Ingram, City Manager FROM: Sean Crumby, Assistant City Manager/ Public Works SUBJECT: WAIVER OF FEES AND INSURANCE REQUIREMENTS FOR MEMORIAL SERVICES AND FUNDRAISING EVENTS RELATED TO THE SHOOTING AT SALON MERITAGE SUMMARY OF REQUEST: That the City Council adopt Resolution No. 6197 authorizing the City Manger to waive fees and insurance requirements for memorial services and fundraising events related to the October 12, 2011 shooting at Salon Meritage. BACKGROUND AND ANALYSIS: In the wake of the tragic shooting on October 12, 2011 at Salon Meritage, the City is attempting to assist and support the family and friends of the victims. Recently, staff received a request from the family of one of the victims to reserve the Marina Community Center for a memorial service reception. Additionally, in the coming weeks, staff expects similar requests for use of City facilities and special event permits for other memorial services and fundraising events for the families of victims. In order to assist the community during this difficult time, staff recommends that the Council authorize the City Manager to waive the City's fees for use of City property and special event applications for all memorial services and fundraisers related to the shooting. Staff also recommends that the City Manager be authorized to waive insurance requirements for any special event permit that might be required. CJPIA has reviewed the insurance waiver recommendation and given the extreme circumstances of this tragedy, concurs with staffs recommendation as a one -time waiver. Applicable fees that staff anticipates recommending authorization to waive include the following: Agenda Item B Special Event Permit Applications. Applications for special event permits must be accompanied by a nonrefundable fee as follows: 1 event per application $150.00 2 events per application $225.00 3 -4 events per application $325.00 5 -6 events per applications $425.00 Outdoor Facilities. Outdoor weddings, receptions, memorial services, and other group activities involving 25 or more persons on City property (including City Hall Courtyard and public beach) are subject to the following fees: Resident -1 to 2 hours $100.00 Resident — 2 to 4 hours $250.00 Non - resident — 1 to 2 hours $200.00 Non - resident — 2 to 4 hours $350.00 Indoor facilities. Use of the City's indoor facilities is subject to the following fees, which increase for groups of 76 or more. An additional $30 fee applies if alcohol will be served at the event. Deposit Staff /hr. Actual insurance fees are passed through at the market rate The City Manager can also authorize staff time for support of these events. ENVIRONMENTAL IMPACT: There is no required environmental review for this item. LEGAL ANALYSIS: The City Attorney has reviewed this item and approved the draft resolution as to form. FINANCIAL IMPACT: The fiscal impact is unknown, but it is believed to be minimal. SUBMITTED BY: Sean Crumby Assistant City Manager/ Pu lic Works NOTED AND APPROVED: Ci -:. - Page 3 RESOLUTION NUMBER 6197 A RESOLUTION OF THE SEAL BEACH CITY COUNCIL AUTHORIZING THE CITY MANAGER TO WAIVE FEES FOR USE OF CITY PROPERTY AND SPECIAL PERMIT APPLICATIONS IN CONNECTION WITH MEMORIAL SERVICES AND FUNDRAISING EVENTS RELATED TO THE OCTOBER 12, 2011 SHOOTING AT SALON MERITAGE THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: Section 1. The tragic shooting on October 12, 2011 at Salon Meritage has touched the lives of every member of the Seal Beach community and requires the whole community to work together to support the family and friends of the victims. The City Council therefore finds it in the public interest to allow the waiver of the City's usual fees and insurance requirements for use of City property and special event permits for memorial services and fundraising events related to the October 12, 2011 shooting. Section 2. The City Manager is hereby authorized to waive the City's usual and customary fees for use of City property and for special event permits for memorial services and fundraising events related to October 12, 2011 shooting. Section 3. The City Manager is hereby' authorized to waive the City's insurance requirements for use of City property and for special event permits for memorial services for victims of the October 12, 2011 shooting. Section 4. The authority granted to the City Manager in this Resolution is subject to any limitations required by the California Joint Powers Insurance Agency.
