January 18, 2012
Chair Massa - Lavitt called the regular meeting of the Planning Commission to
order at 7:30 p.m. on Wednesday, January 18, 2012. The meeting was held in
the City Council Chambers with the Salute to the Flag led by Commissioner
Galbreath.'
ROLL CALL
Present: Chair Massa - Lavitt;
Commissioners: Cummings, Everson, Goldberg, Galbreath

ORAL COMMUNICATIONS
Chair Massa - Lavitt opened oral communications. There were no speakers, Chair
Massa - Lavitt declared oral communications closed.
AGENDA APPROVAL
The Assistant City Attorney recommended item 2 be pulled from the consent
calendar for separate consideration. Cummings moved, second by Everson, to
approve the agenda as amended.
AYES: Cummings, Everson, Galbreath, Goldberg, Massa - Lavitt
NOES: None Motion carried
CONSENT CALENDAR
Galbreath moved, second by Everson, to approve the recommended actions on
the consent calendar except for item 2 — pulled for separate consideration.

2011.

2. Minor Use Permit 11 -5 (A -95 Surfside Avenue)

3. Minor Use Permit 11 -6 (600 Pacific Coast Highway, Suite #200)
Request: To establish therapeutic massage as an accessory
use to an existing chiropractic office.
Recommendation: Approval, subject to conditions and adoption of
Resolution 11 -31
The Assistant City Attorney stated approval of MUP 11 -6 is the final decision of
the Planning Commission — there is a 10 day period to appeal this decision to the
City Council — this period will begin tomorrow morning (01/19/12).
To construct a glass and stucco architectural element
on the rooftop deck that is approximately 35 square
feet in area and exceeds the 35' -0" height limit by
approximately three (3) feet (approximately 38' -0"
overall height).
Recommendation: Continue item to February 1, 2012
Cummings moved, second by Everson, to continue this item to February 1, 2012.

COMMISSION CONCERNS
Commissioner Cummings inquired about the dissolution of the Redevelopment
Agency. Commissioner Goldberg stated he provided staff with pictures of the
water tower house (located on PCH), indicated the property was not on the list of
rental properties, and will they be paying Transient Occupancy Tax (TOT) —
Response: the property is located in a commercial zone, the owner was
contacted and responded, will need to have a business license to rent the
property, will be paying TOT, and will need a banner permit.
