districts shall comply
with the applicable provisions of the federal Voting Rights Act of 1965, Section
1973 of Title 42 of the United States Code, as amended. In establishing the
boundaries of the districts, the council may give consideration to the following
factors: (1) topography, (2) geography, (3) cohesiveness, contiguity, integrity,
and compactness of territory, and (4) community of interest of the districts."
SECTION 3. Pursuant to the Charter, The Council has appointed a committee to
study and report to the City Council on the advisability of redistricting the City
upon receipt of the 1980, 1990 and 2000 federal decennial censuses. The last
time the Council changed district boundaries was in connection with the 1990
census, by adopting Ordinance No. 1344. In connection with the 2010 census,
the City Council appointed a subcommittee of two councilmembers to study and
report to the City Council on the advisability of redistricting the City. The
subcommittee met on July 26, 2011, and September 19, 2011, to review Council
District boundaries and make a recommendation to the City Council. On
September 26, 2011 and October 10, 2011, the City Council held duly noticed
public hearings to receive testimony and evidence regarding the subcommittee's
report regarding council district boundaries.
SECTION 4. The City Council and its subcommittee considered: (1) topography;
(2) geography; (3) cohesiveness, contiguity, integrity, and compactness of
territory; (4) community of interest of the districts; and (5) principles of fair
representation to determine whether any of the boundaries of the districts should
be changed or modified.
Ordinance Number 1613
SECTION 5. In view of the foregoing:
A. The boundaries for City Council Districts 2, 4 and 5 are to remain
unchanged from the boundaries established by Ordinance No. 1344.
B. The Council hereby changes and modifies the boundaries for City
Council Districts 1 and 3 to the boundaries shown on Exhibit A. Exhibit A is
hereby incorporated into this Ordinance by this reference.
SECTION 6. The City Clerk shall certify to the adoption of this ordinance.
PASSED, APPROVED AND ADOPTED by the City Council of the City of Seal
Beach at a regular meeting held on the day of , 2011.
