AN ORDINANCE OF THE CITY OF SEAL BEACH
ESTABLISHING CITY COUNCIL DISTRICT BOUNDARIES AS A
RESULT OF THE FEDERAL 2010 DECENNIAL CENSUS
THE CITY COUNCIL OF THE CITY OF SEAL BEACH ORDAINS AS FOLLOWS:
SECTION 1. City Charter Section 515 provides, in relevant part:
"The five (5) members of the City Council shall be elected by districts, the
boundaries of which shall be as defined by ordinance adopted by the City
Council.
In 1980 and each 10th year thereafter, the City Council shall appoint a committee
to study and report to the City Council on the advisability of redistricting the City.
Upon receipt of any such committee report, and at any other time deemed
necessary or desirable in order that the district boundaries be in accordance with
constitutional requirement, fair and logical, the City Council may by ordinance
change and redefine the boundaries of any or all of such districts. The
boundaries so defined shall be established in such manner that the district shall,
as nearly as practicable, constitute natural areas of contiguous and compact
territory and provide fair representation on the City Council."
SECTION 2. California Elections Code Section 21620 states:
"If the members of the governing body of a chartered city are nominated or
elected 'by districts' or 'from districts,' as defined in Section 34871 of the
Government Code, upon the initial establishment thereof, the districts shall be as
nearly equal in population as may be according to the latest federal decennial
census or, if the city's charter so provides, according to the federal mid - decade
census or the official census of the city, as provided for pursuant to Chapter 17
(commencing with Section 40200) of Part 2 of Division 3 of Title 4 of the
Government Code, as the case may be. After the initial establishment of the
districts, the districts shall continue to be as nearly equal in population as may be
according to the latest federal decennial census or, if authorized by the charter of
the city, according to the federal mid - decade census. The districts shall comply
with the applicable provisions of the federal Voting Rights Act of 1965, Section
1973 of Title 42 of the United States Code, as amended. In establishing the
boundaries of the districts, the council may give consideration to the following
factors: (1) topography, (2) geography, (3) cohesiveness, contiguity, integrity,
and compactness of territory, and (4) community of interest of the districts."
SECTION 3. Pursuant to the Charter, The Council has appointed a committee to
study and report to the City Council on the advisability of redistricting the City
upon receipt of the 1980, 1990 and 2000 federal decennial censuses. The last
time the Council changed district boundaries was in connection with the 1990
census, by adopting Ordinance No. 1344. In connection with the 2010 census,
the City Council appointed a subcommittee of two councilmembers to study and
report to the City Council on the advisability of redistricting the City. The
subcommittee met on July 26, 2011, and September 19, 2011, to review Council
District boundaries and make a recommendation to the City Council. On
September 26, 2011 and October 10, 2011, the City Council held duly noticed
public hearings to receive testimony and evidence regarding the subcommittee's
report regarding council district boundaries.
SECTION 4. The City Council and its subcommittee considered: (1) topography;
(2) geography; (3) cohesiveness, contiguity, integrity, and compactness of
territory; (4) community of interest of the districts; and (5) principles of fair
representation to determine whether any of the boundaries of the districts should
be changed or modified.

SECTION 5. In view of the foregoing:
A. The boundaries for City Council Districts 2, 4 and 5 are to remain
unchanged from the boundaries established by Ordinance No. 1344.
B. The Council hereby changes and modifies the boundaries for City
Council Districts 1 and 3 to the boundaries shown on Exhibit A. Exhibit A is
hereby incorporated into this Ordinance by this reference.
C. The total population per City Council District is as follows:

District 3 - 4893

District 4 - 4972

District 5 - 4466
SECTION 6. The Council hereby amends Municipal Code Section 2.05.005 and
directs the City Engineer to revise the legal descriptions of Councilmanic Districts
Nos. 1 and 3 set forth therein to reflect the changes in boundaries identified in
Section 5B herein.
SECTION 7. The City Clerk shall certify to the adoption of this ordinance.
PASSED, APPROVED AND ADOPTED by the City Council of the City of Seal
Beach at a regular meeting held on the 24th day of October_ 2011.
