HomeMy WebLinkAbout1 - PC Minutes 2011-10-19City of Seal Beach - Planning Commission October 19, 2011 Chair Massa -Lavitt called the regular meeting of the Planning Commission to order at 7:30 p.m. on Wednesday, October 19, 2011. The meeting was held in the City Council Chambers and began with the Salute to the Flag led by Commissioner Galbreath, and a moment of silence in memory of the victims of the October 12 shooting.' ROLL CALL Present: Chair Massa - Lavitt; Commissioners: Cummings, Everson, Galbreath, Goldberg Staff Present: Department of Development Services Mark Persico, Director Jerry Olivera, Senior Planner Steven Flower, Assistant City Attorney ORAL COMMUNICATIONS Chair Massa -Lavitt opened oral communications. There being no speakers, Chair Massa -Lavitt declared oral communications closed. AGENDA APPROVAL By motion of Chair Massa - Lavitt, the agenda was approved as presented. CONSENT CALENDAR Everson moved, second by Cummings, to approve the Consent Calendar as presented. AYES: Cummings, Everson, Goldberg, Massa -Lavitt NOES: None ABSTAIN: Galbreath Motion carried 1. Approved the Planning Commission Meeting Minutes of September 7, 2011 (Mr. Flower indicated that Commissioner Galbreath was not present at that meeting, and will abstain from voting in accordance with Commission practices). SCHEDULED MATTERS There were no matters for consideration at this time. These Minutes were transcribed from audiotape of the meeting. Page 2 — Planning Commission 08/17/11 PUBLIC HEARING 2. Conditional Use Permit 11 -11: 2365 Seal Beach Boulevard #106 (Yasai Japanese Grill) Applicant/Owner: Yunkee Min So Request: For the establishment of a Type 41 (On -sale beer and wine) ABC license at an existing restaurant within the Specific Plan Regulation (SPR) Zone. Recommendation: Approval, subject to conditions, and adoption of Resolution 11 -25. The Senior Planner presented the staff report. Chair Massa -Lavitt opened the discussion for the commission. Chair Massa -Lavitt opened the public hearing. There being no speakers, Chair Massa -Lavitt declared the public hearing closed. Everson moved, second by Galbreath, to approve Conditional Use Permit 11 -11, subject to conditions, and adopt Resolution No. 11 -25 as presented. AYES: Cummings, Everson, Galbreath, Goldberg, Massa -Lavitt NOES: None Motion carried The Assistant City Attorney advised that the adoption of Resolution No. 11 -25 begins a 10 -day calendar appeal period to the City Council. The Commission action tonight is final and the appeal period begins tomorrow morning. DIRECTOR'S REPORT Bay Theater (potential Historic Preservation designation) — staff sent letter to property owner per Commission direction at September 7, 2011 meeting — staff has not received a response from the property owner; Vacation Rentals — provided Commission with information regarding vacation rentals currently licensed — indicated City Council will be discussing issue at goal setting workshop — recommended Commission wait for Council policy direction before proceeding further; discussed upcoming agenda items for November 2, 2011 meeting. Page 3 - Planning Commission 08/17/11 COMMISSION CONCERNS Commissioner Everson: Inquired about Council reviewing Title 11 in regards to vacation rentals (response: Council is having a policy discussion on vacation rentals that may have effects on Title 11). Commissioner Goldberg: Thanked staff for compiling information and data regarding vacation rentals. ADJOURNMENT Chair Massa -Lavitt adjourned the meeting at 7:45 p.m. in memory of John Larson, a former planning commissioner and council member.
